Le bailleur sollicitait l&#8217;expulsion du locataire et le paiement des sommes dues. Le juge des contentieux de la protection a prononc\u00e9 la r\u00e9solution du contrat et ordonn\u00e9 l&#8217;expulsion. Il a \u00e9galement condamn\u00e9 le locataire au paiement des cr\u00e9ances et a retenu l&#8217;ex\u00e9cution provisoire de droit.<\/p>\n<p>L&#8217;application stricte de la clause r\u00e9solutoire<\/p>\n<p>La r\u00e9solution du contrat de location est intervenue en application de l&#8217;article 24 de la loi du 6 juillet 1989. Le juge a constat\u00e9 la r\u00e9union des conditions l\u00e9gales pour son jeu, le commandement de payer \u00e9tant demeur\u00e9 infructueux. &#8220;Un commandement de payer visant cette clause a \u00e9t\u00e9 signifi\u00e9 [&#8230;] le 10 septembre 2024 pour la somme de 1192,31 euros. Il est demeur\u00e9 infructueux pendant plus de 2 mois, de sorte qu\u2019il y a lieu de constater que les conditions d&#8217;acquisition de la clause r\u00e9solutoire contenue dans le bail \u00e9taient r\u00e9unies \u00e0 la date du 10 novembre 2024.&#8221; (Motifs) Le juge n&#8217;a pas accord\u00e9 de d\u00e9lai de paiement en vertu de l&#8217;article 24 V, le locataire n&#8217;ayant pas comparu pour les solliciter. Cette solution rappelle le caract\u00e8re automatique de la r\u00e9solution lorsque le locataire ne saisit pas le juge pour obtenir un am\u00e9nagement.<\/p>\n<p>La cons\u00e9quence in\u00e9luctable : l&#8217;expulsion et les condamnations p\u00e9cuniaires<\/p>\n<p>La r\u00e9siliation entra\u00eene l\u00e9galement l&#8217;expulsion, ordonn\u00e9e avec le concours de la force publique. Le juge a \u00e9galement liquid\u00e9 la cr\u00e9ance locative arr\u00eat\u00e9e \u00e0 la date de l&#8217;audience. &#8220;Habitat 08 produit \u00e0 l&#8217;audience un d\u00e9compte actualis\u00e9 de sa cr\u00e9ance, d&#8217;un montant principal de 2542,44 euros, au titre des loyers, charges et indemnit\u00e9s d&#8217;occupation dus par son locataire, justifiant ainsi du bien-fond\u00e9 de ses pr\u00e9tentions.&#8221; (Motifs) Une indemnit\u00e9 d&#8217;occupation est due jusqu&#8217;\u00e0 la lib\u00e9ration effective des lieux. Cette condamnation compl\u00e8te vise \u00e0 r\u00e9parer int\u00e9gralement le pr\u00e9judice subi par le bailleur du fait de l&#8217;occupation sans titre.<\/p>\n<p>Le maintien de l&#8217;ex\u00e9cution provisoire de droit<\/p>\n<p>Le juge a refus\u00e9 d&#8217;\u00e9carter le principe de l&#8217;ex\u00e9cution provisoire pr\u00e9vu \u00e0 l&#8217;article 514 du code de proc\u00e9dure civile. &#8220;En l&#8217;esp\u00e8ce, l&#8217;ex\u00e9cution provisoire ne parait pas incompatible avec la nature de l&#8217;affaire, de sorte qu\u2019il n\u2019y a pas lieu de l&#8217;\u00e9carter, dans les termes pr\u00e9vus par les dispositions de l&#8217;article 514-1 du m\u00eame code.&#8221; (Motifs) Cette solution s&#8217;inscrit dans le droit commun de la proc\u00e9dure, le juge estimant que les circonstances ne justifiaient pas une mesure d\u00e9rogatoire. Elle contraste avec d&#8217;autres d\u00e9cisions o\u00f9 les cons\u00e9quences de l&#8217;expulsion peuvent conduire \u00e0 la suspendre. &#8220;Attendu que cette reprise du paiement [&#8230;] conduirait [&#8230;] \u00e0 des cons\u00e9quences disproportionn\u00e9es et irr\u00e9versibles, en cas d&#8217;engagement effectif de la proc\u00e9dure d&#8217;expulsion&#8221; (Cour d&#8217;appel de Lyon, le 5 janvier 2026, n\u00b025\/00155)<\/p>\n<p>La port\u00e9e d&#8217;une d\u00e9cision r\u00e9put\u00e9e contradictoire<\/p>\n<p>L&#8217;absence du locataire \u00e0 l&#8217;audience n&#8217;a pas emp\u00each\u00e9 le jugement au fond. Statuant par jugement r\u00e9put\u00e9 contradictoire, le juge a pu examiner les pi\u00e8ces et actes de proc\u00e9dure r\u00e9guliers. La d\u00e9cision illustre les risques encourus par un d\u00e9fendeur qui ne conteste pas la demande, laissant le juge appr\u00e9cier les preuves apport\u00e9es par la seule partie pr\u00e9sente. Elle rappelle que le juge peut, mais n&#8217;est pas tenu, d&#8217;accorder des d\u00e9lais de paiement d&#8217;office.
