Le Tribunal judiciaire du Mans, juge de la mise en \u00e9tat, rend une ordonnance le vingt-cinq septembre deux mille vingt-cinq. L’affaire concerne une opposition \u00e0 une injonction de payer relative \u00e0 des factures de travaux. Les parties sollicitent conjointement une m\u00e9diation judiciaire. Le juge doit d\u00e9cider de l’opportunit\u00e9 d’ordonner cette mesure. Il fait droit \u00e0 cette demande commune et sursoit \u00e0 statuer en attendant l’issue de la m\u00e9diation.<\/p>\n

Le cadre l\u00e9gal de la m\u00e9diation judiciaire civile<\/p>\n

Le fondement l\u00e9gal de la d\u00e9cision est clairement \u00e9nonc\u00e9. Le juge applique les dispositions du code de proc\u00e9dure civile relatives \u00e0 la m\u00e9diation conventionnelle judiciaire. Il se r\u00e9f\u00e8re pr\u00e9cis\u00e9ment \u00e0 l’article qui en d\u00e9finit le principe et la mission. “le juge saisi d\u2019un litige peut, apr\u00e8s avoir recueilli l\u2019accord des parties, ordonner une m\u00e9diation.Le m\u00e9diateur d\u00e9sign\u00e9 par le juge a pour mission d\u2019entendre les parties et de confronter leurs points de vue pour leur permettre de trouver une solution au conflit qui les oppose. ” (Motifs). La juridiction rappelle ainsi la condition essentielle du consentement des parties pour cette mesure. La port\u00e9e de ce fondement est confirm\u00e9e par une jurisprudence r\u00e9cente. “L’article 22-1 de la loi n\u00b095-125 du 8 f\u00e9vrier 1995 relative \u00e0 l’organisation des juridictions et \u00e0 la proc\u00e9dure civile, p\u00e9nale et administrative, tel que modifi\u00e9 par la loi n\u00b02019-222 du 23 mars 2019, dispose qu’en tout \u00e9tat de la proc\u00e9dure, y compris en r\u00e9f\u00e9r\u00e9, lorsqu’il estime qu’une r\u00e9solution amiable du litige est possible, le juge peut, s’il n’a pas recueilli l’accord des parties, leur enjoindre de rencontrer un m\u00e9diateur qu’il d\u00e9signe et qui r\u00e9pond aux conditions pr\u00e9vues par d\u00e9cret en Conseil d’Etat.” (Tribunal judiciaire de Paris, le 29 janvier 2025, n\u00b023\/10833). La pr\u00e9sente ordonnance illustre l’application du premier cas de figure, fond\u00e9 sur l’accord commun.<\/p>\n

La mise en \u0153uvre pratique de la mesure ordonn\u00e9e<\/p>\n

La d\u00e9cision d\u00e9taille avec pr\u00e9cision les modalit\u00e9s concr\u00e8tes de la m\u00e9diation. Le juge d\u00e9signe l’organisme de m\u00e9diation et fixe la dur\u00e9e initiale de la mission \u00e0 trois mois. Il pr\u00e9cise que la m\u00e9diation portera sur l’int\u00e9gralit\u00e9 du litige n\u00e9 de l’opposition. Une condition suspensive est impos\u00e9e aux parties sous forme d’une consignation. Le dispositif organise \u00e9galement le suivi de la mesure par le juge. Le m\u00e9diateur doit l’informer de toute difficult\u00e9 ou interruption. La valeur de cette ordonnance r\u00e9side dans son caract\u00e8re incitatif et cadrant. Elle cr\u00e9e un cadre proc\u00e9dural s\u00e9curis\u00e9 pour la recherche d’un accord. La consignation vise \u00e0 garantir le s\u00e9rieux de l’engagement des parties. Le sursis \u00e0 statuer est la cons\u00e9quence logique de la mise en place de cette mesure. Il suspend la proc\u00e9dure judiciaire pour laisser sa chance au dialogue. “Dans l\u2019attente, il sera sursis \u00e0 statuer sur l\u2019ensemble des demandes.” (Motifs). Cette approche est coh\u00e9rente avec la gestion des instances. “En l\u2019esp\u00e8ce, la mesure de m\u00e9diation judiciaire civile ordonn\u00e9e par le Juge de la Mise en \u00e9tat le 2 d\u00e9cembre 2024 est toujours en cours. Il convient donc de surseoir \u00e0 statuer dans l\u2019attente de l\u2019issue de la m\u00e9diation en cours.” (Tribunal judiciaire de Thionville, le 15 d\u00e9cembre 2025, n\u00b024\/01546).
