Le juge des contentieux de la protection, statuant en r\u00e9f\u00e9r\u00e9 le 2 octobre 2025, examine une demande en r\u00e9siliation de bail pour impay\u00e9s. Le bailleur, une soci\u00e9t\u00e9 d’habitation, a assign\u00e9 les locataires apr\u00e8s un commandement de payer demeur\u00e9 infructueux. La d\u00e9cision statue sur la recevabilit\u00e9 de la demande et les cons\u00e9quences de la clause r\u00e9solutoire. Elle accueille la demande de r\u00e9siliation mais accorde aux locataires des d\u00e9lais de paiement sous condition.<\/p>\n

La r\u00e9gularit\u00e9 proc\u00e9durale pr\u00e9alable \u00e0 l’expulsion<\/p>\n

Le juge v\u00e9rifie d’abord le respect des formalit\u00e9s protectrices impos\u00e9es au bailleur. L’article 24 de la loi du 6 juillet 1989 conditionne la recevabilit\u00e9 de l’assignation. Pour les bailleurs personnes morales, une saisine pr\u00e9alable de la commission de coordination est exig\u00e9e. Cette formalit\u00e9 est r\u00e9put\u00e9e accomplie par un signalement aux organismes payeurs d’aides. “En l’esp\u00e8ce, le bailleur justifie de la saisine de la Caisse aux Allocations Familiales (CAF) dans les d\u00e9lais l\u00e9gaux.” (Motifs de la d\u00e9cision). La demande est donc d\u00e9clar\u00e9e recevable, le bailleur ayant satisfait \u00e0 son obligation d’information. Cette analyse confirme une jurisprudence constante sur le caract\u00e8re substantiel de cette condition. La valeur de ce contr\u00f4le r\u00e9side dans la protection du locataire contre une expulsion pr\u00e9cipit\u00e9. Il impose une d\u00e9marche de pr\u00e9vention avant toute action judiciaire, pr\u00e9servant ainsi la relation contractuelle.<\/p>\n

L’efficacit\u00e9 de la clause r\u00e9solutoire de plein droit<\/p>\n

Le juge constate ensuite la r\u00e9siliation du bail en raison des impay\u00e9s persistants. Le contrat contenait une clause r\u00e9solutoire conditionn\u00e9e \u00e0 un commandement infructueux. Un tel acte a \u00e9t\u00e9 r\u00e9guli\u00e8rement signifi\u00e9 aux locataires pour un arri\u00e9r\u00e9 de loyer. “Il ressort des explications et justificatifs fournis par le bailleur que les loyers et les charges n’ont pas \u00e9t\u00e9 r\u00e9guli\u00e8rement et int\u00e9gralement pay\u00e9s.” (Motifs de la d\u00e9cision). Les causes du commandement \u00e9tant demeur\u00e9es impay\u00e9es depuis plus de deux mois, la condition est remplie. La r\u00e9siliation de plein droit est donc acquise \u00e0 la date fix\u00e9e par le commandement. Ce raisonnement souligne l’effectivit\u00e9 des clauses r\u00e9solutoires express\u00e9ment stipul\u00e9es. Elle rappelle que leur mise en \u0153uvre reste subordonn\u00e9e au respect d’une proc\u00e9dure formelle et au constat d’une inex\u00e9cution durable.<\/p>\n

Le pouvoir mod\u00e9rateur du juge sur les d\u00e9lais de paiement<\/p>\n

Le juge use ensuite de son pouvoir d’am\u00e9nagement pour att\u00e9nuer les cons\u00e9quences de la r\u00e9siliation. L’article 24 de la loi de 1989 lui permet d’accorder des d\u00e9lais de paiement. Il prend en compte la situation des d\u00e9biteurs et les propositions de r\u00e8glement formul\u00e9es. “Eu \u00e9gard au montant de la dette, aux r\u00e8glements effectu\u00e9s en cours de proc\u00e9dure […] il convient de leur accorder des d\u00e9lages de paiement.” (Motifs de la d\u00e9cision). Un \u00e9ch\u00e9ancier mensuel de cinquante euros sur trente-six mois est ainsi ordonn\u00e9. Cette mesure suspend temporairement les effets de la clause r\u00e9solutoire prononc\u00e9e. La port\u00e9e de cette d\u00e9cision est d’\u00e9quilibrer les int\u00e9r\u00eats du cr\u00e9ancier et la situation du d\u00e9biteur. Elle \u00e9vite une expulsion imm\u00e9diate tout en garantissant l’ex\u00e9cution future du contrat et le paiement des loyers courants.<\/p>\n

Le r\u00e9gime dissuasif de la suspension conditionnelle<\/p>\n

Enfin, le juge assortit la suspension de la clause r\u00e9solutoire de conditions strictes. Le b\u00e9n\u00e9fice des d\u00e9lais est subordonn\u00e9 au paiement ponctuel de chaque \u00e9ch\u00e9ance et du loyer courant. Toute d\u00e9faillance entra\u00eene la reprise imm\u00e9diate des effets de la r\u00e9siliation. “En cas de non-paiement d’une seule \u00e9ch\u00e9ance dans les d\u00e9lais en plus du loyer courant, la clause r\u00e9solutoire reprendra son plein effet.” (Motifs de la d\u00e9cision). L’int\u00e9gralit\u00e9 de la dette devient alors imm\u00e9diatement exigible et l’expulsion autoris\u00e9e. Ce dispositif conf\u00e8re une force ex\u00e9cutoire imm\u00e9diate \u00e0 la d\u00e9cision en cas de manquement. Sa valeur r\u00e9side dans son caract\u00e8re incitatif au respect de l’\u00e9ch\u00e9ancier judiciaire.
