La proc\u00e9dure trouve son origine dans la vente d\u2019un bien immobilier \u00e9quip\u00e9 de panneaux photovolta\u00efques. L\u2019acqu\u00e9reur r\u00e9clamait la restitution des sommes per\u00e7ues par le vendeur au titre de la revente d\u2019\u00e9lectricit\u00e9 post\u00e9rieurement \u00e0 la vente. Le tribunal a d\u00e9clar\u00e9 l\u2019opposition recevable mais a accueilli le fond de la demande en condamnant le vendeur \u00e0 payer une partie de la cr\u00e9ance initiale. Cette d\u00e9cision pr\u00e9cise les conditions de recevabilit\u00e9 de l\u2019opposition et les obligations d\u00e9coulant d\u2019une clause contractuelle sp\u00e9cifique.<\/p>\n<p>La recevabilit\u00e9 de l\u2019opposition form\u00e9e dans les d\u00e9lais<\/p>\n<p>Le tribunal a d\u2019abord v\u00e9rifi\u00e9 le respect des d\u00e9lais proc\u00e9duraux pour l\u2019opposition. Le texte applicable impose un d\u00e9lai strict \u00e0 compter de la premi\u00e8re signification. &#8220;Aux termes de l&#8217;article 1416 alin\u00e9a 2 du code de proc\u00e9dure civile l&#8217;opposition est recevable dans le d\u00e9lai d&#8217;un mois suivant le premier acte signifi\u00e9 \u00e0 personne&#8221; (Expos\u00e9 des motifs, 1\u00b0). En l\u2019esp\u00e8ce, l\u2019opposition a \u00e9t\u00e9 formul\u00e9e apr\u00e8s la signification de l\u2019ordonnance, intervenant dans le mois requis. Cette application stricte consacre une s\u00e9curit\u00e9 juridique pour le d\u00e9biteur. Elle permet d\u2019\u00e9viter toute forclusion pr\u00e9matur\u00e9e d\u00e8s lors qu\u2019un acte a \u00e9t\u00e9 signifi\u00e9 \u00e0 personne. La solution s\u2019inscrit en coh\u00e9rence avec une jurisprudence r\u00e9cente sur le point de d\u00e9part du d\u00e9lai. &#8220;Aux termes de l\u2019article 1416 du code de proc\u00e9dure civile, l\u2019opposition est form\u00e9e dans le mois qui suit la signification de l\u2019ordonnance, toutefois, si la signification n\u2019a pas \u00e9t\u00e9 faite \u00e0 personne, l\u2019opposition est recevable jusqu\u2019\u00e0 l\u2019expiration d\u2019un d\u00e9lai d\u2019un mois suivant le premier acte signifi\u00e9 \u00e0 personne&#8221; (Tribunal judiciaire de Chartres, le 1 juillet 2025, n\u00b024\/00652). La d\u00e9cision renforce ainsi une interpr\u00e9tation protectrice des droits de la d\u00e9fense.<\/p>\n<p>La condamnation fond\u00e9e sur l\u2019inex\u00e9cution d\u2019une obligation contractuelle<\/p>\n<p>Sur le fond, le tribunal a retenu la responsabilit\u00e9 du vendeur pour manquement contractuel. La clause de l\u2019acte authentique pr\u00e9voyait son obligation de permettre \u00e0 l\u2019acqu\u00e9reur de b\u00e9n\u00e9ficier du contrat de revente. &#8220;les clauses de l&#8217;acte authentique de la vente de la maison indiquaient bien une jouissance du bien acquis \u00e0 la date du 5 juillet 2022, le vendeur s&#8217;obligeant \u00e0 faire toutes d\u00e9marches n\u00e9cessaires&#8221; (Expos\u00e9 des motifs, 2\u00b0). En facturant \u00e0 son profit le produit de la revente, le vendeur a viol\u00e9 cette obligation. Le tribunal en d\u00e9duit la cr\u00e9ance certaine et liquide justifiant la condamnation. Cette analyse souligne l\u2019importance des obligations accessoires li\u00e9es \u00e0 la jouissance du bien. Elle \u00e9tend la garantie des vices cach\u00e9s aux droits contractuels attach\u00e9s au bien vendu. La d\u00e9cision pr\u00e9cise que le transfert de jouissance emporte celui des avantages \u00e9conomiques connexes. Elle sanctionne ainsi toute r\u00e9tention de profit par l\u2019ancien propri\u00e9taire apr\u00e8s la date de vente.<\/p>\n<p>La modulation des condamnations p\u00e9cuniaires par le juge<\/p>\n<p>Enfin, le tribunal a us\u00e9 de son pouvoir d\u2019appr\u00e9ciation pour mod\u00e9rer les demandes indemnitaires. La cr\u00e9ance initiale de 3500 euros a \u00e9t\u00e9 r\u00e9duite \u00e0 1500,70 euros au vu des \u00e9l\u00e9ments produits. De m\u00eame, la demande au titre de l\u2019article 700 du code de proc\u00e9dure civile a \u00e9t\u00e9 fix\u00e9e \u00e0 500 euros. Le juge a ainsi op\u00e9r\u00e9 une concr\u00e9tisation des pr\u00e9judices all\u00e9gu\u00e9s. Cette pratique rappelle que le juge de l\u2019opposition dispose d\u2019un plein pouvoir d\u2019appr\u00e9ciation sur le fond. Il n\u2019est pas li\u00e9 par les montants mentionn\u00e9s dans l\u2019ordonnance d\u2019injonction de payer. La d\u00e9cision illustre le contr\u00f4le judiciaire complet exerc\u00e9 apr\u00e8s une opposition r\u00e9guli\u00e8re. Elle assure une proportionnalit\u00e9 entre le manquement constat\u00e9 et la r\u00e9paration accord\u00e9e. Le juge statue en \u00e9quit\u00e9 tout en respectant le principe de la contradiction entre les parties.<\/p>\n<p>Cette d\u00e9cision offre une application p\u00e9dagogique des r\u00e8gles de proc\u00e9dure civile en mati\u00e8re d\u2019injonction de payer. Elle confirme une interpr\u00e9tation stricte des d\u00e9lais d\u2019opposition, protectrice des droits du d\u00e9biteur. Sur le fond, elle consacre l\u2019\u00e9tendue des obligations du vendeur concernant les avantages accessoires au bien.
