Le Tribunal judiciaire, par jugement du 7 juillet 2025, statue sur une demande en paiement entre soci\u00e9t\u00e9s. Le d\u00e9fendeur, d\u00e9faillant, est assign\u00e9 pour le r\u00e8glement de plusieurs factures. Le juge examine le bien-fond\u00e9 de la cr\u00e9ance et les cons\u00e9quences du retard de paiement. Il accueille la demande principale et adjuge les indemnit\u00e9s l\u00e9gales, tout en rejetant une demande compl\u00e9mentaire de dommages-int\u00e9r\u00eats.<\/p>\n

La r\u00e9gularit\u00e9 de la proc\u00e9dure malgr\u00e9 la d\u00e9faillance<\/p>\n

Le cadre proc\u00e9dural de la d\u00e9cision contradictoire. L\u2019article 472 du Code de proc\u00e9dure civile s\u2019applique en cas de non-comparution du d\u00e9fendeur. Le juge statue sur le fond mais ne fait droit \u00e0 la demande que s\u2019il l\u2019estime “r\u00e9guli\u00e8re, recevable et bien fond\u00e9e”. Cette disposition prot\u00e8ge le d\u00e9fendeur absent d\u2019une demande infond\u00e9e. Elle rappelle que la d\u00e9faillance n\u2019entra\u00eene pas une admission automatique des pr\u00e9tentions adverses.<\/p>\n

L\u2019exigence de preuve du bien-fond\u00e9 de la cr\u00e9ance. Le juge constate la d\u00e9faillance de la soci\u00e9t\u00e9 assign\u00e9e, qui “n\u2019a pas constitu\u00e9 avocat”. Il base sa d\u00e9cision sur la production par le demandeur du contrat initial, de trois avenants et de quatre factures sp\u00e9cifiques. La cr\u00e9ance est jug\u00e9e “suffisamment justifi\u00e9e” par ces pi\u00e8ces. Le d\u00e9fendeur ne rapportant pas la preuve du paiement, sa condamnation est prononc\u00e9e. Cette analyse place la charge de la preuve sur le demandeur, m\u00eame en l\u2019absence de contradiction.<\/p>\n

Les cons\u00e9quences p\u00e9cuniaires du retard de paiement<\/p>\n

Le r\u00e9gime l\u00e9gal des int\u00e9r\u00eats et de l\u2019indemnit\u00e9 forfaitaire. Le juge applique l\u2019article L.441-10 II du code de commerce concernant les int\u00e9r\u00eats de retard. Il retient le taux contractuel, fix\u00e9 \u00e0 “trois fois le taux d’int\u00e9r\u00eat l\u00e9gal”, applicable d\u00e8s le lendemain de l\u2019exigibilit\u00e9. Par ailleurs, il condamne au paiement d\u2019une “indemnit\u00e9 forfaitaire pour frais de recouvrement d\u2019un montant de 40 euros” par facture impay\u00e9e. Cette application stricte de la loi vise \u00e0 compenser les frais induits par le recouvrement.<\/p>\n

La distinction entre indemnit\u00e9s l\u00e9gales et dommages-int\u00e9r\u00eats. Le tribunal rejette la demande de dommages et int\u00e9r\u00eats compl\u00e9mentaires. Il motive ce rejet par l\u2019absence de justification d\u2019un “pr\u00e9judice subi distinct de celui occasionn\u00e9 par le seul retard de paiement”. Ce pr\u00e9judice est d\u00e9j\u00e0 indemnis\u00e9 par les int\u00e9r\u00eats moratoires. Cette solution rappelle le caract\u00e8re suffisant et forfaitaire des sanctions pr\u00e9vues par le code de commerce. Elle rejoint la position de la Cour d\u2019appel de Paris, qui a jug\u00e9 que “l’indemnit\u00e9 forfaitaire pour frais de recouvrement est due de plein droit” (Cour d’appel de Paris, le 19 octobre 2023, n\u00b023\/03142).
