Le bailleur public sollicitait le constat de la r\u00e9siliation de baux pour loyers impay\u00e9s. Le juge a constat\u00e9 l&#8217;acquisition de la clause r\u00e9solutoire mais a \u00e9galement accord\u00e9 des d\u00e9lais de paiement suspensifs. Cette d\u00e9cision illustre la conciliation entre la protection du cr\u00e9ancier et les m\u00e9canismes de pr\u00e9vention des expulsions.<\/p>\n<p>La r\u00e9gularit\u00e9 proc\u00e9durale et le constat de la r\u00e9siliation<\/p>\n<p>Le juge a d&#8217;abord v\u00e9rifi\u00e9 le strict respect des formalit\u00e9s pr\u00e9alables \u00e0 la saisine. La notification de l&#8217;assignation au repr\u00e9sentant de l&#8217;\u00c9tat fut produite dans les d\u00e9lais l\u00e9gaux. L&#8217;information de la caisse d&#8217;allocations familiales fut \u00e9galement justifi\u00e9e par le bailleur. Ces v\u00e9rifications garantissent le respect des proc\u00e9dures de pr\u00e9vention des expulsions locatives. La demande fut ainsi d\u00e9clar\u00e9e recevable, confirmant l&#8217;importance d&#8217;un dossier complet.<\/p>\n<p>Le juge a ensuite constat\u00e9 l&#8217;acquisition de la clause r\u00e9solutoire. Le bail contenait une clause pr\u00e9voyant la r\u00e9siliation pour d\u00e9faut de paiement. Un commandement de payer fut signifi\u00e9 le 13 novembre 2024 pour un arri\u00e9r\u00e9 locatif. &#8220;Il ressort du d\u00e9compte du 1er septembre 2025 et de l&#8217;historique des paiements, que la dette locative n&#8217;a pas \u00e9t\u00e9 r\u00e9gl\u00e9e dans les deux mois du commandement&#8221; (Motifs). Le juge en a d\u00e9duit que les conditions l\u00e9gales \u00e9taient r\u00e9unies au 13 janvier 2025. Cette application stricte de l&#8217;article 24 de la loi de 1989 rejoint une jurisprudence constante. &#8220;L&#8217;article 24 de la loi du 6 juillet 1989 pr\u00e9voit que toute clause pr\u00e9voyant la r\u00e9siliation de plein droit du contrat de location pour d\u00e9faut de paiement du loyer ou des charges aux termes convenus ou pour non versement du d\u00e9p\u00f4t de garantie ne produit effet que deux mois apr\u00e8s un commandement de payer demeur\u00e9 infructueux&#8221; (Cour d&#8217;appel de Paris, le 12 mai 2022, n\u00b019\/21139). La locataire fut donc d\u00e9clar\u00e9e occupante sans droit ni titre depuis cette date.<\/p>\n<p>La suspension conditionnelle des effets et les mesures provisionnelles<\/p>\n<p>Le c\u0153ur de la d\u00e9cision r\u00e9side dans l&#8217;am\u00e9nagement des cons\u00e9quences de la r\u00e9siliation. Malgr\u00e9 l&#8217;absence de la locataire \u00e0 l&#8217;audience, le juge a exploit\u00e9 les \u00e9l\u00e9ments du dossier. Il releva que le versement du loyer courant avait repris. Le bailleur proposait lui-m\u00eame un \u00e9ch\u00e9ancier. Le juge a donc accord\u00e9 des d\u00e9lais de paiement de six mensualit\u00e9s de cent cinquante euros. &#8220;Pendant le cours des d\u00e9lais ainsi accord\u00e9s, les effets de la clause r\u00e9solutoire sont de plein droit suspendus&#8221; (Motifs). Cette suspension est une mesure de gr\u00e2ce conditionnelle, visant \u00e0 \u00e9viter l&#8217;expulsion.<\/p>\n<p>Le dispositif organise pr\u00e9cis\u00e9ment les cons\u00e9quences d&#8217;un \u00e9ventuel nouvel incident. La suspension prendrait fin d\u00e8s le premier impay\u00e9. La clause r\u00e9solutoire retrouverait alors son plein effet. &#8220;D\u00e8s le premier impay\u00e9 ou d\u00e8s lors que la locataire ne se lib\u00e8re pas de sa dette locative dans le d\u00e9lai et selon les modalit\u00e9s fix\u00e9es par le juge, cette suspension prend fin&#8221; (Motifs). L&#8217;expulsion pourrait alors \u00eatre poursuivie et une indemnit\u00e9 d&#8217;occupation serait due. Le juge en a fix\u00e9 le montant par provision. &#8220;Il convient de fixer cette indemnit\u00e9 au montant du loyer charges comprises qui aurait \u00e9t\u00e9 d\u00fb si le bail s\u2019\u00e9tait poursuivi&#8221; (Motifs). Cette approche est conforme \u00e0 la r\u00e9paration du pr\u00e9judice subi par le bailleur. &#8220;Il convient, pour r\u00e9parer ce dommage, de fixer l\u2019indemnit\u00e9 d\u2019occupation au montant des loyers et charges qui auraient \u00e9t\u00e9 dus en cas de non-r\u00e9siliation du bail&#8221; (Tribunal judiciaire de Toulouse, le 27 ao\u00fbt 2025, n\u00b025\/00330).<\/p>\n<p>Enfin, le juge a accord\u00e9 une provision sur la cr\u00e9ance locative incontestable. Il a condamn\u00e9 la locataire \u00e0 verser la somme de neuf cent quarante-deux euros. Cette somme est due \u00e0 titre provisionnel au titre de l&#8217;article 835 du code de proc\u00e9dure civile. Les d\u00e9pens et une indemnit\u00e9 au titre de l&#8217;article 700 ont \u00e9galement \u00e9t\u00e9 allou\u00e9s au bailleur. Ces condamnations financi\u00e8res compl\u00e8tent le dispositif de l&#8217;ordonnance. Elles assurent une protection imm\u00e9diate des int\u00e9r\u00eats du cr\u00e9ancier pendant la p\u00e9riode probatoire.<\/p>\n<p>Cette ordonnance de r\u00e9f\u00e9r\u00e9 manifeste la fonction \u00e9quilibr\u00e9e du juge des contentieux de la protection. Elle combine le constat strict d&#8217;une r\u00e9siliation de plein droit avec des mesures gracieuses et temporaires. Le juge utilise pleinement les outils proc\u00e9duraux pour concilier ex\u00e9cution contractuelle et pr\u00e9vention sociale. La d\u00e9cision reste toutefois ex\u00e9cutoire \u00e0 titre provisoire, pr\u00e9servant l&#8217;issue du litige au fond.
