Le bailleur a sollicit\u00e9 la r\u00e9siliation du bail pour d\u00e9faut de paiement et l&#8217;expulsion de la locataire. Le juge a constat\u00e9 la r\u00e9gularit\u00e9 de la proc\u00e9dure et l&#8217;acquisition de la clause r\u00e9solutoire. Il a ordonn\u00e9 l&#8217;expulsion et condamn\u00e9 la locataire au paiement des sommes dues. La d\u00e9cision illustre le r\u00e9gime protecteur encadrant la r\u00e9siliation pour impay\u00e9s.<\/p>\n<p>La r\u00e9gularit\u00e9 proc\u00e9durale de la demande en r\u00e9siliation<\/p>\n<p>Le juge v\u00e9rifie d&#8217;abord le strict respect des formalit\u00e9s pr\u00e9alables \u00e0 l&#8217;action. La notification de l&#8217;assignation \u00e0 la pr\u00e9fecture est une condition de recevabilit\u00e9 imp\u00e9rative. &#8220;Une copie de l\u2019assignation a \u00e9t\u00e9 notifi\u00e9e \u00e0 la pr\u00e9fecture des Bouches du Rh\u00f4ne le 8 avril 2025, soit plus de six semaines avant la premi\u00e8re audience&#8221; (Motifs). Ce d\u00e9lai permet \u00e0 l&#8217;autorit\u00e9 publique d&#8217;exercer son droit d&#8217;intervention. Le juge rel\u00e8ve ainsi la parfaite conformit\u00e9 de la d\u00e9marche proc\u00e9durale initi\u00e9e par le bailleur. Cette v\u00e9rification pr\u00e9alable est essentielle pour assurer la s\u00e9curit\u00e9 juridique.<\/p>\n<p>Le juge rappelle ensuite le caract\u00e8re d&#8217;ordre public des r\u00e8gles protectrices du locataire. Le d\u00e9lai de gr\u00e2ce est un minimum intangible offert au d\u00e9biteur. &#8220;Le d\u00e9lai de deux mois ou de six semaines est un d\u00e9lai minimum donn\u00e9 au locataire pour r\u00e9gulariser la dette locative&#8221; (Motifs). Ce principe neutralise temporairement les effets de la clause r\u00e9solutoire. La jurisprudence ant\u00e9rieure confirmait d\u00e9j\u00e0 cette analyse protectrice. &#8220;Il r\u00e9sulte des dispositions de l\u2019article 7 a) de la Loi 89-462 du 6 juillet 1989 que les locataires sont oblig\u00e9s de payer le loyer et les charges aux termes convenus. En application de l\u2019article 24 de la loi pr\u00e9cit\u00e9e, dans sa r\u00e9daction ant\u00e9rieure \u00e0 la loi du 27 juillet 2023 pour se conformer aux dispositions contractuelles, la r\u00e9siliation du contrat de location pour d\u00e9faut de paiement du loyer ou des charges aux termes convenus ne produit effet que deux mois apr\u00e8s un commandement de payer, demeur\u00e9 infructueux&#8221; (Tribunal judiciaire de Pontoise, le 10 d\u00e9cembre 2025, n\u00b025\/00323). La pr\u00e9sente d\u00e9cision s&#8217;inscrit dans cette continuit\u00e9.<\/p>\n<p>La mise en \u0153uvre des cons\u00e9quences de la r\u00e9siliation<\/p>\n<p>Le juge constate la r\u00e9union des conditions d&#8217;acquisition de la clause r\u00e9solutoire. Le commandement de payer est demeur\u00e9 infructueux au-del\u00e0 du d\u00e9lai contractuel. &#8220;Le commandement de payer est demeur\u00e9 infructueux pendant plus de deux mois, de sorte qu\u2019il y a lieu de constater que les conditions d\u2019acquisition de la clause r\u00e9solutoire contenue dans le bail sont r\u00e9unies&#8221; (Motifs). Cette constatation entra\u00eene la r\u00e9siliation du contrat de location. Une autre jurisprudence avait d\u00e9j\u00e0 proc\u00e9d\u00e9 \u00e0 une telle constatation. &#8220;En cons\u00e9quence, il y a lieu de constater l\u2019acquisition de la clause r\u00e9solutoire ins\u00e9r\u00e9e dans le bail au 24 mars 2025&#8221; (Tribunal judiciaire de Grasse, le 5 f\u00e9vrier 2026, n\u00b025\/01252). Le juge en tire toutes les cons\u00e9quences l\u00e9gales.<\/p>\n<p>Il ordonne ensuite l&#8217;expulsion et statue sur les cons\u00e9quences p\u00e9cuniaires de l&#8217;occupation sans droit. Le maintien dans les lieux apr\u00e8s la r\u00e9siliation constitue une faute civile. &#8220;Le maintien dans les lieux post\u00e9rieurement \u00e0 la date d\u2019expiration du bail constitue une faute civile ouvrant droit \u00e0 r\u00e9paration&#8221; (Motifs). L&#8217;indemnit\u00e9 d&#8217;occupation est fix\u00e9e au montant du dernier loyer connu. Le juge accorde \u00e9galement une provision sur la cr\u00e9ance incontestable. Il rejette toutefois la demande de suppression des d\u00e9lais d&#8217;expulsion.
