L\u2019autorit\u00e9 administrative invoquait un d\u00e9faut de d\u00e9livrance de documents de voyage par un consulat et une menace pour l\u2019ordre public. Le juge estime que l\u2019absence de perspective raisonnable d\u2019\u00e9loignement, malgr\u00e9 les diligences, emp\u00eache toute prolongation suppl\u00e9mentaire. Il rappelle ainsi le caract\u00e8re strictement accessoire de la r\u00e9tention par rapport \u00e0 l\u2019ex\u00e9cution effective de l\u2019\u00e9loignement.<\/p>\n<p>La condition imp\u00e9rative d\u2019une perspective raisonnable d\u2019\u00e9loignement<\/p>\n<p>Le juge des libert\u00e9s et de la d\u00e9tention rappelle le principe fondamental du droit de la r\u00e9tention. Le maintien en r\u00e9tention ne peut \u00eatre justifi\u00e9 que par l\u2019existence d\u2019une perspective effective de d\u00e9part. Le juge v\u00e9rifie scrupuleusement l\u2019existence de cette condition pr\u00e9alable \u00e0 toute prolongation. Il souligne que les diligences administratives, bien que r\u00e9elles, ne suffisent pas \u00e0 \u00e9tablir cette perspective. Le silence persistant des autorit\u00e9s consulaires prive l\u2019administration d\u2019une certitude quant \u00e0 l\u2019ex\u00e9cution prochaine. Cette analyse place la r\u00e9alit\u00e9 de l\u2019\u00e9loignement possible au c\u0153ur du contr\u00f4le juridictionnel.<\/p>\n<p>Le rejet du fondement tir\u00e9 du d\u00e9faut de d\u00e9livrance de documents<\/p>\n<p>Le juge \u00e9carte l\u2019application du cas pr\u00e9vu par le code pour d\u00e9faut de d\u00e9livrance de documents. L\u2019autorit\u00e9 administrative invoquait le troisi\u00e8me motif l\u00e9gal pour solliciter la prolongation exceptionnelle. Le juge constate un silence total du consulat concern\u00e9 depuis plus de deux mois. Il estime que ce d\u00e9lai rend incertaine toute d\u00e9livrance \u00e0 bref d\u00e9lai. &#8220;Il n&#8217;est pas d\u00e9montr\u00e9 que l&#8217;\u00e9loignement peut \u00eatre men\u00e9 \u00e0 bien dans le d\u00e9lai permis par une quatri\u00e8me prolongation&#8221; (Motifs). Cette interpr\u00e9tation restrictive prot\u00e8ge la libert\u00e9 individuelle contre des d\u00e9lais ind\u00e9finis. Elle rejoint une jurisprudence exigeant des preuves concr\u00e8tes de l\u2019imminence de la d\u00e9livrance. &#8220;D\u00e8s lors, il n\u2019est nullement d\u00e9montr\u00e9 que la d\u00e9livrance des documents de voyages par un consulat devrait intervenir \u00e0 bref d\u00e9lai&#8221; (Tribunal judiciaire, le 8 mai 2025, n\u00b025\/02685).<\/p>\n<p>L\u2019inutilit\u00e9 de statuer sur la menace pour l\u2019ordre public<\/p>\n<p>Le juge se d\u00e9clare inutile d\u2019examiner le second moyen avanc\u00e9 par l\u2019administration. L\u2019absence de perspective d\u2019\u00e9loignement rend acad\u00e9mique la question d\u2019une menace pour l\u2019ordre public. &#8220;Il n&#8217;est pas besoin d&#8217;examiner si le comportement de l&#8217;int\u00e9ress\u00e9 caract\u00e9rise ou non la menace pour l&#8217;ordre public&#8221; (Motifs). Cette position affirme la hi\u00e9rarchie des conditions l\u00e9gales de prolongation. La possibilit\u00e9 effective d\u2019\u00e9loignement constitue un pr\u00e9alable absolu \u00e0 tout autre motif. La d\u00e9cision \u00e9vite ainsi de cr\u00e9er une jurisprudence sur ce point de fait dans cette affaire. Elle rappelle que la gravit\u00e9 des faits reproch\u00e9s ne saurait compenser l\u2019impossibilit\u00e9 d\u2019ex\u00e9cuter la mesure.<\/p>\n<p>La port\u00e9e d\u2019un contr\u00f4le juridictionnel renforc\u00e9 sur la dur\u00e9e<\/p>\n<p>Cette d\u00e9cision illustre un contr\u00f4le rigoureux des prolongations exceptionnelles de r\u00e9tention. Le juge refuse d\u2019ent\u00e9riner une prolongation fond\u00e9e sur une simple attente passive. Il exige une d\u00e9monstration positive de l\u2019aboutissement prochain des d\u00e9marches. Cette lecture stricte du code de l\u2019entr\u00e9e et du s\u00e9jour prot\u00e8ge contre une r\u00e9tention devenue disproportionn\u00e9e. Elle garantit que la privation de libert\u00e9 reste exceptionnelle et limit\u00e9e dans le temps. La d\u00e9cision renforce le r\u00f4le du juge des libert\u00e9s comme garant ultime du respect des d\u00e9lais l\u00e9gaux.
