Le tribunal judiciaire de Lille, statuant en r\u00e9f\u00e9r\u00e9 le 9 octobre 2025, a examin\u00e9 une demande d’extension d’une mesure d’expertise. Des propri\u00e9taires souhaitaient rendre communes \u00e0 leur assureur et \u00e0 leur locataire commercial des op\u00e9rations d’expertise diligent\u00e9es \u00e0 leur encontre. Le locataire avait form\u00e9 des demandes reconventionnelles. Le juge a accueilli la demande d’extension mais a d\u00e9clar\u00e9 irrecevables les demandes reconventionnelles. Il a \u00e9galement statu\u00e9 sur les d\u00e9pens et l’ex\u00e9cution provisoire de sa d\u00e9cision.<\/p>\n

Le motif l\u00e9gitime justifiant une mesure d’instruction anticip\u00e9e<\/p>\n

Le juge des r\u00e9f\u00e9r\u00e9s rappelle les conditions de l’article 145 du code de proc\u00e9dure civile. Une mesure d’instruction peut \u00eatre ordonn\u00e9e avant tout proc\u00e8s en pr\u00e9sence d’un motif l\u00e9gitime. Ce motif est caract\u00e9ris\u00e9 par “la probabilit\u00e9 de faits susceptibles d’\u00eatre invoqu\u00e9s dans un litige \u00e9ventuel” (Motifs de la d\u00e9cision). En l’esp\u00e8ce, la production du contrat d’assurance et du bail commercial \u00e9tablit ce lien probable. L’expertise vise \u00e0 d\u00e9terminer les responsabilit\u00e9s et les pr\u00e9judices li\u00e9s \u00e0 des d\u00e9sordres affectant l’immeuble. La solution consacre une interpr\u00e9tation large du motif l\u00e9gitime, facilitant l’administration pr\u00e9ventive de la preuve. Elle rejoint une jurisprudence constante, comme le souligne un tribunal en indiquant qu’un “int\u00e9r\u00eat manifeste” suffit (Tribunal judiciaire de Marseille, le 7 mai 2025, n\u00b025\/01135). La port\u00e9e est pratique, permettant d’associer en amont tous les acteurs potentiellement responsables.<\/p>\n

L’appr\u00e9ciation souveraine du lien suffisant pour les demandes reconventionnelles<\/p>\n

Le juge analyse ensuite la recevabilit\u00e9 des demandes du locataire commercial au regard de l’article 70 du code de proc\u00e9dure civile. Les demandes reconventionnelles doivent “se rattachent aux pr\u00e9tentions originaires par un lien suffisant” (Motifs de la d\u00e9cision). L’appr\u00e9ciation de ce lien rel\u00e8ve du pouvoir souverain des juges du fond. La d\u00e9cision pr\u00e9cise que ce lien doit \u00eatre factuel et permettre de traiter la situation dans sa globalit\u00e9. En l’esp\u00e8ce, la demande initiale concerne l’extension d’une expertise technique sur des d\u00e9sordres immobiliers. Les demandes reconventionnelles portent sur l’ex\u00e9cution du bail, comme une indemnisation pour perte d’exploitation. Le juge estime que “l\u2019objet et la finalit\u00e9” des deux s\u00e9ries de demandes sont distincts. Cette analyse restrictive \u00e9vite l’encombrement de la proc\u00e9dure rapide du r\u00e9f\u00e9r\u00e9 par des questions complexes.
