Le bailleur invoque une clause r\u00e9solutoire apr\u00e8s un commandement de payer demeur\u00e9 infructueux. Les locataires, bien que pr\u00e9sents \u00e0 l&#8217;instance, n&#8217;ont pas repris le paiement int\u00e9gral du loyer courant. Le juge doit d\u00e9terminer si les conditions l\u00e9gales pour constater la r\u00e9siliation du bail et ordonner l&#8217;expulsion sont r\u00e9unies. Il accueille la demande du bailleur et condamne les occupants au paiement des sommes dues.<\/p>\n<p>La rigueur des conditions l\u00e9gales pour suspendre la r\u00e9siliation<\/p>\n<p>L&#8217;exigence d&#8217;une reprise pr\u00e9alable et int\u00e9grale du loyer courant. Le dispositif de l&#8217;article 24 de la loi de 1989 offre une possibilit\u00e9 de suspension des effets de la clause r\u00e9solutoire. Cette suspension est toutefois subordonn\u00e9e \u00e0 une condition pr\u00e9alable stricte \u00e9nonc\u00e9e par le texte. &#8220;\u00e0 la condition que celui-ci ait repris le versement int\u00e9gral du loyer courant avant la date de l&#8217;audience&#8221; (Article 24 VII). Le juge constate en l&#8217;esp\u00e8ce que cette condition n&#8217;est pas remplie. &#8220;L&#8217;examen du d\u00e9compte locatif laisse appara\u00eetre l&#8217;augmentation de la dette locative et l&#8217;absence de reprise du paiement du loyer courant en int\u00e9gralit\u00e9&#8221; (Motifs de la d\u00e9cision). Cette absence de reprise rend inop\u00e9rante toute demande de d\u00e9lais de paiement suspensifs. La jurisprudence rappelle que le juge ne peut statuer sur de tels d\u00e9lais lorsque le locataire ne s&#8217;engage pas \u00e0 reprendre les paiements. &#8220;L\u2019absence de la locataire \u00e0 l\u2019audience ne lui permet ni de pr\u00e9ciser sa situation actuelle, ni m\u00eame de s\u2019engager \u00e0 reprendre le paiement des loyers courants&#8221; (Tribunal judiciaire de Reims, le 23 mars 2026, n\u00b025\/04004). La port\u00e9e de cette condition est donc d\u00e9cisive pour l&#8217;issue de la proc\u00e9dure.<\/p>\n<p>L&#8217;impossibilit\u00e9 d&#8217;octroyer des d\u00e9lais de paiement suspensifs. Faute de reprise des loyers courants, le juge ne peut mettre en \u0153uvre le m\u00e9canisme de suspension. Les textes pr\u00e9voient que l&#8217;octroi de d\u00e9lais de paiement est lui-m\u00eame conditionn\u00e9 \u00e0 cette reprise. &#8220;le juge peut, \u00e0 la demande du locataire, du bailleur ou d&#8217;office, \u00e0 la condition que le locataire soit en situation de r\u00e9gler sa dette locative et qu&#8217;il ait repris le versement int\u00e9gral du loyer courant avant la date de l&#8217;audience, accorder des d\u00e9lais de paiement&#8221; (Article 24 V). Une jurisprudence confirme cette interpr\u00e9tation stricte des conditions. &#8220;le juge peut, \u00e0 la demande du locataire, du bailleur ou d&#8217;office, \u00e0 la condition que le locataire soit en situation de r\u00e9gler sa dette locative et qu&#8217;il ait repris le versement int\u00e9gral du loyer courant avant la date de l&#8217;audience, accorder des d\u00e9lais de paiement&#8221; (Tribunal judiciaire de Saint-Gaudens, le 5 janvier 2026, n\u00b025\/00201). La valeur de cette d\u00e9cision r\u00e9side dans son application rigoureuse du cadre l\u00e9gal protecteur mais exigeant. Elle rappelle que la bienveillance du juge est encadr\u00e9e par des conditions proc\u00e9durales pr\u00e9cises. Le sens est clair : la volont\u00e9 du l\u00e9gislateur est de prot\u00e9ger le locataire de bonne foi qui manifeste un effort de paiement.<\/p>\n<p>Les cons\u00e9quences juridiques et p\u00e9cuniaires de la r\u00e9siliation constat\u00e9e<\/p>\n<p>La constatation judiciaire de l&#8217;acquisition de la clause r\u00e9solutoire. Le juge constate que le commandement de payer, r\u00e9gulier en la forme, est rest\u00e9 sans effet pendant plus de six semaines. Il en d\u00e9duit que la condition r\u00e9solutoire s&#8217;est r\u00e9alis\u00e9e. &#8220;les conditions d&#8217;acquisition de la clause r\u00e9solutoire contenue dans le bail \u00e9taient r\u00e9unies \u00e0 la date du 5 f\u00e9vrier 2025&#8221; (Motifs de la d\u00e9cision). Cette constatation entra\u00eene automatiquement la r\u00e9siliation du contrat de bail. Elle justifie l&#8217;ordonnance de lib\u00e9ration des lieux sous quinze jours. Le juge rejette \u00e9galement les demandes accessoires du bailleur concernant une astreinte ou l&#8217;enl\u00e8vement des meubles. Il estime que le recours \u00e0 la force publique est suffisant. Le sort des meubles est en effet r\u00e9gi par des textes sp\u00e9cifiques post-expulsion. Cette solution d\u00e9montre un souci de proportionnalit\u00e9 dans les mesures d&#8217;ex\u00e9cution. La port\u00e9e pratique est d&#8217;\u00e9viter des mesures coercitives suppl\u00e9mentaires non n\u00e9cessaires \u00e0 ce stade.<\/p>\n<p>La condamnation au paiement des indemnit\u00e9s d&#8217;occupation et de la dette locative. La r\u00e9siliation du bail ne lib\u00e8re pas les anciens locataires de leurs obligations p\u00e9cuniaires. Le juge les condamne au paiement solidaire de l&#8217;arri\u00e9r\u00e9 de loyers et charges. Il ordonne \u00e9galement le versement d&#8217;une indemnit\u00e9 d&#8217;occupation post-r\u00e9siliation. Cette indemnit\u00e9 est fix\u00e9e au montant du loyer initial jusqu&#8217;\u00e0 la lib\u00e9ration effective. &#8220;afin de r\u00e9parer le pr\u00e9judice d\u00e9coulant pour le demandeur de l&#8217;occupation indue de son bien&#8221; (Motifs de la d\u00e9cision). Cette condamnation a une double valeur, compensatoire et incitative. Elle r\u00e9pare le pr\u00e9judice du bailleur priv\u00e9 de son bien et incite les occupants \u00e0 lib\u00e9rer rapidement les lieux. Le sens de cette d\u00e9cision est d&#8217;assurer une ex\u00e9cution compl\u00e8te de la d\u00e9cision de justice.
