Fr\u00e5gan g\u00e4llde om h\u00f6gsta f\u00f6rvaltningsdomstolen skulle bereda bitr\u00e4det m\u00f6jlighet att yrka p\u00e5 arvode och om ett arvode enligt \u00e4rende enligt 17 a \u00a7 i r\u00e4ttshj\u00e4lpslagen och 7 a \u00a7 arvodesf\u00f6rordningen skulle fastst\u00e4llas.<\/p>\n<p>H\u00f6gsta f\u00f6rvaltningsdomstolen har i sitt \u00e5rsboksbeslut HFD 2014:177 fastst\u00e4llt att det, att bitr\u00e4det inte hade framst\u00e4llt n\u00e5got yrkande om arvode inte kunde betraktas som en s\u00e5dan i 28 \u00a7 i f\u00f6rvaltningsprocesslagen avsedd omst\u00e4ndighet med anledning av vilken domstolen borde ha berett bitr\u00e4det tillf\u00e4lle att komplettera besv\u00e4ren. N\u00e4r arvodesyrkandet inte framgick av r\u00e4tteg\u00e5ngshandlingarna och ingen faktura l\u00e4mnats till h\u00f6gsta f\u00f6rvaltningsdomstolen, var det enligt beslutet inte domstolens skyldighet att bereda bitr\u00e4det tillf\u00e4lle att framst\u00e4lla ett yrkande om arvode. Eftersom bitr\u00e4det i n\u00e4mnda fall inte under handl\u00e4ggningen hade framst\u00e4llt n\u00e5got yrkande om arvode enligt r\u00e4ttshj\u00e4lpslagen eller l\u00e4mnat n\u00e5gon faktura i vilken han i egenskap av r\u00e4tteg\u00e5ngsbitr\u00e4de skulle ha yrkat arvode, ans\u00e5g h\u00f6gsta f\u00f6rvaltningsdomstolen att arvode inte senare kunde utd\u00f6mas till bitr\u00e4det.<\/p>\n<p>H\u00f6gsta f\u00f6rvaltningsdomstolen ans\u00e5g att fr\u00e5gan g\u00e4llande komplettering i f\u00f6religgande fall skulle bed\u00f6mas p\u00e5 samma s\u00e4tt som i n\u00e4mnda \u00e5rsboksbeslut. Med beaktande av att \u00e5rsboksbeslutet inte g\u00e4llde arvode enligt \u00e4rende enligt 7a \u00a7 i arvodesf\u00f6rordningen, skulle \u00e4rendet i \u00f6vrigt bed\u00f6mas p\u00e5 nytt enligt till\u00e4mpliga stadganden.<\/p>\n<p>Enligt 12 \u00a7 1 mom. och 2 mom. 4 punkten i arvodesf\u00f6rordningen ska en beg\u00e4ran om arvode enligt 7 a \u00a7 i f\u00f6rordningen l\u00e4mnas in via justitief\u00f6rvaltningens elektroniska tj\u00e4nster. Enligt h\u00f6gsta f\u00f6rvaltningsdomstolen kan beg\u00e4ran om arvode med beaktande av 7 a \u00a7 4 mom. i arvodesf\u00f6rordningen l\u00e4mnas in \u00e4ven p\u00e5 annat s\u00e4tt, t.ex. fritt formulerat i besv\u00e4rsskriften.<\/p>\n<p>R\u00e4ttshj\u00e4lpsarvodet best\u00e4ms domstolsspecifikt och d\u00e4rf\u00f6r g\u00e4llde inte den av bitr\u00e4det i f\u00f6rvaltningsdomstolen framst\u00e4llda beg\u00e4ran om arvode i h\u00f6gsta f\u00f6rvaltningsdomstolen.
