Ce dernier r\u00e9clamait la reconnaissance d\u2019une faute inexcusable de son employeur et de l\u2019entreprise utilisatrice. Le tribunal a reconnu la faute inexcusable de l\u2019entreprise utilisatrice et a ordonn\u00e9 une expertise pour \u00e9valuer les pr\u00e9judices. Il a \u00e9galement prononc\u00e9 une r\u00e9partition de la responsabilit\u00e9 financi\u00e8re entre les deux soci\u00e9t\u00e9s impliqu\u00e9es.<\/p>\n<p>La caract\u00e9risation de la faute inexcusable par pr\u00e9somption l\u00e9gale<\/p>\n<p>Le tribunal a d\u2019abord \u00e9tabli l\u2019existence d\u2019un poste pr\u00e9sentant des risques particuliers. Le contrat de mise \u00e0 disposition indiquait explicitement que le poste figurait sur la liste de l\u2019article L. 4154-2 du code du travail. Les activit\u00e9s de montage de charpente m\u00e9tallique, notamment l\u2019op\u00e9ration d\u2019assemblage au sol d\u2019une m\u00e9gapoutre, exposaient le salari\u00e9 \u00e0 des dangers sp\u00e9cifiques. Le proc\u00e8s-verbal de l\u2019inspection du travail a confirm\u00e9 l\u2019absence d\u2019\u00e9valuation des risques pour ces op\u00e9rations et de mode op\u00e9ratoire sp\u00e9cifique. &#8220;Il ressort de ces \u00e9l\u00e9ments que M. [W] a effectivement occup\u00e9 un poste l\u2019exposant \u00e0 des risques particuliers dans le cadre de son activit\u00e9 de monteur de charpente m\u00e9tallique&#8221; (Motifs). Cette qualification abstraite du poste d\u00e9clenche le r\u00e9gime protecteur pr\u00e9vu pour les travailleurs temporaires.<\/p>\n<p>L\u2019absence de formation renforc\u00e9e a ensuite permis d\u2019appliquer la pr\u00e9somption. L\u2019entreprise utilisatrice arguait avoir dispens\u00e9 des formations via des quarts d\u2019heure s\u00e9curit\u00e9 et un livret d\u2019accueil. Le tribunal a constat\u00e9 que ces documents \u00e9taient g\u00e9n\u00e9raux et ne traitaient pas des risques sp\u00e9cifiques \u00e0 l\u2019op\u00e9ration incrimin\u00e9e. Le salari\u00e9 n\u2019avait aucune exp\u00e9rience pr\u00e9alable en charpente m\u00e9tallique de grande structure. &#8220;Il y a lieu de retenir que M. [W], en contrat de travail temporaire, a \u00e9t\u00e9 amen\u00e9 \u00e0 effectuer une op\u00e9ration d\u2019assemblage au sol d\u2019une m\u00e9gapoutre alors qu\u2019il n\u2019avait re\u00e7u aucune formation \u00e0 la s\u00e9curit\u00e9 sur les risques sp\u00e9cifiques de cette activit\u00e9&#8221; (Motifs). La pr\u00e9somption de faute inexcusable de l\u2019article L. 4154-3 du code du travail \u00e9tait donc \u00e9tablie, l\u2019employeur n\u2019ayant pas rapport\u00e9 la preuve contraire.<\/p>\n<p>Les cons\u00e9quences juridiques et financi\u00e8res de la faute reconnue<\/p>\n<p>La d\u00e9cision pr\u00e9cise les responsabilit\u00e9s respectives de l\u2019entreprise de travail temporaire et de l\u2019entreprise utilisatrice. En sa qualit\u00e9 d\u2019employeur l\u00e9gal, la soci\u00e9t\u00e9 de travail temporaire reste tenue envers le salari\u00e9. Toutefois, la faute inexcusable est imput\u00e9e \u00e0 l\u2019entreprise utilisatrice, substitu\u00e9e dans la direction. &#8220;En s\u2019abstenant de se conformer aux exigences prescrites \u00e0 l\u2019article L. 4154-2 du code du travail, la faute inexcusable de la soci\u00e9t\u00e9 [26], substitu\u00e9e dans la direction de l\u2019employeur de M. [W], la soci\u00e9t\u00e9 [31], est caract\u00e9ris\u00e9e&#8221; (Motifs). Cette solution s\u2019inscrit dans la ligne jurisprudentielle rappelant que &#8220;l&#8217;entreprise utilisatrice est consid\u00e9r\u00e9e par d\u00e9termination de la loi comme substitu\u00e9e dans la direction de l&#8217;employeur&#8221; (Tribunal judiciaire de Rouen, le 27 novembre 2025, n\u00b023\/00363).<\/p>\n<p>Le tribunal op\u00e8re une r\u00e9partition de la charge financi\u00e8re entre les deux cooblig\u00e9s. Il reconna\u00eet une n\u00e9gligence de l\u2019entreprise de travail temporaire, qui n\u2019a pas v\u00e9rifi\u00e9 la mise en \u0153uvre effective de la formation renforc\u00e9e malgr\u00e9 la mention du poste \u00e0 risques sur le contrat. Cette n\u00e9gligence contribue \u00e0 la survenance du dommage. En cons\u00e9quence, la responsabilit\u00e9 est partag\u00e9e \u00e0 hauteur de trente pour cent pour l\u2019employeur et soixante-dix pour cent pour l\u2019entreprise utilisatrice. Cette condamnation solidaire est assortie d\u2019une injonction de communiquer une attestation d\u2019assurance. La d\u00e9cision permet ainsi \u00e0 l\u2019employeur d\u2019exercer son recours en garantie dans la m\u00eame instance.<\/p>\n<p>Les autres cons\u00e9quences de la faute sont \u00e9galement mises en \u0153uvre. La majoration de la rente due au salari\u00e9 est ordonn\u00e9e conform\u00e9ment \u00e0 l\u2019article L. 452-2 du code de la s\u00e9curit\u00e9 sociale. Une expertise m\u00e9dicale est diligent\u00e9e pour \u00e9valuer les pr\u00e9judices extra-patrimoniaux r\u00e9parables, tels que les souffrances endur\u00e9es ou le pr\u00e9judice d\u2019agr\u00e9ment. Une provision de huit mille euros est accord\u00e9e \u00e0 la victime.
