Le juge des contentieux de la protection statue par jugement r\u00e9put\u00e9 contradictoire sur une demande en paiement d’arri\u00e9r\u00e9s locatifs, r\u00e9siliation de bail et expulsion. Les d\u00e9fendeurs, locataires solidaires, ne comparaissent pas. Le juge examine la recevabilit\u00e9 de l’action et le fond des demandes. Il accueille les pr\u00e9tentions du bailleur en constatant la r\u00e9siliation du bail et en ordonnant l’expulsion, tout en pr\u00e9cisant le r\u00e9gime des indemnit\u00e9s d’occupation.<\/p>\n

La r\u00e9gularit\u00e9 proc\u00e9durale et l’acquisition de la clause r\u00e9solutoire<\/p>\n

Le juge v\u00e9rifie d’abord le strict respect des formalit\u00e9s l\u00e9gales encadrant la proc\u00e9dure. La notification de l’assignation au pr\u00e9fet est une condition de recevabilit\u00e9 imp\u00e9rative. “Une copie de l\u2019assignation a \u00e9t\u00e9 notifi\u00e9e au repr\u00e9sentant de l\u2019Etat dans le d\u00e9partement le 17 avril 2025, soit plus de six semaines avant l\u2019audience” (Sur la recevabilit\u00e9 de la demande en r\u00e9siliation du bail). Cette diligence rend l’action recevable, \u00e9vitant l’irrecevabilit\u00e9 prononc\u00e9e dans d’autres cas. La valeur de ce contr\u00f4le est essentielle pour prot\u00e9ger les locataires. Ensuite, le juge analyse les conditions de mise en \u0153uvre de la clause r\u00e9solutoire. Un premier commandement est \u00e9cart\u00e9 car son d\u00e9lai de six semaines est non conforme. Seul le second commandement, d\u00e9livr\u00e9 le 17 janvier 2025, respecte la loi. “Il y a lieu de constater que les conditions d\u2019acquisition de la clause r\u00e9solutoire sont r\u00e9unies \u00e0 la date du 17 mars 2025” (Sur la r\u00e9siliation et l’expulsion). Cette rigueur confirme une application stricte de l’article 24 de la loi de 1989. La port\u00e9e en est une s\u00e9curit\u00e9 juridique renforc\u00e9e pour les deux parties au contrat.<\/p>\n

Le r\u00e9gime des condamnations p\u00e9cuniaires et la solidarit\u00e9<\/p>\n

La d\u00e9cision distingue nettement le r\u00e9gime des cr\u00e9ances contractuelles de celui de la r\u00e9paration quasi-d\u00e9lictuelle. Pour l’arri\u00e9r\u00e9 locatif, la solidarit\u00e9 contractuelle s’applique pleinement. “Conform\u00e9ment \u00e0 la clause de solidarit\u00e9 stipul\u00e9e audit bail, les locataires sont tenus solidairement d\u2019ex\u00e9cuter l\u2019ensemble des obligations en r\u00e9sultant” (Sur la demande en paiement de l\u2019arri\u00e9r\u00e9 locatif). En revanche, pour les indemnit\u00e9s d’occupation dues apr\u00e8s r\u00e9siliation, la solidarit\u00e9 conventionnelle ne joue pas. Le juge fonde alors la condamnation in solidum sur le droit commun de la responsabilit\u00e9. “L\u2019indemnit\u00e9 d’occupation est due en raison de la faute quasi d\u00e9lictuelle commise par les d\u00e9fendeurs” (Sur la demande en paiement d\u2019une indemnit\u00e9 d\u2019occupation). Il applique la jurisprudence selon laquelle “chacun des responsables d’un m\u00eame dommage doit \u00eatre condamn\u00e9 \u00e0 le r\u00e9parer en totalit\u00e9” (Sur la demande en paiement d\u2019une indemnit\u00e9 d\u2019occupation). Le sens est d’assurer une r\u00e9paration int\u00e9grale au bailleur. La valeur r\u00e9side dans l’articulation fine des r\u00e9gimes juridiques.
