Les requ\u00e9rants, acqu\u00e9reurs d\u2019un bien, sollicitent l\u2019inclusion des vendeurs dans une mission d\u2019expertise diligent\u00e9e suite \u00e0 des d\u00e9sordres constat\u00e9s. La juridiction examine la r\u00e9gularit\u00e9 de la citation des d\u00e9fendeurs et le respect du contradictoire. Elle accueille la demande tout en \u00e9mettant des r\u00e9serves proc\u00e9durales pour l\u2019avenir.<\/p>\n<p>La r\u00e9gularit\u00e9 formelle de la citation admise<\/p>\n<p>La juridiction constate d\u2019abord la diligence du commissaire de justice. Celui-ci a entrepris des d\u00e9marches actives pour localiser les d\u00e9fendeurs. &#8220;Il est justifi\u00e9 des d\u00e9marches op\u00e9r\u00e9es par le commissaire de justice aupr\u00e8s du notaire des vendeurs pour tenter d&#8217;obtenir les renseignements actualis\u00e9s sur l&#8217;adresse des d\u00e9fendeurs&#8221; (Motifs). Cette recherche pr\u00e9alable aupr\u00e8s du notaire instrumentaire valide l\u2019effort de localisation. La cour en d\u00e9duit la r\u00e9gularit\u00e9 formelle de l\u2019acte introductif d\u2019instance. La solution s\u2019inscrit dans une jurisprudence constante sur la signification. &#8220;Le tribunal consid\u00e8re que la signification de l\u2019acte est r\u00e9guli\u00e8re&#8221; (Tribunal de commerce de Grenoble, le 23 mai 2025, n\u00b02025J00069). La port\u00e9e est claire : une diligence raisonnable suffit \u00e0 r\u00e9gulariser la citation. La valeur r\u00e9side dans l\u2019assouplissement des formalit\u00e9s de notification. L\u2019accent est mis sur la r\u00e9alit\u00e9 des efforts et non sur leur r\u00e9sultat effectif.<\/p>\n<p>Une extension conditionn\u00e9e au respect futur du contradictoire<\/p>\n<p>La d\u00e9cision ordonne l\u2019extension de l\u2019expertise aux vendeurs. &#8220;Ordonnons l&#8217;extension des op\u00e9rations d&#8217;expertise&#8221; (D\u00e9cision). Cette inclusion vise \u00e0 garantir l\u2019\u00e9quit\u00e9 proc\u00e9durale en permettant \u00e0 chacun de pr\u00e9senter ses arguments. &#8220;Pour qu&#8217;ils soient en mesure de faire valoir leur point de vue sur les responsabilit\u00e9s ou garanties \u00e9ventuelles&#8221; (Motifs). Cependant, la cour assortit cette mesure d\u2019une mise en garde s\u00e9v\u00e8re. Elle souligne que la pr\u00e9sente ordonnance ne vaut pas validation d\u00e9finitive. &#8220;Cette d\u00e9cision n&#8217;emporte pas quitus d\u00e9finitif de la r\u00e9gularit\u00e9 de la proc\u00e9dure \u00e0 l&#8217;\u00e9gard des d\u00e9fendeurs&#8221; (Motifs). La charge de localisation effective est report\u00e9e sur les demandeurs. Le sens est un \u00e9quilibre entre c\u00e9l\u00e9rit\u00e9 et droits de la d\u00e9fense. La port\u00e9e est pratique : elle oblige l\u2019avocat \u00e0 intensifier ses recherches.
