K\u00e4r\u00e4j\u00e4oikeus tuomitsi tekij\u00e4t varkauden yrityksist\u00e4 rangaistuksiin ja velvoitti heid\u00e4t suorittamaan rakennuksen omistajalle yhteisvastuullisesti vahingonkorvausta. Kolmannen tekij\u00e4n menettely\u00e4 arvioitiin my\u00f6hemmin toisessa oikeudenk\u00e4ynniss\u00e4. K\u00e4r\u00e4j\u00e4oikeus totesi h\u00e4nt\u00e4 koskevassa tuomiossaan, ett\u00e4 tuossa asiassa ei ollut esitetty mit\u00e4\u00e4n n\u00e4ytt\u00f6\u00e4 tai selvityst\u00e4 huoltoasemarakennukselle aiheutuneista vahingoista. Tuomitessaan tuon asian vastaajan varkauden yrityksest\u00e4 rangaistukseen k\u00e4r\u00e4j\u00e4oikeus hylk\u00e4si rakennuksen omistajan vahingonkorvausvaatimukset.<\/p>\n<p>A valitti hovioikeuteen h\u00e4nelle tuomitusta vankeusrangaistuksesta ja korvausvelvollisuudesta. Hovioikeus ei my\u00f6nt\u00e4nyt jatkok\u00e4sittelylupaa.
