Les premiers r\u00e9clamaient r\u00e9paration pour des d\u00e9sordres persistants affectant leur maison, vendue durant la proc\u00e9dure. Le promoteur opposait leur irrecevabilit\u00e9 et formulait une demande reconventionnelle en paiement d\u2019un solde consign\u00e9. Le tribunal a d\u00e9clar\u00e9 les anciens propri\u00e9taires recevables \u00e0 agir pour leur pr\u00e9judice personnel ant\u00e9rieur \u00e0 la vente. Il a retenu la responsabilit\u00e9 contractuelle du vendeur pour d\u00e9faut de conformit\u00e9, allouant une indemnit\u00e9 pour pr\u00e9judice de jouissance mais rejetant la demande de moins-value. Il a \u00e9galement accueilli la demande en d\u00e9consignation du promoteur et ordonn\u00e9 des garanties entre les diff\u00e9rents constructeurs.<\/p>\n<p>La recevabilit\u00e9 de l\u2019action apr\u00e8s la cession du bien<\/p>\n<p>L\u2019admissibilit\u00e9 du pr\u00e9judice personnel de l\u2019ancien propri\u00e9taire.<\/p>\n<p>Le promoteur soutenait l\u2019irrecevabilit\u00e9 des demandes des anciens acqu\u00e9reurs apr\u00e8s la vente de leur bien. Le tribunal a \u00e9cart\u00e9 cette fin de non-recevoir en reconnaissant la persistance d\u2019un int\u00e9r\u00eat \u00e0 agir. Il a estim\u00e9 que les \u00e9poux all\u00e9guaient un pr\u00e9judice personnel, distinct de la propri\u00e9t\u00e9 du bien, justifiant leur action. &#8220;Ils all\u00e8guent un \u00e9ventuel pr\u00e9judice personnel, de l\u2019ordre du pr\u00e9judice de jouissance et de la moins value lors de la cession, leur conf\u00e9rant un int\u00e9r\u00eat direct et certain \u00e0 agir apr\u00e8s la vente de la maison.&#8221; (Motifs, sur la fin de non-recevoir). Cette solution consacre l\u2019autonomie du pr\u00e9judice subi par l\u2019acqu\u00e9reur en sa qualit\u00e9 d\u2019occupant, pr\u00e9judice qui survit \u00e0 la cession du droit de propri\u00e9t\u00e9. Elle \u00e9vite qu\u2019un manquement contractuel prolong\u00e9 ne reste impuni du seul fait d\u2019une mutation intervenant avant jugement.<\/p>\n<p>Les limites de la transmission des actions au sous-acqu\u00e9reur.<\/p>\n<p>Le tribunal a pr\u00e9cis\u00e9 le r\u00e9gime des actions en responsabilit\u00e9 transmises \u00e0 la suite de la vente. Il a rappel\u00e9 le principe de la subrogation du sous-acqu\u00e9reur dans les droits de son auteur, y compris pour les d\u00e9sordres apparus avant la vente. &#8220;Il est de principe que le sous- acqu\u00e9reur jouit de tous les droits et actions attach\u00e9es \u00e0 la chose qui appartenaient \u00e0 son auteur, de sorte qu&#8217;il dispose, le cas \u00e9ch\u00e9ant, de l&#8217; action en responsabilit\u00e9 contractuelle dont son vendeur aurait b\u00e9n\u00e9fici\u00e9.&#8221; (Motifs, sur la fin de non-recevoir). Cette analyse distingue nettement l\u2019action contractuelle, transmise avec la chose, du pr\u00e9judice personnel de l\u2019ancien propri\u00e9taire, qui demeure propre \u00e0 celui-ci. Elle assure une continuit\u00e9 dans la r\u00e9paration des d\u00e9sordres tout en pr\u00e9servant les droits sp\u00e9cifiques de chaque partie concern\u00e9e par la cha\u00eene de vente.<\/p>\n<p>L\u2019appr\u00e9ciation des manquements contractuels et leurs cons\u00e9quences<\/p>\n<p>La caract\u00e9risation de la faute par la non-lev\u00e9e des r\u00e9serves.<\/p>\n<p>La responsabilit\u00e9 du promoteur a \u00e9t\u00e9 retenue sur le fondement contractuel pour manquement \u00e0 son obligation de d\u00e9livrance conforme. Le tribunal a constat\u00e9 l\u2019existence de nombreuses r\u00e9serves list\u00e9es lors de la r\u00e9ception et leur persistance pendant plusieurs ann\u00e9es. &#8220;Ces \u00e9l\u00e9ments d\u00e9montrent \u00e0 suffisance le manquement du vendeur \u00e0 son obligation de d\u00e9livrer un bien conforme et exempt de vices ou encore de lever les d\u00e9sordres r\u00e9serv\u00e9s dans le d\u00e9lai contractuel.&#8221; (Motifs, sur la demande principale). La faute ne r\u00e9side pas seulement dans l\u2019existence des d\u00e9sordres initiaux, mais dans l\u2019inaction du vendeur \u00e0 les faire dispara\u00eetre dans le d\u00e9lai convenu, constituant ainsi une inex\u00e9cution fautive du contrat de vente.<\/p>\n<p>La r\u00e9paration diff\u00e9renci\u00e9e des pr\u00e9judices subis.<\/p>\n<p>Le tribunal a op\u00e9r\u00e9 une distinction nette entre les diff\u00e9rents chefs de pr\u00e9judice invoqu\u00e9s. Il a allou\u00e9 une indemnit\u00e9 forfaitaire pour le pr\u00e9judice de jouissance, retenu au titre de la g\u00eane subie pendant l\u2019occupation. En revanche, il a rejet\u00e9 la demande de moins-value lors de la revente, faute de preuve d\u2019un lien de causalit\u00e9. &#8220;Rien ne d\u00e9montre donc que le prix de vente (&#8230;) a \u00e9t\u00e9 impact\u00e9 par l&#8217;inertie du vendeur \u00e0 lever les r\u00e9serves.&#8221; (Motifs, au titre de la moins-value). Cette d\u00e9cision souligne l\u2019exigence d\u2019un lien causal direct et certain, particuli\u00e8rement lorsque l\u2019acte de vente ne mentionne pas les d\u00e9sordres. Elle s\u00e9curise ainsi les transactions immobili\u00e8res en \u00e9vitant une indemnisation sp\u00e9culative.<\/p>\n<p>La port\u00e9e de la d\u00e9cision est significative en mati\u00e8re de vente d\u2019immeuble \u00e0 construire. Elle affirme avec force que l\u2019ancien acqu\u00e9reur conserve un int\u00e9r\u00eat \u00e0 agir pour son pr\u00e9judice d\u2019occupation, m\u00eame apr\u00e8s avoir c\u00e9d\u00e9 le bien. Elle rappelle \u00e9galement l\u2019obligation positive du vendeur de lever les r\u00e9serves dans un d\u00e9lai raisonnable, sous peine d\u2019engager sa responsabilit\u00e9 contractuelle.
