L&#8217;homologation transforme ainsi un contrat priv\u00e9 en titre ex\u00e9cutoire. Cette formalit\u00e9 permet d&#8217;assurer l&#8217;efficacit\u00e9 de l&#8217;accord en cas de manquement. La d\u00e9cision illustre le r\u00f4le du juge comme garant de la pacification des litiges. Elle s&#8217;inscrit dans la logique de l&#8217;article 768 du code de proc\u00e9dure civile.<\/p>\n<p>&#8220;Il r\u00e9sulte de la combinaison des articles 1567, 1565 et 1566 du code de proc\u00e9dure civile que l&#8217;accord auquel sont parvenues les parties m\u00eame sans qu&#8217;il ait \u00e9t\u00e9 recouru \u00e0 une m\u00e9diation, une conciliation ou une proc\u00e9dure participative peut \u00eatre soumis, aux fins de le rendre ex\u00e9cutoire, \u00e0 l&#8217;homologation du juge comp\u00e9tent pour conna\u00eetre du contentieux dans la mati\u00e8re consid\u00e9r\u00e9e&#8221; (Cour d&#8217;appel de Paris, le 20 f\u00e9vrier 2025, n\u00b024\/00513). Cette jurisprudence confirme la possibilit\u00e9 d&#8217;homologuer tout accord mettant fin \u00e0 un litige. La pr\u00e9sente ordonnance en est une application directe et pragmatique. Elle consacre l&#8217;autonomie des parties dans la r\u00e9solution de leur diff\u00e9rend. Le juge se borne \u00e0 ent\u00e9riner leur volont\u00e9 commune sans contr\u00f4ler le fond.<\/p>\n<p>La validation de la clause sur les frais consacre le principe de la charge partag\u00e9e.<\/p>\n<p>L&#8217;ordonnance ent\u00e9rine express\u00e9ment l&#8217;article premier du protocole relatif aux frais. Chaque partie supportera d\u00e9sormais les frais irr\u00e9p\u00e9tibles et les d\u00e9pens qu&#8217;elle a expos\u00e9s. Cette solution d\u00e9roge au principe g\u00e9n\u00e9ral de la condamnation aux d\u00e9pens du perdant. Elle est le reflet direct de l&#8217;accord transactionnel et de l&#8217;absence de vainqueur. Le juge homologue ainsi une r\u00e9partition conventionnelle des frais de proc\u00e9dure.<\/p>\n<p>&#8220;Dit qu&#8217;en application de l&#8217;article 1 du protocole, chacune des parties conservera \u00e0 sa charge les frais irr\u00e9p\u00e9tibles et d\u00e9pens relatifs \u00e0 la proc\u00e9dure engag\u00e9e&#8221; (Motifs de la d\u00e9cision). Cette clause est reproduite mot pour mot dans le dispositif de l&#8217;ordonnance. Elle illustre la libert\u00e9 laiss\u00e9e aux parties pour organiser les cons\u00e9quences p\u00e9cuniaires de leur accord. La jurisprudence admet couramment de telles stipulations dans les protocoles transactionnels. &#8220;Conform\u00e9ment \u00e0 l&#8217;article II du protocole transactionnel, la S.A.S. [U] [D] s\u2019est engag\u00e9e \u00e0 prendre en charge les frais irr\u00e9p\u00e9tibles et les d\u00e9pens expos\u00e9s par les demandeurs dans le cadre de la pr\u00e9sente instance&#8221; (Tribunal judiciaire, le 8 janvier 2026, n\u00b025\/00304). Cette d\u00e9cision montre la diversit\u00e9 des modalit\u00e9s possibles pour la prise en charge des frais.
