Le bailleur sollicitait l&#8217;expulsion du locataire d\u00e9faillant et le paiement des sommes dues. Le juge des contentieux de la protection a prononc\u00e9 la r\u00e9solution du contrat et ordonn\u00e9 l&#8217;expulsion. Il a \u00e9galement condamn\u00e9 la locataire au paiement des loyers et charges impay\u00e9s. La juridiction a enfin confirm\u00e9 l&#8217;application de l&#8217;ex\u00e9cution provisoire de droit \u00e0 sa d\u00e9cision.<\/p>\n<p>La mise en \u0153uvre rigoureuse de la clause r\u00e9solutoire de droit<\/p>\n<p>Le juge constate l&#8217;acquisition de la clause par le d\u00e9faut de paiement. L&#8217;application du droit ant\u00e9rieur \u00e0 la r\u00e9forme de 2023 est d&#8217;abord pr\u00e9cis\u00e9e. La d\u00e9cision rappelle le r\u00e9gime de la r\u00e9siliation de plein droit pr\u00e9vu par l&#8217;article 24. &#8220;Un commandement de payer visant cette clause a \u00e9t\u00e9 signifi\u00e9 \u00e0 Madame [Y] [E] le 4 septembre 2024 pour la somme de 1481,74 euros. Il est demeur\u00e9 infructueux pendant plus de 2 mois, de sorte qu\u2019il y a lieu de constater que les conditions d&#8217;acquisition de la clause r\u00e9solutoire contenue dans le bail \u00e9taient r\u00e9unies \u00e0 la date du 4 novembre 2024.&#8221; (Motifs, sur la r\u00e9siliation du bail). Le juge se borne ainsi \u00e0 constater la r\u00e9alisation des conditions l\u00e9gales sans pouvoir moduler ses effets. La port\u00e9e de cette analyse est stricte et marque l&#8217;opposition avec le nouveau droit. Le juge \u00e9carte ensuite l&#8217;octroi de d\u00e9lais de paiement en l&#8217;absence de demande. Le texte pr\u00e9voit que le juge peut accorder des d\u00e9lais m\u00eame d&#8217;office. L&#8217;absence de comparution du locataire et l&#8217;absence d&#8217;\u00e9l\u00e9ments sur sa situation conduisent \u00e0 ne pas en accorder. Cette approche confirme le caract\u00e8re subsidiaire de ce pouvoir d&#8217;office. La solution souligne la gravit\u00e9 des cons\u00e9quences d&#8217;une proc\u00e9dure non contradictoire.<\/p>\n<p>La confirmation syst\u00e9matique de l&#8217;ex\u00e9cution provisoire de droit<\/p>\n<p>La d\u00e9cision rejette l&#8217;\u00e9cartement de l&#8217;ex\u00e9cution provisoire au visa de l&#8217;article 514-1 du code de proc\u00e9dure civile. Le raisonnement retenu est d&#8217;abord fond\u00e9 sur une appr\u00e9ciation abstraite de la nature de l&#8217;affaire. &#8220;En l&#8217;esp\u00e8ce, l&#8217;ex\u00e9cution provisoire ne parait pas incompatible avec la nature de l&#8217;affaire, de sorte qu\u2019il n\u2019y a pas lieu de l&#8217;\u00e9carter&#8221; (Motifs, sur les autres demandes). Le juge ne proc\u00e8de \u00e0 aucune concr\u00e9tisation des cons\u00e9quences de l&#8217;expulsion pour la d\u00e9fenderesse. Cette position s&#8217;\u00e9loigne d&#8217;une jurisprudence plus protectrice. &#8220;En l&#8217;esp\u00e8ce, au regard des cons\u00e9quences graves et irr\u00e9versibles de l&#8217;ex\u00e9cution de la pr\u00e9sente d\u00e9cision, l&#8217;ex\u00e9cution provisoire risque d&#8217;entra\u00eener des cons\u00e9quences manifestement excessives privant de r\u00e9alit\u00e9 le droit au double degr\u00e9 de juridiction, et appara\u00eet, de ce fait, incompatible avec la nature de l&#8217;affaire. La valeur de la solution est restrictive et minimise le contr\u00f4le du juge. La port\u00e9e en est significative pour les proc\u00e9dures d&#8217;expulsion non contradictoires.
