Cet accord mettait fin \u00e0 un litige n\u00e9 de la r\u00e9vision d\u2019un bail rural. La juridiction a homologu\u00e9 l\u2019accord et lui a donn\u00e9 force ex\u00e9cutoire, constatant l\u2019extinction de l\u2019instance. Elle a \u00e9galement statu\u00e9 sur les frais et rappel\u00e9 le caract\u00e8re provisoire de l\u2019ex\u00e9cution.<\/p>\n<p>La qualification juridique de l\u2019accord transactionnel<\/p>\n<p>L\u2019accord soumis r\u00e9pond aux crit\u00e8res l\u00e9gaux de la transaction. Le juge rappelle la d\u00e9finition fondamentale du contrat transactionnel. &#8220;La transaction est un contrat par lequel les parties, par des concessions r\u00e9ciproques, terminent une contestation n\u00e9e, ou pr\u00e9viennent une contestation \u00e0 na\u00eetre&#8221; (article 2044 du code civil). L\u2019exigence d\u2019un \u00e9crit est ainsi implicitement satisfaite par la production du protocole. La v\u00e9rification du respect des conditions de fond est donc essentielle pour le juge saisi d\u2019une demande d\u2019homologation.<\/p>\n<p>La pr\u00e9sence de concessions r\u00e9ciproques est constat\u00e9e en l\u2019esp\u00e8ce. Le tribunal note que le protocole comporte effectivement ces concessions n\u00e9cessaires. Il rel\u00e8ve aussi un accord sur la prise en charge des frais par l\u2019une des parties. Cette analyse permet de v\u00e9rifier la lic\u00e9it\u00e9 et la validit\u00e9 de l\u2019accord des volont\u00e9s. La qualification retenue ouvre la voie \u00e0 l\u2019intervention du juge pour homologuer.<\/p>\n<p>Les effets proc\u00e9duraux de l\u2019homologation judiciaire<\/p>\n<p>L\u2019homologation conf\u00e8re \u00e0 l\u2019accord priv\u00e9 la force ex\u00e9cutoire. Le tribunal fonde son pouvoir sur une disposition proc\u00e9durale pr\u00e9cise. &#8220;Il appartient au juge de donner force ex\u00e9cutoire \u00e0 l\u2019acte constatant l\u2019accord des parties&#8221; (article 384 alin\u00e9a 3 du code de proc\u00e9dure civile). Cette formalit\u00e9 transforme un contrat en titre ex\u00e9cutoire. Elle permet d\u2019assurer l\u2019effectivit\u00e9 de la solution choisie par les parties elles-m\u00eames.<\/p>\n<p>La d\u00e9cision entra\u00eene l\u2019extinction d\u00e9finitive de l\u2019instance en cours. Le juge constate cette extinction comme une cons\u00e9quence directe de l\u2019accord homologu\u00e9. Il statue \u00e9galement sur les frais de l\u2019instance \u00e9teinte, laissant chacun \u00e0 sa charge. Enfin, il rappelle le principe de l\u2019ex\u00e9cution provisoire de la d\u00e9cision. &#8220;La pr\u00e9sente d\u00e9cision est ex\u00e9cutoire \u00e0 titre provisoire&#8221; (article 514 du code de proc\u00e9dure civile). Cette mesure assure l\u2019efficacit\u00e9 imm\u00e9diate de la transaction sans attendre un \u00e9ventuel appel.<\/p>\n<p>La port\u00e9e de cette d\u00e9cision est double. Elle confirme la place centrale du juge dans l\u2019homologation des transactions, m\u00eame hors proc\u00e9dures alternatives. Elle illustre aussi la compl\u00e9mentarit\u00e9 entre l\u2019autonomie des parties et le contr\u00f4le judiciaire.
