Le preneur, une soci\u00e9t\u00e9 exploitant une r\u00e9sidence de tourisme, refusait le paiement en invoquant les cons\u00e9quences des mesures sanitaires. La juridiction a rejet\u00e9 l\u2019ensemble des moyens soulev\u00e9s par la d\u00e9fenderesse et l\u2019a condamn\u00e9e au paiement de la somme due.<\/p>\n<p>L\u2019exclusion des causes d\u2019exon\u00e9ration li\u00e9es \u00e0 la crise sanitaire<\/p>\n<p>La rejet de la perte partielle de la chose lou\u00e9e. La soci\u00e9t\u00e9 locataire invoquait l\u2019article 1722 du code civil concernant la perte partielle de la chose. Le tribunal a estim\u00e9 que les mesures administratives de fermeture ne pouvaient \u00eatre assimil\u00e9es \u00e0 cette notion. &#8220;L\u2019effet de ces mesures g\u00e9n\u00e9rales et temporaires d\u2019interdiction d\u2019accueillir du public [&#8230;] ne peut cependant pas \u00eatre assimil\u00e9 \u00e0 la perte de la chose au sens du texte susvis\u00e9&#8221; (Sur la perte partielle de la chose lou\u00e9e). Cette analyse restreint la port\u00e9e de l\u2019article 1722 aux seuls cas de destruction mat\u00e9rielle ou juridique d\u00e9finitive. Elle confirme que les perturbations temporaires de l\u2019exploitation, m\u00eame impos\u00e9es par la loi, ne lib\u00e8rent pas automatiquement le preneur de son obligation p\u00e9cuniaire.<\/p>\n<p>Le rejet de l\u2019exception d\u2019inex\u00e9cution. Le preneur opposait \u00e9galement l\u2019inex\u00e9cution des obligations du bailleur, notamment la jouissance paisible. Le juge a rappel\u00e9 les principes gouvernant cette exception. &#8220;Il appartient en outre au juge de d\u00e9cider d\u2019apr\u00e8s les circonstances si cette inex\u00e9cution est suffisamment grave&#8221; (Sur l\u2019exception d\u2019inex\u00e9cution). En l\u2019esp\u00e8ce, il a jug\u00e9 que l\u2019impossibilit\u00e9 d\u2019exploiter n\u2019\u00e9tait pas imputable au bailleur. Cette solution affirme le principe de l\u2019obligation de payer le prix malgr\u00e9 un cas de force majeure ext\u00e9rieur aux parties. Elle souligne que l\u2019exception d\u2019inex\u00e9cution suppose un manquement imputable au cocontractant et une gravit\u00e9 suffisante.<\/p>\n<p>La d\u00e9limitation des pouvoirs du juge civil et des voies de droit<\/p>\n<p>L\u2019irrecevabilit\u00e9 du grief tir\u00e9 de la Convention europ\u00e9enne. Le preneur invoquait une atteinte \u00e0 son droit de propri\u00e9t\u00e9 garanti par l\u2019article 1er du Protocole n\u00b01. Le tribunal a \u00e9cart\u00e9 ce moyen pour incomp\u00e9tence. &#8220;Le contr\u00f4le de la l\u00e9galit\u00e9 [des d\u00e9cisions administratives] ne rel\u00e8ve pas du juge civil&#8221; (Sur l&#8217;atteinte au droit de propri\u00e9t\u00e9). Cette d\u00e9cision trace une fronti\u00e8re nette entre le contentieux contractuel et le contr\u00f4le de la l\u00e9galit\u00e9 des actes administratifs. Elle rappelle que le juge civil ne peut servir de voie de recours indirect contre des mesures g\u00e9n\u00e9rales de l\u2019autorit\u00e9 publique.<\/p>\n<p>Le refus d\u2019accorder des d\u00e9lais de paiement. La soci\u00e9t\u00e9 d\u00e9bitrice sollicitait l\u2019application de l\u2019article 1343-5 du code civil. Le juge a refus\u00e9 au vu des \u00e9l\u00e9ments produits. &#8220;Elle ne communique aucune donn\u00e9e plus r\u00e9cente et ne d\u00e9montre d\u00e8s lors pas que sa situation actuelle commande qu\u2019il soit fait droit \u00e0 sa demande&#8221; (Sur la demande reconventionnelle en d\u00e9lais de paiement). Cette appr\u00e9ciation souveraine r\u00e9affirme le caract\u00e8re strictement exceptionnel des d\u00e9lais de paiement. Elle place la charge de la preuve sur le d\u00e9biteur qui doit d\u00e9montrer une situation \u00e9conomique actuelle justifiant cette faveur.<\/p>\n<p>Cette d\u00e9cision illustre la r\u00e9sistance du principe pacta sunt servanda face aux bouleversements ext\u00e9rieurs au contrat. Elle pr\u00e9cise que les mesures sanitaires, bien que contraignantes, ne constituent pas une cause l\u00e9gale d\u2019exon\u00e9ration des loyers commerciaux. Le juge civil se cantonne strictement \u00e0 l\u2019ex\u00e9cution du lien contractuel, renvoyant \u00e0 d\u2019autres juridictions le contr\u00f4le des mesures publiques.
