Ces derniers sollicitaient la r\u00e9paration de nombreux d\u00e9sordres affectant leur logement, invoquant diverses garanties et responsabilit\u00e9s contractuelles \u00e0 l\u2019encontre du vendeur, du ma\u00eetre d\u2019\u0153uvre et des entreprises. La juridiction a proc\u00e9d\u00e9 \u00e0 une analyse d\u00e9taill\u00e9e des d\u00e9sordres par lot, en qualifiant leur nature juridique et en d\u00e9terminant les responsabilit\u00e9s engag\u00e9es. Elle a retenu la responsabilit\u00e9 d\u00e9cennale pour certains d\u00e9sordres \u00e9lectriques et la garantie des vices apparents pour la majorit\u00e9 des autres, condamnant les d\u00e9fendeurs in solidum \u00e0 payer les travaux de r\u00e9paration et divers pr\u00e9judices.<\/p>\n<p>La qualification rigoureuse des d\u00e9sordres<\/p>\n<p>La distinction fondamentale entre garantie d\u00e9cennale et garantie des vices apparents<\/p>\n<p>Le tribunal op\u00e8re une qualification pr\u00e9cise des d\u00e9sordres en fonction de leur gravit\u00e9 et de leur visibilit\u00e9 \u00e0 la r\u00e9ception. Pour les d\u00e9sordres \u00e9lectriques, il retient le caract\u00e8re d\u00e9cennal lorsque les d\u00e9fauts, non visibles \u00e0 la r\u00e9ception, font porter un risque pour la s\u00e9curit\u00e9 des personnes. Il juge ainsi que &#8220;l\u2019absence d\u2019installation de prises de sol \u00e9tanches sur la terrasse susceptible de faire disjoncter l\u2019installation en cas de pluie et qui caract\u00e9rise \u00e0 ce titre un risque pour la s\u00e9curit\u00e9 des personnes, constitue un d\u00e9sordre non visible \u00e0 la r\u00e9ception qui doit \u00eatre qualifi\u00e9 de d\u00e9cennal en ce qu\u2019il rend impropre l\u2019ouvrage \u00e0 sa destination d\u2019habitation&#8221; (Motifs, I.A). \u00c0 l\u2019inverse, les d\u00e9sordres purement esth\u00e9tiques ou de conformit\u00e9 contractuelle visiblement non r\u00e9serv\u00e9s sont exclus du champ d\u00e9cennal. Cette analyse restrictive de la garantie d\u00e9cennale, r\u00e9serv\u00e9e aux d\u00e9sordres graves et cach\u00e9s, est conforme \u00e0 la jurisprudence constante. Elle rappelle utilement que tous les d\u00e9fauts de construction ne rel\u00e8vent pas automatiquement de cette garantie, prot\u00e9geant ainsi les constructeurs de demandes excessives.<\/p>\n<p>L\u2019exclusion de la garantie de parfait ach\u00e8vement et le sort des d\u00e9sordres non r\u00e9serv\u00e9s<\/p>\n<p>La d\u00e9cision \u00e9carte d\u2019embl\u00e9e la garantie de parfait ach\u00e8vement, les demandeurs ne fondant pas leur action sur ce fondement. Elle pr\u00e9cise n\u00e9anmoins que cette garantie &#8220;n\u2019\u00e9tant par ailleurs pas exclusive de l\u2019action en responsabilit\u00e9 contractuelle, il n\u2019y a pas lieu de statuer sur cette fin de non-recevoir&#8221; (Motifs, I). Concernant les d\u00e9sordres apparents non r\u00e9serv\u00e9s \u00e0 la r\u00e9ception, le tribunal applique strictement l\u2019effet purgeur de la r\u00e9ception. Il estime ainsi qu\u2019un d\u00e9faut de conformit\u00e9 aux documents contractuels, visible et non r\u00e9serv\u00e9, ne peut plus donner lieu \u00e0 action contre l\u2019entrepreneur. Cette solution souligne l\u2019importance cruciale de la diligence du ma\u00eetre d\u2019ouvrage lors des op\u00e9rations de r\u00e9ception. Elle rejoint la d\u00e9finition de la garantie de parfait ach\u00e8vement rappel\u00e9e par d\u2019autres juridictions, qui couvre les d\u00e9sordres &#8220;signal\u00e9s par le ma\u00eetre de l&#8217;ouvrage, soit au moyen de r\u00e9serves mentionn\u00e9es au proc\u00e8s-verbal de r\u00e9ception, soit par voie de notification \u00e9crite pour ceux r\u00e9v\u00e9l\u00e9s post\u00e9rieurement \u00e0 la r\u00e9ception&#8221; (Tribunal judiciaire de Boulogne-sur-Mer, le 4 mars 2025, n\u00b023\/02726).<\/p>\n<p>L\u2019articulation complexe des responsabilit\u00e9s et des recours<\/p>\n<p>La responsabilit\u00e9 in solidum des constructeurs et le recours du vendeur VEFA<\/p>\n<p>Le tribunal met en \u0153uvre le principe de la responsabilit\u00e9 in solidum des constructeurs au titre de la garantie d\u00e9cennale, conform\u00e9ment \u00e0 l\u2019article 1792 du code civil. Il condamne ainsi solidairement le vendeur, le ma\u00eetre d\u2019\u0153uvre et l\u2019entreprise d\u2019\u00e9lectricit\u00e9. Il reconna\u00eet ensuite au vendeur un recours int\u00e9gral contre les autres constructeurs, en l\u2019absence de faute qui lui serait imputable. Le jugement \u00e9nonce que &#8220;sauf faute prouv\u00e9e qui lui soit imputable, le vendeur d&#8217;un immeuble \u00e0 construire, pris en sa qualit\u00e9 de ma\u00eetre de l&#8217;ouvrage, dispose d&#8217;un recours pour le tout contre les entrepreneurs responsables des dommages de nature d\u00e9cennale&#8221; (Motifs, I.B.5). Ce m\u00e9canisme prot\u00e8ge efficacement le vendeur, simple ma\u00eetre de l\u2019ouvrage, qui endosse une responsabilit\u00e9 l\u00e9gale envers l\u2019acqu\u00e9reur mais peut se retourner int\u00e9gralement contre les v\u00e9ritables auteurs des d\u00e9sordres. Il assure une indemnisation rapide \u00e0 la victime tout en permettant une r\u00e9partition ultime de la charge.<\/p>\n<p>La d\u00e9termination des parts de faute dans les rapports entre cooblig\u00e9s<\/p>\n<p>Apr\u00e8s avoir prononc\u00e9 des condamnations in solidum, le tribunal proc\u00e8de \u00e0 une d\u00e9licate r\u00e9partition des responsabilit\u00e9s dans les rapports entre les diff\u00e9rents cooblig\u00e9s. Il \u00e9value les fautes respectives de chacun pour fixer leur contribution d\u00e9finitive \u00e0 la dette. Pour les d\u00e9sordres \u00e9lectriques d\u00e9cennaux, il attribue ainsi 70% de la faute \u00e0 l\u2019entreprise d\u2019\u00e9lectricit\u00e9 et 30% au ma\u00eetre d\u2019\u0153uvre, ce dernier ayant manqu\u00e9 \u00e0 son obligation de contr\u00f4le. Le jugement rappelle que &#8220;la proportion, dans laquelle les diff\u00e9rents cooblig\u00e9s in solidum doivent, dans leurs rapports r\u00e9ciproques, supporter la charge de la dette, est d\u00e9termin\u00e9e \u00e0 l\u2019aune de la faute commise par chacun d\u2019eux&#8221; (Motifs, I.B.6). Cette analyse fine, qui d\u00e9passe la simple solidarit\u00e9, est essentielle pour r\u00e9gler les recours entre professionnels et d\u00e9signer le principal responsable.
