A falta de pagamento da renda n\u00e3o determina, sem mais, a resolu\u00e7\u00e3o do contrato de arrendamento pelo senhorio e subsequente despejo, pois que, para o efeito, \u00e9 necess\u00e1rio que o inquilino esteja em mora, ou seja, que lhe seja imput\u00e1vel o retardamento da presta\u00e7\u00e3o. II. Sendo a inquilina confrontada com dois sujeitos que, simultaneamente, se arrogam, perante si, como sendo os seus credores do pagamento de rendas, intitulando-se senhorios do locado, a par da obriga\u00e7\u00e3o legal decorrente da decretada penhora, por dep\u00f3sito das rendas, efetuados pela inquilina, e por consigna\u00e7\u00e3o em dep\u00f3sito, numa outra demanda (autos de a\u00e7\u00e3o executiva), em que \u00e9 executada uma daquelas arrogadas senhorias, justifica, sem reserva, considerar que existe mora creditoris, ou seja, motivo relativo \u00e0 pessoa do credor, excluindo, por isso, a natureza culposa do n\u00e3o pagamento da renda, afastando a mora debitoris, o que imp\u00f5e considerar-se n\u00e3o verificado o pressuposto resolutivo dos n\u00bas. 3 e 4 do art.\u00ba 1083\u00b0 do C\u00f3digo Civil. III.
