La d\u00e9fenderesse, d\u00e9faillante, ne conteste pas la cr\u00e9ance r\u00e9clam\u00e9e. Le juge doit v\u00e9rifier le bien-fond\u00e9 de la demande malgr\u00e9 cette absence. Il accueille la requ\u00eate en condamnant la consommatrice au paiement du solde des factures impay\u00e9es. Cette d\u00e9cision pr\u00e9cise les conditions de preuve du lien contractuel en mati\u00e8re de consommation.<\/p>\n<p>La preuve du contrat par les \u00e9l\u00e9ments de fait<\/p>\n<p>Le juge exige la d\u00e9monstration de l\u2019existence du lien contractuel par le demandeur. L\u2019absence de contrat sign\u00e9 ne fait pas obstacle \u00e0 cette preuve. La cr\u00e9anci\u00e8re produit un mandat de pr\u00e9l\u00e8vement sign\u00e9 et des factures pay\u00e9es. &#8220;L&#8217;ensemble de ses \u00e9l\u00e9ments d\u00e9montrent que [la d\u00e9fenderesse] a entendu souscrire un contrat&#8221; (Motifs). Ces indices s\u00e9rieux et concordants \u00e9tablissent une volont\u00e9 contractuelle non \u00e9quivoque. La jurisprudence reconna\u00eet qu\u2019un abonnement implique un engagement contractuel (Tribunal de commerce de Bobigny, le 3 avril 2025, n\u00b02025R00069). La port\u00e9e est large car elle valide une preuve par faisceau d\u2019indices. Cette solution s\u00e9curise les relations commerciales courantes fond\u00e9es sur des actes sous seing priv\u00e9.<\/p>\n<p>L\u2019application du droit commun des contrats et des obligations<\/p>\n<p>Le juge \u00e9carte l\u2019application des anciens articles du code civil invoqu\u00e9s par erreur. Le contrat \u00e9tant post\u00e9rieur \u00e0 la r\u00e9forme, le droit moderne des obligations s\u2019applique. Il rappelle le principe de force obligatoire des conventions. &#8220;Les contrats l\u00e9galement form\u00e9s tiennent lieu de loi \u00e0 ceux qui les ont faits&#8221; (Motifs, art. 1103 C. civ.). Le d\u00e9faut de paiement constitue une inex\u00e9cution contractuelle caract\u00e9ris\u00e9e. La mise en demeure fait courir les int\u00e9r\u00eats moratoires sans preuve de pr\u00e9judice. La valeur de cette analyse est de rappeler la hi\u00e9rarchie des sources et la date d\u2019entr\u00e9e en vigueur des textes. Elle garantit une application rigoureuse et actualis\u00e9e du droit positif aux litiges.<\/p>\n<p>La fixation de la cr\u00e9ance et des int\u00e9r\u00eats moratoires<\/p>\n<p>Le juge proc\u00e8de \u00e0 un calcul pr\u00e9cis du solde restant d\u00fb sur la base des pi\u00e8ces comptables. Il retient le montant actualis\u00e9 pr\u00e9sent\u00e9 par le cr\u00e9ancier. La d\u00e9fenderesse n\u2019ayant oppos\u00e9 aucune contestation s\u00e9rieuse, la dette est \u00e9tablie. &#8220;Les motifs \u00e9nonc\u00e9s dans l\u2019assignation, les explications fournies \u00e0 la barre ainsi que les pi\u00e8ces pr\u00e9sent\u00e9es puis examin\u00e9es et consid\u00e9r\u00e9es comme probantes \u00e9tablissent l&#8217;existence d&#8217;une obligation qui n&#8217;est pas s\u00e9rieusement contestable&#8221; (Tribunal judiciaire de Saint-Malo, le 3 novembre 2025, n\u00b023\/01543). Le point de d\u00e9part des int\u00e9r\u00eats est fix\u00e9 \u00e0 la r\u00e9ception de la mise en demeure. Cette m\u00e9thode prot\u00e8ge le cr\u00e9ancier tout en respectant les exigences de la proc\u00e9dure contradictoire.<\/p>\n<p>Les cons\u00e9quences proc\u00e9durales de la d\u00e9faillance<\/p>\n<p>La d\u00e9cision est rendue en l\u2019absence de la partie d\u00e9fenderesse conform\u00e9ment \u00e0 la loi. L\u2019article 472 du code de proc\u00e9dure civile permet de statuer au fond malgr\u00e9 la d\u00e9faillance. Le juge ne fait droit \u00e0 la demande que s\u2019il l\u2019estime r\u00e9guli\u00e8re et bien fond\u00e9e. Il rejette la demande au titre de l\u2019article 700 du code de proc\u00e9dure civile. La condamnation aux d\u00e9pens est prononc\u00e9e contre la partie succombante. La port\u00e9e de ce raisonnement est de rappeler les pouvoirs du juge en cas de non-comparution.
