La juridiction a d\u00fb d\u00e9terminer l\u2019\u00e9tendue de la r\u00e9paration des pr\u00e9judices subis par l\u2019occupant, malgr\u00e9 l\u2019existence d\u2019un protocole d\u2019accord non sign\u00e9 par la d\u00e9fenderesse. Le tribunal a retenu la responsabilit\u00e9 de la soci\u00e9t\u00e9 et a condamn\u00e9 celle-ci \u00e0 indemniser int\u00e9gralement les pr\u00e9judices mat\u00e9riel et de jouissance, dans la limite de sa demande.<\/p>\n<p>La caract\u00e9risation de la responsabilit\u00e9 et l\u2019\u00e9valuation du pr\u00e9judice de jouissance<\/p>\n<p>La responsabilit\u00e9 de la soci\u00e9t\u00e9 gestionnaire est \u00e9tablie sur le fondement de la faute d\u00e9lictuelle. Le tribunal constate le comportement \u00e0 l\u2019origine du dommage de mani\u00e8re incontest\u00e9e. &#8220;En l&#8217;esp\u00e8ce il est constant que la soci\u00e9t\u00e9 [Adresse 7] a par erreur forc\u00e9 la porte de la cave occup\u00e9e par M. [R] [B], l&#8217;a vid\u00e9e de ses objets lesquels ont \u00e9t\u00e9 d\u00e9truits.&#8221; (Motifs) Ce fait volontaire cause un dommage certain, engageant l\u2019obligation de r\u00e9parer pr\u00e9vue \u00e0 l\u2019article 1240 du code civil. La faute est ainsi caract\u00e9ris\u00e9e par l\u2019action mat\u00e9rielle illicite d\u2019\u00e9vacuation et de destruction des biens.<\/p>\n<p>L\u2019\u00e9valuation du pr\u00e9judice de jouissance proc\u00e8de d\u2019une m\u00e9thode pragmatique fond\u00e9e sur des \u00e9l\u00e9ments comparatifs. Le juge \u00e9carte l\u2019estimation non justifi\u00e9e du demandeur et retient un loyer de r\u00e9f\u00e9rence produit par la d\u00e9fenderesse. &#8220;La soci\u00e9t\u00e9 [Adresse 7] produit en revanche une annonce pour une location de cave dans le [Localit\u00e9 4] pour un loyer de 80 euros par mois. Ce montant sera en cons\u00e9quence retenu.&#8221; (Motifs) La dur\u00e9e d\u2019indisponibilit\u00e9 est fix\u00e9e de mani\u00e8re pr\u00e9cise, en retenant la date de remise des cl\u00e9s admise par les deux parties, d\u00e9montrant l\u2019importance des constats non contest\u00e9s.<\/p>\n<p>La port\u00e9e limit\u00e9e du <a href=\"https:\/\/kohenavocats.com\/avocats-droit-social-paris\/avocats-transaction-indemnites-paris\/\" target=\"_blank\" title=\"protocole transactionnel\">protocole transactionnel<\/a> et la r\u00e9paration du pr\u00e9judice mat\u00e9riel<\/p>\n<p>L\u2019existence d\u2019un protocole d\u2019accord non sign\u00e9 par la partie condamn\u00e9e est sans effet sur l\u2019action en justice. Le tribunal rappelle le principe selon lequel un tel document ne saurait limiter a priori l\u2019indemnisation. &#8220;La soci\u00e9t\u00e9 [Adresse 7] ne peut invoquer un protocole qu&#8217;elle n&#8217;a pas sign\u00e9 afin de limiter a priori l&#8217;indemnisation du pr\u00e9judice \u00e0 la somme de 1669,92 euros.&#8221; (Motifs) Cette solution rejoint la jurisprudence qui rappelle qu\u2019une transaction non ex\u00e9cut\u00e9e ne bloque pas le droit d\u2019agir. &#8220;Elle peut \u00e9galement, sans que puisse lui \u00eatre oppos\u00e9e la fin de non-recevoir tir\u00e9e de l&#8217;existence du protocole d&#8217;accord transactionnel, poursuivre le litige en engageant une action au fond&#8221; (Tribunal judiciaire de Clermont-Ferrand, le 12 mai 2025, n\u00b024\/02140).<\/p>\n<p>L\u2019\u00e9valuation du pr\u00e9judice mat\u00e9riel ob\u00e9it \u00e0 un contr\u00f4le rigoureux de la preuve et au principe de l\u2019infra petita. Le juge op\u00e8re un examen d\u00e9taill\u00e9 des justificatifs, \u00e9cartant les factures non nominatives ou incompl\u00e8tes. &#8220;Les objets et factures suivantes seront \u00e9cart\u00e9s, ces derni\u00e8res n&#8217;\u00e9tant pas \u00e9t\u00e9 \u00e9tablies au nom de M. [R] [B] mais de Mme [Y] [O]&#8221; (Motifs). Cependant, le tribunal ne peut statuer au-del\u00e0 de la somme plafond sollicit\u00e9e par la d\u00e9fenderesse. &#8220;N\u00e9anmoins la d\u00e9fenderesse ayant demand\u00e9 de limiter la somme accord\u00e9e \u00e0 1669,92 euros, elle sera condamn\u00e9e \u00e0 payer cette somme au demandeur en r\u00e9paration de son pr\u00e9judice mat\u00e9riel, le tribunal ne pouvant statuer infra petita.&#8221; (Motifs) Cette d\u00e9cision illustre l\u2019articulation entre l\u2019office du juge et les demandes des parties.<\/p>\n<p>Cette d\u00e9cision affirme une application stricte du droit de la preuve en mati\u00e8re d\u2019\u00e9valuation des pr\u00e9judices. Elle rappelle avec force qu\u2019un protocole transactionnel non sign\u00e9 par l\u2019une des parties est inopposable et ne fait pas obstacle \u00e0 l\u2019action en justice.
