L\u2019int\u00e9ress\u00e9, de nationalit\u00e9 lib\u00e9rienne, fait l\u2019objet d\u2019une mesure d\u2019\u00e9loignement. Le juge des libert\u00e9s et de la d\u00e9tention, saisi conjointement d\u2019un recours contre le placement et d\u2019une requ\u00eate en prolongation, constate le d\u00e9sistement du premier. Il note l\u2019absence de critique sur les diligences administratives en cours. &#8220;Il n\u2019est \u00e9mis aucune critique sur les diligences accomplies jusqu\u2019\u00e0 pr\u00e9sent par l\u2019Administration&#8221; (Motifs). Le contr\u00f4le porte ainsi sur la r\u00e9alit\u00e9 des efforts entrepris pour organiser le d\u00e9part.<\/p>\n<p>La perspective d\u2019ex\u00e9cution dans un d\u00e9lai raisonnable guide l\u2019appr\u00e9ciation du juge. La d\u00e9cision mentionne la saisine des autorit\u00e9s consulaires pour l\u2019obtention d\u2019un laissez-passer. Cette d\u00e9marche atteste de la volont\u00e9 de l\u2019administration de concr\u00e9tiser l\u2019\u00e9loignement. Le juge v\u00e9rifie que la r\u00e9tention ne d\u00e9passe pas le temps strictement n\u00e9cessaire au d\u00e9part. Cette analyse rejoint la jurisprudence r\u00e9cente sur l\u2019exigence de perspectives raisonnables. &#8220;Il appartient au juge judiciaire d&#8217;appr\u00e9cier concr\u00e8tement au regard des donn\u00e9es de chaque situation \u00e0 la date o\u00f9 il statue, si la mesure de r\u00e9tention et sa poursuite sont justifi\u00e9es par des perspectives raisonnables de mise \u00e0 ex\u00e9cution de la mesure d\u2019\u00e9loignement&#8221; (Tribunal judiciaire de Toulouse, le 13 janvier 2025, n\u00b025\/00101). Le contr\u00f4le est donc dynamique et exigeant.<\/p>\n<p>Le rejet de l\u2019assignation \u00e0 r\u00e9sidence et ses conditions strictes<\/p>\n<p>Le juge \u00e9carte la possibilit\u00e9 d\u2019une mesure alternative \u00e0 la r\u00e9tention. L\u2019examen des garanties de repr\u00e9sentation est subordonn\u00e9 \u00e0 une condition pr\u00e9alable. La d\u00e9cision souligne que l\u2019int\u00e9ress\u00e9 ne remplit pas les crit\u00e8res l\u00e9gaux pour une assignation. &#8220;Elle n\u2019a pas pr\u00e9alablement remis \u00e0 un service de police ou \u00e0 une unit\u00e9 de gendarmerie un passeport en cours de validit\u00e9, quels que soient les m\u00e9rites de ses garanties de repr\u00e9sentation&#8221; (Motifs). La d\u00e9tention d\u2019un titre de voyage valide est ainsi \u00e9rig\u00e9e en condition sine qua non. Cette interpr\u00e9tation est rigoureuse et litt\u00e9rale.<\/p>\n<p>Cette condition formelle prime sur l\u2019appr\u00e9ciation des garanties de repr\u00e9sentation. Le juge ne proc\u00e8de m\u00eame pas \u00e0 l\u2019examen de ces garanties, pourtant \u00e9voqu\u00e9es. La solution applique strictement la lettre de l\u2019article L. 743-13 du CESEDA. Elle rejoint une jurisprudence constante sur ce point. &#8220;Le juge charg\u00e9 du contr\u00f4le de la r\u00e9tention peut toujours ordonner l&#8217;assignation \u00e0 r\u00e9sidence de l&#8217;\u00e9tranger lorsque celui-ci dispose de garanties de repr\u00e9sentation, apr\u00e8s remise aux autorit\u00e9s de police d&#8217;un passeport en cours de validit\u00e9&#8221; (Cour d\u2019appel de Paris, le 7 janvier 2025, n\u00b025\/00067). La remise du document est un pr\u00e9alable incontournable \u00e0 toute discussion sur les garanties. Cette approche limite consid\u00e9rablement le champ des alternatives \u00e0 la d\u00e9tention.<\/p>\n<p>La port\u00e9e de cette d\u00e9cision est significative pour le r\u00e9gime de la r\u00e9tention. Elle confirme la nature double du contr\u00f4le juridictionnel, \u00e0 la fois proc\u00e9dural et substantiel. Le juge v\u00e9rifie le respect des droits de la d\u00e9fense et l\u2019existence d\u2019une perspective d\u2019ex\u00e9cution. Elle renforce \u00e9galement le caract\u00e8re imp\u00e9ratif de la condition du passeport pour l\u2019assignation. Cette rigueur peut sembler protectrice de la l\u00e9galit\u00e9 mais r\u00e9duit la marge de man\u0153uvre du juge. Enfin, elle illustre la difficult\u00e9 pratique d\u2019\u00e9loigner les personnes d\u00e9pourvues de titre de voyage.
