Le <a href=\"https:\/\/kohenavocats.com\/avocats-en-droit-penal-a-paris-conseil-et-defense-strategique\/avocats-detention-provisoire-paris\/\" target=\"_blank\" title=\"juge des libert\u00e9s et de la d\u00e9tention\">juge des libert\u00e9s et de la d\u00e9tention<\/a> rejette les moyens d\u2019irr\u00e9gularit\u00e9 soulev\u00e9s par la d\u00e9fense. Il ordonne finalement la prolongation de la r\u00e9tention pour une dur\u00e9e de vingt-six jours. La d\u00e9cision souligne le contr\u00f4le du juge sur le strict respect des proc\u00e9dures applicables.<\/p>\n<p>Le contr\u00f4le formel des conditions de la retenue<\/p>\n<p>Le juge v\u00e9rifie d\u2019abord la r\u00e9gularit\u00e9 de l\u2019interpellation ayant conduit \u00e0 la retenue. Il rappelle que les services de police doivent justifier de &#8220;\u00e9l\u00e9ments objectifs d\u2019extran\u00e9it\u00e9&#8221; (Motifs, point 1). La r\u00e9f\u00e9rence \u00e0 une fiche de recherche CESEDA est jug\u00e9e suffisante pour \u00e9tablir ce motif l\u00e9gal. Cette approche valide un contr\u00f4le fond\u00e9 sur des fichiers administratifs pr\u00e9existants. Elle confirme une interpr\u00e9tation large des \u00e9l\u00e9ments objectifs autorisant la r\u00e9quisition.<\/p>\n<p>L\u2019examen se poursuit sur les modalit\u00e9s pratiques de la notification et de la dur\u00e9e. Une erreur mat\u00e9rielle indiquant une dur\u00e9e maximale de seize heures est relev\u00e9e dans les documents. Le juge estime que cette &#8220;mention est erron\u00e9e&#8221; mais ne constitue pas une atteinte aux droits (Motifs, point 2). Il constate par ailleurs que la retenue a bien pris fin \u00e0 l\u2019issue exacte de vingt-quatre heures. Ce raisonnement distingue l\u2019erreur formelle de l\u2019atteinte substantielle aux droits de la personne retenue.<\/p>\n<p>L\u2019appr\u00e9ciation souveraine des conditions de prolongation<\/p>\n<p>Le juge examine ensuite le fondement de la demande de prolongation de la r\u00e9tention. Il rel\u00e8ve que la mesure d\u2019\u00e9loignement n\u2019a pu \u00eatre ex\u00e9cut\u00e9e dans le d\u00e9lai initial de quatre jours. L\u2019administration justifie de diligences par la saisine des autorit\u00e9s consulaires et de la direction g\u00e9n\u00e9rale. Le juge en d\u00e9duit qu\u2019elle a agi conform\u00e9ment \u00e0 l\u2019exigence de diligence continue. Cette appr\u00e9ciation concr\u00e8te des efforts administratifs est centrale pour autoriser la prolongation.<\/p>\n<p>L\u2019alternative de l\u2019assignation \u00e0 r\u00e9sidence est \u00e9cart\u00e9e en l\u2019esp\u00e8ce. Le juge note que l\u2019int\u00e9ress\u00e9 &#8220;n\u2019a pas pr\u00e9alablement remis \u00e0 un service de police un passeport en cours de validit\u00e9&#8221; (Motifs, sur la demande de prolongation). Cette condition stricte est jug\u00e9e prioritaire sur l\u2019existence de garanties de repr\u00e9sentation. La d\u00e9cision r\u00e9affirme ainsi le caract\u00e8re subsidiaire de l\u2019assignation par rapport \u00e0 la r\u00e9tention. Elle consacre une interpr\u00e9tation rigoureuse des conditions l\u00e9gales de substitution \u00e0 la d\u00e9tention.<\/p>\n<p>Cette ordonnance illustre la tension entre contr\u00f4le proc\u00e9dural strict et d\u00e9f\u00e9rence sur le fond. Le juge op\u00e8re un examen minutieux des vices de forme all\u00e9gu\u00e9s. Il rejette ceux qui n\u2019entravent pas substantiellement l\u2019exercice des droits de la d\u00e9fense. Sur la prolongation, son pouvoir d\u2019appr\u00e9ciation des diligences administratives reste large. La solution converge avec une jurisprudence exigeant une information rapide des droits. &#8220;1h50 s\u2019est \u00e9coul\u00e9e entre la notification du placement et de ses voies de recours et la notification des droits du retenu&#8221; a ainsi \u00e9t\u00e9 jug\u00e9e irr\u00e9guli\u00e8re (Tribunal judiciaire de Meaux, le 31 janvier 2025, n\u00b025\/00404). En revanche, elle s\u2019en \u00e9carte sur l\u2019appr\u00e9ciation des \u00e9l\u00e9ments d\u2019extran\u00e9it\u00e9, une autre d\u00e9cision ayant annul\u00e9 un contr\u00f4le malgr\u00e9 la pr\u00e9sentation d\u2019un passeport national (Tribunal judiciaire, le 7 d\u00e9cembre 2025, n\u00b025\/07022).
