Le locataire, apr\u00e8s mise en demeure, avait accumul\u00e9 un arri\u00e9r\u00e9 important avant de quitter les lieux volontairement. Le juge a \u00e9galement examin\u00e9 des demandes indemnitaires crois\u00e9es. La juridiction a prononc\u00e9 la r\u00e9solution judiciaire du bail et condamn\u00e9 le locataire au paiement des loyers dus, tout en rejetant les autres demandes indemnitaires des parties.<\/p>\n<p>La sanction des obligations locatives essentielles<\/p>\n<p>La d\u00e9cision rappelle avec fermet\u00e9 le caract\u00e8re essentiel de l&#8217;obligation de payer le loyer. Le manquement r\u00e9p\u00e9t\u00e9 et durable \u00e0 cette obligation contractuelle justifie la sanction la plus grave. Le juge constate que le locataire &#8220;a manqu\u00e9 de fa\u00e7on r\u00e9p\u00e9t\u00e9e et durable \u00e0 son obligation principale de paiement du loyer et des charges, ce malgr\u00e9 mise en demeure&#8221; (Motifs). Cette inex\u00e9cution persistante, caract\u00e9ris\u00e9e par un arri\u00e9r\u00e9 important, constitue une faute suffisamment grave pour entra\u00eener la rupture du contrat. La solution s&#8217;inscrit dans la ligne jurisprudentielle admettant la r\u00e9siliation pour manquement grave aux obligations du preneur. Elle confirme que la gravit\u00e9 s&#8217;appr\u00e9cie notamment par la dur\u00e9e de l&#8217;impay\u00e9 et la persistance du d\u00e9faut de paiement apr\u00e8s mise en demeure.<\/p>\n<p>Le jugement op\u00e8re une application stricte des textes r\u00e9gissant la mati\u00e8re. Le juge fonde sa d\u00e9cision sur les articles 1728 et 1729 du code civil, qui d\u00e9finissent les obligations du preneur et la sanction de leur inex\u00e9cution. Il rappelle \u00e9galement le fondement l\u00e9gal sp\u00e9cifique au bail d&#8217;habitation, l&#8217;article 7 de la loi de 1989. La r\u00e9solution est ainsi prononc\u00e9e &#8220;en application de l&#8217;article 1729 du Code civil pour manquement \u00e0 l&#8217;obligation contractuelle de paiement&#8221; (Motifs). Cette rigueur dans l&#8217;application du droit commun et de la loi sp\u00e9ciale renforce la s\u00e9curit\u00e9 juridique des bailleurs face aux impay\u00e9s. Elle d\u00e9montre que les juges n&#8217;h\u00e9sitent pas \u00e0 sanctionner les manquements caract\u00e9ris\u00e9s, m\u00eame lorsque le locataire a quitt\u00e9 les lieux, en fixant la date de prise d&#8217;effet de la r\u00e9solution au jour de ce d\u00e9part.<\/p>\n<p>Le rejet des demandes indemnitaires annexes<\/p>\n<p>Le tribunal \u00e9carte la demande du bailleur fond\u00e9e sur une convention orale de travaux. Il rappelle le caract\u00e8re d&#8217;ordre public des dispositions protectrices de la loi de 1989. Le juge souligne que &#8220;toutefois les parties peuvent convenir par une clause expresse des travaux que le locataire ex\u00e9cutera&#8221; (Motifs, citant l&#8217;article 6 de la loi du 6 juillet 1989). En l&#8217;absence d&#8217;une telle clause \u00e9crite dans le bail, la convention all\u00e9gu\u00e9e est jug\u00e9e contraire \u00e0 la loi. Cette solution prot\u00e8ge le locataire contre des engagements impr\u00e9cis et potentiellement d\u00e9s\u00e9quilibr\u00e9s. Elle rappelle avec force le formalisme exig\u00e9 pour d\u00e9roger aux obligations l\u00e9gales du bailleur en mati\u00e8re d&#8217;entretien.<\/p>\n<p>La demande en r\u00e9paration d&#8217;un pr\u00e9judice moral est \u00e9galement rejet\u00e9e pour d\u00e9faut de preuve. Le juge reconna\u00eet le caract\u00e8re d\u00e9plaisant des propos \u00e9chang\u00e9s mais exige une d\u00e9monstration concr\u00e8te du pr\u00e9judice. Il rel\u00e8ve que le demandeur &#8220;ne justifie pas de la r\u00e9alit\u00e9 du pr\u00e9judice qu\u2019il d\u00e9clare avoir subi et ne verse aucun document de nature \u00e0 en corroborer son existence&#8221; (Motifs). Cette exigence d&#8217;un pr\u00e9judice certain et prouv\u00e9 est une application classique du droit de la responsabilit\u00e9 civile.
