Le bailleur, une soci\u00e9t\u00e9 civile, a notifi\u00e9 la situation \u00e0 la commission comp\u00e9tente avant d\u2019assigner les locataires d\u00e9faillants. Le juge des contentieux de la protection d\u00e9clare la demande recevable et fait droit aux principales requ\u00eates. Il constate la r\u00e9siliation du bail et ordonne l\u2019expulsion des occupants ainsi que le paiement des sommes dues.<\/p>\n<p>La r\u00e9gularit\u00e9 proc\u00e9durale de la demande en r\u00e9siliation<\/p>\n<p>Le respect des conditions pr\u00e9alables \u00e0 l\u2019action en justice. Ils doivent obligatoirement saisir une commission de pr\u00e9vention des expulsions. &#8220;les bailleurs personnes morales autres qu&#8217;une soci\u00e9t\u00e9 civile constitu\u00e9e exclusivement entre parents et alli\u00e9s jusqu&#8217;au quatri\u00e8me degr\u00e9 inclus ne peuvent faire d\u00e9livrer, sous peine d&#8217;irrecevabilit\u00e9 de la demande, une assignation aux fins de constat de r\u00e9siliation du bail avant l&#8217;expiration d&#8217;un d\u00e9lai de deux mois suivant la saisine de la commission de coordination des actions de pr\u00e9vention des expulsions locatives&#8221; (Motifs). La d\u00e9cision v\u00e9rifie scrupuleusement le respect de ce d\u00e9lai entre la saisine et l\u2019assignation. Cette analyse confirme une application rigoureuse d\u2019une r\u00e8gle d\u2019ordre public protectrice des locataires. La port\u00e9e est essentielle pour garantir la recevabilit\u00e9 de l\u2019action.<\/p>\n<p>La notification \u00e0 l\u2019autorit\u00e9 administrative comme condition de validit\u00e9. Au-del\u00e0 du d\u00e9lai, la loi impose une information du repr\u00e9sentant de l\u2019\u00c9tat. Une copie de l\u2019assignation doit lui \u00eatre notifi\u00e9e six semaines avant l\u2019audience. Le juge rel\u00e8ve que cette formalit\u00e9 a \u00e9t\u00e9 accomplie en l\u2019esp\u00e8ce dans les temps requis. Cette v\u00e9rification compl\u00e8te le contr\u00f4le de r\u00e9gularit\u00e9 de la proc\u00e9dure introduite par le bailleur. La valeur de ce point r\u00e9side dans le souci de transparence et de coordination administrative. Il s\u2019agit d\u2019assurer un suivi des situations de pr\u00e9carit\u00e9 locative par les pouvoirs publics.<\/p>\n<p>Les effets juridiques de la clause r\u00e9solutoire acquise<\/p>\n<p>La mise en \u0153uvre conventionnelle de la r\u00e9siliation de plein droit. Le juge constate la r\u00e9union des conditions contractuelles pour l\u2019acquisition de la clause. Le bail contenait une stipulation pr\u00e9voyant la r\u00e9siliation de plein droit apr\u00e8s commandement infructueux. &#8220;le pr\u00e9sent contrat sera r\u00e9sili\u00e9 de plein droit, sans qu&#8217;il soit besoin de faire prononcer cette r\u00e9siliation en justice : deux mois apr\u00e8s un commandement de payer demeur\u00e9 infructueux&#8221; (Motifs). Le commandement de payer est rest\u00e9 sans effet au-del\u00e0 du d\u00e9lai contractuel de deux mois. Le juge en d\u00e9duit la r\u00e9siliation du bail \u00e0 une date certaine. Le sens est de donner effet \u00e0 la volont\u00e9 des parties exprim\u00e9e dans un contrat l\u00e9galement form\u00e9.<\/p>\n<p>Les cons\u00e9quences civiles de l\u2019occupation sans droit ni titre. La r\u00e9siliation entra\u00eene l\u2019obligation de quitter les lieux et de r\u00e9parer le pr\u00e9judice caus\u00e9. Les anciens locataires, devenus occupants sans titre, doivent indemniser le propri\u00e9taire. Leur maintien dans les lieux constitue une faute au sens de l\u2019article 1240 du code civil. Le juge condamne donc au paiement d\u2019une indemnit\u00e9 d\u2019occupation provisionnelle jusqu\u2019\u00e0 la lib\u00e9ration effective. Cette indemnit\u00e9 est fix\u00e9e au montant du dernier loyer et charges. La port\u00e9e est de pr\u00e9venir l\u2019enrichissement sans cause et de compenser la perte de jouissance du bien.<\/p>\n<p>La condamnation au paiement des cr\u00e9ances locatives et des frais<\/p>\n<p>L\u2019allocation provisionnelle de l\u2019arri\u00e9r\u00e9 de loyers et charges. Le juge statue en r\u00e9f\u00e9r\u00e9 sur le fondement de l\u2019absence de contestation s\u00e9rieuse. Il accorde une provision sur la cr\u00e9ance locative, \u00e9tay\u00e9e par un d\u00e9compte d\u00e9taill\u00e9. La solidarit\u00e9 entre locataires, stipul\u00e9e au contrat, est appliqu\u00e9e pour le paiement de cette somme. Les int\u00e9r\u00eats l\u00e9gaux courent \u00e0 compter de la date de l\u2019assignation pour la partie de la cr\u00e9ance alors exigible. Cette solution assure au cr\u00e9ancier un recouvrement partiel rapide sans pr\u00e9juger du jugement au fond.<\/p>\n<p>La mise \u00e0 charge des d\u00e9pens et des frais non compris dans les d\u00e9pens. Suivant le principe selon lequel les d\u00e9pens suivent la d\u00e9faite, les locataires sont condamn\u00e9s aux entiers d\u00e9pens. Ceux-ci incluent sp\u00e9cifiquement les co\u00fbts des actes d\u2019huissier n\u00e9cessaires \u00e0 la proc\u00e9dure. Une somme modique est \u00e9galement allou\u00e9e au titre de l\u2019article 700 du code de proc\u00e9dure civile. Cette condamnation vise \u00e0 compenser partiellement les frais d\u2019instance expos\u00e9s par la partie gagnante.
