Le bailleur, une soci\u00e9t\u00e9 d&#8217;\u00e9conomie mixte, demandait l&#8217;expulsion de locataires pour impay\u00e9s de loyer. Apr\u00e8s un commandement demeur\u00e9 infructueux, la <a href=\"https:\/\/kohenavocats.fr\/avocat-resiliation-bail-paris\/\" target=\"_blank\" title=\"clause r\u00e9solutoire\">clause r\u00e9solutoire<\/a> \u00e9tait acquise. Les locataires, reconnaissant la dette, sollicitaient des d\u00e9lais de paiement et le maintien dans les lieux. Le juge a constat\u00e9 la r\u00e9gularit\u00e9 de la proc\u00e9dure et le bien-fond\u00e9 de la cr\u00e9ance. Il a cependant accord\u00e9 des d\u00e9lais aux locataires et suspendu les effets de la clause r\u00e9solutoire, sous conditions strictes.<\/p>\n<p>La r\u00e9gularit\u00e9 proc\u00e9durale comme pr\u00e9alable incontournable<\/p>\n<p>Le juge v\u00e9rifie scrupuleusement le respect des formalit\u00e9s l\u00e9gales pr\u00e9vues par la loi du 6 juillet 1989. La notification de l&#8217;assignation \u00e0 la pr\u00e9fecture et la saisine de la commission de pr\u00e9vention des expulsions sont des conditions de recevabilit\u00e9. Ces actes doivent intervenir dans des d\u00e9lais stricts, plusieurs semaines avant l&#8217;audience. Leur omission entra\u00eenerait l&#8217;irrecevabilit\u00e9 de la demande du bailleur. Cette v\u00e9rification initiale prot\u00e8ge le locataire contre une proc\u00e9dure exp\u00e9ditive. Elle garantit l&#8217;intervention des autorit\u00e9s administratives dans le processus d&#8217;expulsion. La r\u00e9gularit\u00e9 de la proc\u00e9dure constitue ainsi un garde-fou essentiel.<\/p>\n<p>L&#8217;acquisition de la clause r\u00e9solutoire et son effet diff\u00e9r\u00e9<\/p>\n<p>Le juge constate que les conditions l\u00e9gales pour l&#8217;acquisition de la clause sont r\u00e9unies. Un <a href=\"https:\/\/kohenavocats.fr\/avocat-recouvrement-loyers-paris\/\" target=\"_blank\" title=\"commandement de payer\">commandement de payer<\/a> sp\u00e9cifique doit avoir \u00e9t\u00e9 signifi\u00e9 au locataire. Ce commandement doit ensuite \u00eatre demeur\u00e9 infructueux pendant un d\u00e9lai minimal. &#8220;Cette clause ne produit effet que six semaines apr\u00e8s un commandement de payer demeur\u00e9 infructueux&#8221; (article 24 I de la loi n\u00b089-462 du 06 juillet 1989). Le d\u00e9lai de carence court \u00e0 compter de la signification de l&#8217;acte. Son expiration permet au bailleur d&#8217;invoquer la r\u00e9siliation de plein droit. Cette formalit\u00e9 offre au locataire un ultime d\u00e9lai pour r\u00e9gulariser sa situation. Elle \u00e9vite une rupture trop brutale du contrat de location.<\/p>\n<p>La suspension conditionnelle des effets de la clause r\u00e9solutoire<\/p>\n<p>Le juge op\u00e8re une distinction nette entre l&#8217;octroi de d\u00e9lais et la suspension de la clause. Depuis la r\u00e9forme de 2023, les d\u00e9lais de paiement n&#8217;entra\u00eenent plus automatiquement cette suspension. Le juge doit \u00eatre saisi d&#8217;une demande sp\u00e9cifique \u00e0 cet effet. &#8220;Lorsque le juge est saisi en ce sens par le bailleur ou par le locataire, et \u00e0 la condition que celui-ci ait repris le versement int\u00e9gral du loyer courant avant la date de l&#8217;audience, les effets de la clause de r\u00e9siliation de plein droit peuvent \u00eatre suspendus&#8221; (article 24 VII de la loi n\u00b089-462 du 06 juillet 1989). Cette suspension est donc subordonn\u00e9e \u00e0 une double condition. Le locataire doit \u00eatre \u00e0 jour du loyer courant et d\u00e9montrer sa capacit\u00e9 \u00e0 apurer la dette. La jurisprudence confirme cette approche. &#8220;Tant qu&#8217;aucune d\u00e9cision constatant la r\u00e9siliation du bail n&#8217;est pass\u00e9e en force de chose jug\u00e9e, le juge peut accorder au locataire, \u00e0 jour du paiement de ses loyers, des d\u00e9lais suspendant les effets de la clause r\u00e9solutoire&#8221; (Cour d&#8217;appel, le 5 juin 2025, n\u00b024\/08769). La suspension est ainsi une faveur judiciaire accord\u00e9e sous contr\u00f4le.<\/p>\n<p>Le r\u00e9gime strict de la suspension et ses cons\u00e9quences<\/p>\n<p>La suspension des effets de la clause est temporaire et fragile. Elle court uniquement pendant la p\u00e9riode d&#8217;ex\u00e9cution des d\u00e9lais accord\u00e9s. Toute d\u00e9faillance du locataire entra\u00eene sa fin imm\u00e9diate. &#8220;Cette suspension prend fin d\u00e8s le premier impay\u00e9 ou d\u00e8s lors que le locataire ne se lib\u00e8re pas de sa dette locative dans le d\u00e9lai et selon les modalit\u00e9s fix\u00e9s par le juge&#8221; (article 24 VII de la loi n\u00b089-462 du 06 juillet 1989). Le juge pr\u00e9cise les modalit\u00e9s de paiement avec rigueur dans le dispositif. Il assortit sa d\u00e9cision de sanctions claires en cas de manquement. Le locataire encourt alors l&#8217;exigibilit\u00e9 imm\u00e9diate du solde et l&#8217;expulsion. Une indemnit\u00e9 d&#8217;occupation provisionnelle peut \u00e9galement \u00eatre due. Ce r\u00e9gime incite fortement le locataire \u00e0 respecter scrupuleusement le calendrier. Il assure au bailleur une protection en cas de nouvelle d\u00e9faillance.
