La premi\u00e8re, introduite au nom de leur assur\u00e9, est jug\u00e9e irrecevable. La seconde, une demande d\u2019extension d\u2019expertise, est quant \u00e0 elle accueillie. La d\u00e9cision op\u00e8re ainsi une distinction nette fond\u00e9e sur l\u2019int\u00e9r\u00eat \u00e0 agir.<\/p>\n<p>Le d\u00e9faut d\u2019int\u00e9r\u00eat \u00e0 agir<\/p>\n<p>L\u2019exigence d\u2019un int\u00e9r\u00eat l\u00e9gitime. Le juge rappelle les principes fondamentaux r\u00e9gissant l\u2019action en justice. L\u2019article 31 du code de proc\u00e9dure civile dispose que l\u2019action est ouverte \u00e0 tous ceux qui ont un int\u00e9r\u00eat l\u00e9gitime. L\u2019application stricte de ce texte conduit \u00e0 un rejet. La d\u00e9cision constate en effet que l\u2019assur\u00e9 d\u00e9sign\u00e9 est \u201cparfaitement \u00e9tranger \u00e0 la proc\u00e9dure\u201d (Motifs, sur la recevabilit\u00e9). D\u00e8s lors, les demandeurs ne peuvent justifier d\u2019un int\u00e9r\u00eat propre \u00e0 agir en son nom. La port\u00e9e de cette solution est rigoureuse. Elle rappelle que la qualit\u00e9 d\u2019assureur ne conf\u00e8re pas automatiquement un int\u00e9r\u00eat \u00e0 agir pour le compte de l\u2019assur\u00e9. Cet int\u00e9r\u00eat doit \u00eatre personnel et actuel, sous peine d\u2019irrecevabilit\u00e9.<\/p>\n<p>La justification d\u2019un int\u00e9r\u00eat l\u00e9gitime<\/p>\n<p>La d\u00e9monstration d\u2019un lien pertinent. La seconde demande rencontre un sort favorable. Les requ\u00e9rants fondent leur action sur leur qualit\u00e9 d\u2019assureurs d\u2019une autre soci\u00e9t\u00e9. Ils produisent des pi\u00e8ces \u00e9tablissant un lien contractuel, tel un \u201ccontrat de sous-traitance\u201d (Motifs, sur la demande d\u2019extension). Ces \u00e9l\u00e9ments d\u00e9montrent un int\u00e9r\u00eat l\u00e9gitime \u00e0 l\u2019extension de l\u2019expertise. La valeur de cette analyse r\u00e9side dans son approche concr\u00e8te. Le juge v\u00e9rifie l\u2019existence d\u2019un motif s\u00e9rieux li\u00e9 \u00e0 la proc\u00e9dure en cours. Comme le rel\u00e8ve une jurisprudence, justifier d\u2019un \u201cint\u00e9r\u00eat l\u00e9gitime compte tenu de la demande de l\u2019expert\u201d est essentiel (Tribunal judiciaire, le 12 mars 2025, n\u00b024\/00462). La d\u00e9cision illustre cette exigence probatoire.<\/p>\n<p>Les effets de l\u2019extension ordonn\u00e9e<\/p>\n<p>L\u2019\u00e9largissement du cadre probatoire. Accueillir la demande d\u2019extension produit des effets proc\u00e9duraux imm\u00e9diats. L\u2019expertise devient commune et opposable aux nouvelles parties impliqu\u00e9es. Le juge ordonne que l\u2019expert les convoque d\u00e9sormais \u00e0 ses op\u00e9rations. La port\u00e9e est significative pour l\u2019instruction du litige principal. Elle permet une instruction plus compl\u00e8te en int\u00e9grant tous les acteurs potentiellement responsables. La solution assure ainsi l\u2019efficacit\u00e9 de la mesure d\u2019instruction. Elle garantit l\u2019\u00e9galit\u00e9 des armes en r\u00e9servant les droits et moyens des parties ajout\u00e9es.
