L\u2019assur\u00e9, victime d\u2019un accident, avait per\u00e7u cette pension avant qu\u2019un contr\u00f4le ne r\u00e9v\u00e8le l\u2019absence de conditions d\u2019ouverture. La juridiction a rejet\u00e9 son recours et l\u2019a condamn\u00e9 au remboursement des sommes per\u00e7ues. Elle a ainsi pr\u00e9cis\u00e9 les r\u00e8gles probatoires applicables en mati\u00e8re de restitution d\u2019indu et d\u00e9fini les obligations respectives des parties.<\/p>\n<p>La charge de la preuve en mati\u00e8re de restitution d\u2019indu social<\/p>\n<p>La preuve de l\u2019absence de droit conditionne la r\u00e9p\u00e9tition de l\u2019indu. Le tribunal rappelle le principe g\u00e9n\u00e9ral selon lequel &#8220;ce qui a \u00e9t\u00e9 re\u00e7u sans \u00eatre d\u00fb est sujet \u00e0 restitution&#8221; (article 1302 du code civil). L\u2019organisme gestionnaire doit donc \u00e9tablir que le b\u00e9n\u00e9ficiaire ne remplissait pas les conditions l\u00e9gales pour pr\u00e9tendre \u00e0 la prestation. En l\u2019esp\u00e8ce, il a d\u00e9montr\u00e9 que l\u2019assur\u00e9 n\u2019avait effectu\u00e9 que 338 heures de travail sur la p\u00e9riode de r\u00e9f\u00e9rence. L\u2019assur\u00e9 ne contestait pas ce point et ne rapportait pas la preuve contraire. La juridiction en d\u00e9duit que l\u2019indu est parfaitement caract\u00e9ris\u00e9, permettant ainsi la condamnation au remboursement.<\/p>\n<p>La port\u00e9e de cette solution est de confirmer l\u2019application du droit commun de l\u2019enrichissement sans cause au contentieux de la s\u00e9curit\u00e9 sociale. La caisse n\u2019a pas \u00e0 rapporter la preuve d\u2019une faute du b\u00e9n\u00e9ficiaire, mais simplement celle d\u2019un paiement non d\u00fb. Cette analyse rejoint une jurisprudence constante, comme le rappelle un arr\u00eat pr\u00e9cisant que &#8220;celui qui re\u00e7oit par erreur ou sciemment ce qui ne lui est pas d\u00fb doit le restituer&#8221; (Tribunal judiciaire de Marseille, le 27 f\u00e9vrier 2025, n\u00b020\/00757). Elle s\u00e9curise ainsi l\u2019action en recouvrement des organismes sociaux.<\/p>\n<p>L\u2019inopposabilit\u00e9 des vices de proc\u00e9dure \u00e9trangers \u00e0 la constatation de l\u2019indu<\/p>\n<p>L\u2019assur\u00e9 invoquait en d\u00e9fense un vice de proc\u00e9dure pour contester la r\u00e9p\u00e9tition. Il soutenait que l\u2019organisme, n\u2019ayant pas communiqu\u00e9 une attestation de salaire erron\u00e9e, ne pouvait l\u00e9galement r\u00e9clamer l\u2019indu. Le tribunal \u00e9carte cet argument en op\u00e9rant une distinction essentielle. Les articles invoqu\u00e9s par l\u2019assur\u00e9 concernent exclusivement la proc\u00e9dure de reconnaissance du caract\u00e8re professionnel d\u2019un accident. Ils sont inapplicables \u00e0 une demande relative \u00e0 une pension d\u2019invalidit\u00e9. D\u00e8s lors, la production de cette attestation n\u2019\u00e9tait pas une condition pr\u00e9alable \u00e0 l\u2019action en recouvrement.<\/p>\n<p>La valeur de ce raisonnement est de circonscrire strictement les moyens de d\u00e9fense recevables contre une action en r\u00e9p\u00e9tition. Elle emp\u00eache le b\u00e9n\u00e9ficiaire de faire \u00e9chec au recouvrement en soulevant des irr\u00e9gularit\u00e9s sans lien avec le fond du droit. La caisse peut ainsi \u00e9tablir l\u2019indu par tout moyen, sans \u00eatre tenue \u00e0 une proc\u00e9dure formaliste pr\u00e9alable. Cette approche pragmatique assure l\u2019efficacit\u00e9 du recouvrement des prestations ind\u00fbment vers\u00e9es et pr\u00e9serve les finances des r\u00e9gimes sociaux.
