L&#8217;approche est purement fond\u00e9e sur les effets du trouble, confirmant son caract\u00e8re objectif.<\/p>\n<p>La r\u00e9paration distincte des pr\u00e9judices subis<\/p>\n<p>L&#8217;indemnisation du pr\u00e9judice de jouissance actuel<\/p>\n<p>Le tribunal reconna\u00eet un pr\u00e9judice distinct \u00e0 l&#8217;occupante des lieux, subi directement et quotidiennement. Il indemnise la perte de jouissance li\u00e9e \u00e0 la d\u00e9gradation de son cadre de vie par une somme forfaitaire. En revanche, il \u00e9carte la demande fond\u00e9e sur la d\u00e9gradation de l&#8217;\u00e9tat de sant\u00e9 par manque de preuve. Le lien de causalit\u00e9 entre le trouble et ce pr\u00e9judice personnel n&#8217;\u00e9tait pas \u00e9tabli par les pi\u00e8ces vers\u00e9es aux d\u00e9bats. Cette analyse d\u00e9montre l&#8217;exigence d&#8217;un lien certain et direct pour chaque chef de pr\u00e9judice invoqu\u00e9. La r\u00e9paration reste cantonn\u00e9e aux cons\u00e9quences patrimoniales directes du trouble.<\/p>\n<p>La reconnaissance d&#8217;une d\u00e9pr\u00e9ciation immobili\u00e8re certaine<\/p>\n<p>Le propri\u00e9taire, distinct de l&#8217;occupante, obtient r\u00e9paration pour la d\u00e9pr\u00e9ciation de la valeur de son bien. Le tribunal estime ce pr\u00e9judice certain et non hypoth\u00e9tique, contrairement aux arguments du d\u00e9fendeur. Il se fonde sur les \u00e9l\u00e9ments de trouble d\u00e9j\u00e0 retenus et sur une estimation professionnelle vers\u00e9e aux d\u00e9bats. La configuration d\u00e9favorable cr\u00e9\u00e9e par la construction voisine impacte n\u00e9cessairement la valeur marchande. Cette indemnisation distincte consacre la dualit\u00e9 des pr\u00e9judices subis par le propri\u00e9taire et l&#8217;occupant.
