Apr\u00e8s un commandement demeur\u00e9 infructueux, le bailleur sollicitait l&#8217;expulsion des locataires et le paiement des sommes dues. Le juge a constat\u00e9 la r\u00e9gularit\u00e9 de la proc\u00e9dure et la r\u00e9siliation du bail, ordonn\u00e9 l&#8217;expulsion et condamn\u00e9 les locataires au paiement.<\/p>\n<p>La r\u00e9gularit\u00e9 proc\u00e9durale comme condition pr\u00e9alable \u00e0 la r\u00e9solution<\/p>\n<p>Le strict respect des formalit\u00e9s l\u00e9gales encadre la mise en \u0153uvre de la clause r\u00e9solutoire. Le juge v\u00e9rifie scrupuleusement le respect des d\u00e9lais et des notifications impos\u00e9s par la loi. La saisine de la commission de coordination et la notification \u00e0 la pr\u00e9fecture sont des conditions de recevabilit\u00e9 imp\u00e9ratives. &#8220;Une copie de l\u2019assignation a \u00e9t\u00e9 notifi\u00e9e \u00e0 la pr\u00e9fecture [&#8230;] plus de six semaines avant l\u2019audience, conform\u00e9ment aux dispositions de l\u2019article 24 III&#8221; (Motifs). Le bailleur justifie \u00e9galement avoir saisi la commission deux mois avant l&#8217;assignation. Cette v\u00e9rification pr\u00e9alable prot\u00e8ge le locataire contre une expulsion pr\u00e9cipit\u00e9e. Elle garantit que les mesures d&#8217;accompagnement social ont bien \u00e9t\u00e9 envisag\u00e9es. La proc\u00e9dure est ainsi valid\u00e9e dans son ensemble avant examen du fond.<\/p>\n<p>L&#8217;acquisition de la clause r\u00e9solutoire et ses cons\u00e9quences inexorables<\/p>\n<p>Le d\u00e9faut de paiement dans le d\u00e9lai l\u00e9gal entra\u00eene la r\u00e9siliation de plein droit du contrat de bail. Le commandement de payer, r\u00e9gulier en la forme, d\u00e9clenche un d\u00e9lai de six semaines pour le locataire. &#8220;Ce commandement comporte les mentions obligatoires prescrites \u00e0 peine de nullit\u00e9 \u00e0 l&#8217;article 24 I&#8221; (Motifs). L&#8217;absence de paiement dans ce d\u00e9lai rend la clause automatiquement acquise. Le juge ne fait que constater cet effet de loi attach\u00e9 au contrat. &#8220;Faute d&#8217;avoir pay\u00e9 ou contest\u00e9 les sommes vis\u00e9es au commandement dans le d\u00e9lai imparti, le locataire ne peut remettre en cause l&#8217;acquisition de la clause r\u00e9solutoire&#8221; (Cour d&#8217;appel de Versailles, le 8 f\u00e9vrier 2024, n\u00b023\/03675). La r\u00e9solution prend effet \u00e0 une date certaine, transformant l&#8217;occupation en situation d&#8217;occupation sans titre.<\/p>\n<p>L&#8217;impossibilit\u00e9 d&#8217;accorder des d\u00e9lais de paiement en l&#8217;absence de reprise des loyers<\/p>\n<p>Le pouvoir d&#8217;octroyer des d\u00e9lais au locataire est strictement conditionn\u00e9 par la loi. Le juge rappelle que cette facult\u00e9 est subordonn\u00e9e \u00e0 deux crit\u00e8res cumulatifs. Le locataire doit \u00eatre en situation de r\u00e9gler sa dette et avoir repris le paiement int\u00e9gral du loyer courant. &#8220;Le juge ne peut accorder des d\u00e9lais qu&#8217;au locataire en situation de r\u00e9gler sa dette locative et ayant repris le versement int\u00e9gral du loyer courant avant la date de l&#8217;audience&#8221; (Motifs). En l&#8217;esp\u00e8ce, ni le paiement des loyers courants ni la capacit\u00e9 de d\u00e9sint\u00e9ressement ne sont \u00e9tablis. La dette a m\u00eame augment\u00e9 depuis le commandement. Cette absence de reprise de paiement ferme la voie \u00e0 tout am\u00e9nagement judiciaire. &#8220;L\u2019article 24 V de la loi du 6 juillet 1989 [&#8230;] pr\u00e9voit que le juge peut [&#8230;] accorder des d\u00e9lais de paiement [&#8230;] \u00e0 la condition que le locataire soit en situation de r\u00e9gler sa dette locative et qu&#8217;il ait repris le versement int\u00e9gral du loyer courant&#8221; (Tribunal judiciaire de Bordeaux, le 16 janvier 2026, n\u00b025\/01804). Le refus de d\u00e9lais est donc une application n\u00e9cessaire de la loi.<\/p>\n<p>Les cons\u00e9quences p\u00e9cuniaires de l&#8217;occupation sans titre apr\u00e8s r\u00e9siliation<\/p>\n<p>La r\u00e9siliation du bail g\u00e9n\u00e8re une obligation de lib\u00e9rer les lieux et de payer une indemnit\u00e9 d&#8217;occupation. Les locataires sont condamn\u00e9s \u00e0 quitter les lieux avec le concours de la force publique si n\u00e9cessaire. Leur occupation constitue d\u00e9sormais un trouble manifestement illicite pour le propri\u00e9taire. Ils doivent \u00e9galement solder l&#8217;arri\u00e9r\u00e9 de loyers et charges jusqu&#8217;\u00e0 la date de r\u00e9solution. &#8220;MONSIEUR [W] [B] [X] ET MADAME [V] [U] seront donc condamn\u00e9s au paiement de la somme de 4577,85 euros \u00e0 titre de l&#8217;arri\u00e9r\u00e9 de loyers&#8221; (Motifs). Une indemnit\u00e9 d&#8217;occupation \u00e9quivalente au dernier loyer est due jusqu&#8217;\u00e0 la lib\u00e9ration effective. Cette condamnation r\u00e9pare le pr\u00e9judice r\u00e9sultant de l&#8217;occupation indue du logement.
