Le juge des contentieux de la protection du tribunal judiciaire de Tarbes, statuant par jugement du 24 juin 2025, a examin\u00e9 la validit\u00e9 d\u2019un cong\u00e9 d\u00e9livr\u00e9 dans le cadre d\u2019un bail d\u2019habitation. Le bailleur invoquait des manquements graves des locataires \u00e0 leurs obligations, causant des troubles au voisinage. Les locataires contestaient la r\u00e9alit\u00e9 et la persistance de ces faits. La juridiction a valid\u00e9 le cong\u00e9 pour motif l\u00e9gitime et s\u00e9rieux, prononc\u00e9 la r\u00e9siliation du bail et ordonn\u00e9 l\u2019expulsion, tout en rejetant certaines demandes accessoires du bailleur.<\/p>\n

L\u2019appr\u00e9ciation rigoureuse du motif l\u00e9gitime et s\u00e9rieux<\/p>\n

La v\u00e9rification du caract\u00e8re s\u00e9rieux et l\u00e9gitime s\u2019effectue principalement au jour de la d\u00e9livrance du cong\u00e9. Le juge rappelle que “l’appr\u00e9ciation du caract\u00e8re s\u00e9rieux et l\u00e9gitime du motif all\u00e9gu\u00e9 doit se faire au jour de la d\u00e9livrance du cong\u00e9, m\u00eame si des \u00e9l\u00e9ments post\u00e9rieurs peuvent contribuer \u00e0 confirmer cette appr\u00e9ciation” (Motifs). Cette r\u00e9f\u00e9rence jurisprudentielle encadre strictement le pouvoir d\u2019appr\u00e9ciation du juge. Il ne s\u2019agit pas de requalifier les faits mais de v\u00e9rifier leur existence objective \u00e0 la date cruciale. La charge de la preuve repose int\u00e9gralement sur le bailleur, conform\u00e9ment aux principes g\u00e9n\u00e9raux du droit de la preuve.<\/p>\n

Les \u00e9l\u00e9ments post\u00e9rieurs ne servent qu\u2019\u00e0 confirmer l\u2019appr\u00e9ciation initiale, sans pouvoir fonder \u00e0 eux seuls le cong\u00e9. En l\u2019esp\u00e8ce, le bailleur a produit un ensemble probant d\u00e9montrant des manquements r\u00e9p\u00e9t\u00e9s et durables. Ces pi\u00e8ces \u00e9tablissent “l’\u00e9dification sans autorisation de divers abris illicites, la pr\u00e9sence d’encombrants sur la propri\u00e9t\u00e9 et de nombreux animaux laiss\u00e9s libres de produire des d\u00e9jections sur l’ensemble de la parcelle, causant des nuisances au voisinage” (Motifs). La preuve apport\u00e9e est ainsi caract\u00e9ris\u00e9e par son ant\u00e9riorit\u00e9 et sa persistance, validant le motif au jour du cong\u00e9.<\/p>\n

Les cons\u00e9quences proc\u00e9durales de la validation du cong\u00e9<\/p>\n

La validation du cong\u00e9 entra\u00eene automatiquement la r\u00e9siliation du bail et la qualification d\u2019occupation sans titre. Le jugement constate que les locataires “sont \u00e0 compter du 30 avril 2024 occupants sans droit ni titre du logement” (Dispositif). Cette qualification justifie la condamnation au paiement d\u2019une indemnit\u00e9 d\u2019occupation mensuelle. Cette indemnit\u00e9 est fix\u00e9e au montant du loyer et des charges, soulignant son caract\u00e8re r\u00e9parateur du pr\u00e9judice subi par le propri\u00e9taire priv\u00e9 de son bien. Elle court jusqu\u2019\u00e0 la lib\u00e9ration effective des lieux.<\/p>\n

Le rejet des demandes accessoires du bailleur montre le contr\u00f4le strict des pr\u00e9rogatives de chaque partie. La demande de dommages-int\u00e9r\u00eats pour proc\u00e9dure abusive est \u00e9cart\u00e9e car “l’appr\u00e9ciation inexacte qu’une partie fait de ses droits n’est pas en soi constitutive d’une faute” (Motifs). Le droit de se d\u00e9fendre est ainsi prot\u00e9g\u00e9, sauf en cas de malice caract\u00e9ris\u00e9e. De m\u00eame, la demande de capitalisation des int\u00e9r\u00eats est rejet\u00e9e pour d\u00e9faut de condamnation p\u00e9cuniaire pr\u00e9alable.
