Le juge des contentieux de la protection a rendu un jugement r\u00e9put\u00e9 contradictoire le 19 juillet 2025. Il statue sur une demande en constatation de r\u00e9siliation de bail pour impay\u00e9s de loyers et d\u00e9faut d’assurance. Le locataire, ne comparaissant pas, s’expose \u00e0 un jugement sur les seuls \u00e9l\u00e9ments fournis par le bailleur. Le juge examine la r\u00e9gularit\u00e9 de la proc\u00e9dure et le bien-fond\u00e9 des demandes. Il constate la r\u00e9siliation du bail et ordonne l’expulsion du locataire ainsi que le paiement des sommes dues.<\/p>\n

La r\u00e9gularit\u00e9 proc\u00e9durale de la demande en r\u00e9siliation<\/p>\n

Le respect des formalit\u00e9s pr\u00e9alables \u00e0 l’assignation. Le l\u00e9gislateur a encadr\u00e9 strictement la proc\u00e9dure de r\u00e9siliation pour impay\u00e9s afin de prot\u00e9ger le locataire. L’article 24 de la loi du 6 juillet 1989 impose un commandement de payer contenant des mentions obligatoires. Le juge v\u00e9rifie que le commandement a \u00e9t\u00e9 r\u00e9guli\u00e8rement signal\u00e9 \u00e0 la commission comp\u00e9tente. “Le commandement de payer en date du 5 juin 2024 a \u00e9t\u00e9 transmis \u00e0 la CCAPEX le 10 juin 2024, soit plus de deux mois avant l’assignation.” Cette transmission respecte l’exigence de signalement pr\u00e9alable pour permettre un diagnostic social.<\/p>\n

La notification de l’assignation au repr\u00e9sentant de l’\u00c9tat. Une condition suppl\u00e9mentaire de recevabilit\u00e9 p\u00e8se sur le bailleur. Il doit notifier l’assignation au pr\u00e9fet dans un d\u00e9lai pr\u00e9cis avant l’audience. “A peine d’irrecevabilit\u00e9 de la demande, l’assignation aux fins de constat de la r\u00e9siliation est notifi\u00e9e (\u2026) au repr\u00e9sentant de l’Etat dans le d\u00e9partement (\u2026) au moins deux mois avant l’audience.” Le juge constate que cette formalit\u00e9 a \u00e9t\u00e9 respect\u00e9e en l’esp\u00e8ce. Cette double condition assure une information des services sociaux et du pr\u00e9fet.<\/p>\n

Le bien-fond\u00e9 des demandes du bailleur<\/p>\n

L’existence d’une inex\u00e9cution contractuelle grave et r\u00e9p\u00e9t\u00e9e. Le juge analyse le comportement du locataire au regard de ses obligations l\u00e9gales et contractuelles. Le d\u00e9faut de paiement du loyer constitue la cause principale de la r\u00e9siliation. “Le fait que Monsieur [C] [D] n’ait pas r\u00e9gl\u00e9 les sommes dues dans le d\u00e9lai de six semaines du commandement de payer (\u2026) entra\u00eene la r\u00e9siliation du bail.” Le non-paiement persistant apr\u00e8s sommation caract\u00e9rise une inex\u00e9cution suffisamment grave.<\/p>\n

Le d\u00e9faut de justification d’assurance comme cause autonome. Le bailleur invoque \u00e9galement le manquement \u00e0 l’obligation d’assurance. Le locataire n’a pas justifi\u00e9 de cette assurance dans le d\u00e9lai imparti apr\u00e8s sommation. “Le fait que le locataire n’ait pas justifi\u00e9 de la souscription d’une assurance (\u2026) entra\u00eene la r\u00e9siliation du bail.” Ce manquement, combin\u00e9 aux impay\u00e9s, conforte le juge dans sa d\u00e9cision de r\u00e9silier le bail et d’ordonner l’expulsion.<\/p>\n

La port\u00e9e de cette d\u00e9cision est significative en mati\u00e8re de bail d’habitation. Elle rappelle le caract\u00e8re d’ordre public des dispositions protectrices de la loi de 1989. Le juge doit v\u00e9rifier scrupuleusement le respect de la proc\u00e9dure pr\u00e9vue \u00e0 l’article 24. La solution illustre aussi la s\u00e9v\u00e9rit\u00e9 envers les manquements r\u00e9p\u00e9t\u00e9s du locataire. L’absence de r\u00e9gularisation apr\u00e8s commandement et l’absence \u00e0 l’audience sont lourdement sanctionn\u00e9es. Enfin, le jugement pr\u00e9cise les cons\u00e9quences pratiques de la r\u00e9siliation.
