Un pr\u00eateur, plac\u00e9 sous curatelle simple lors de la conclusion d\u2019un pr\u00eat, r\u00e9clamait le remboursement d\u2019une somme de 3200 euros. La d\u00e9fenderesse, d\u00e9bitrice, ne s\u2019est pas pr\u00e9sent\u00e9e \u00e0 l\u2019audience. Le juge a examin\u00e9 la recevabilit\u00e9 de l\u2019action et le bien-fond\u00e9 de la cr\u00e9ance. Il a accueilli la demande en ordonnant le remboursement int\u00e9gral de la somme pr\u00eat\u00e9e.<\/p>\n<p>La recevabilit\u00e9 de l\u2019action malgr\u00e9 une mesure de protection<\/p>\n<p>Le juge a implicitement valid\u00e9 la capacit\u00e9 d\u2019agir du pr\u00eateur. La curatelle simple n\u2019affecte pas la capacit\u00e9 de la personne prot\u00e9g\u00e9e \u00e0 conclure seule certains actes. Le pr\u00eat, consenti pendant cette mesure, est donc pr\u00e9sum\u00e9 valable en l\u2019absence de contestation. La d\u00e9cision \u00e9carte ainsi toute irrecevabilit\u00e9 automatique li\u00e9e au statut de la partie demanderesse. Elle confirme que la curatelle simple ne prive pas syst\u00e9matiquement de la capacit\u00e9 d\u2019ester en justice pour recouvrer une cr\u00e9ance.<\/p>\n<p>La preuve de l\u2019existence et du d\u00e9faut d\u2019ex\u00e9cution de l\u2019obligation<\/p>\n<p>Le tribunal a constat\u00e9 la r\u00e9gularit\u00e9 probatoire de la demande. Le demandeur a produit une reconnaissance de dette sign\u00e9e et un justificatif d\u2019encaissement du ch\u00e8que. &#8220;Il r\u00e9sulte de l&#8217;ensemble des pi\u00e8ces vers\u00e9es aux d\u00e9bats que Mme [Z] [E] est d\u00e9bitrice la somme de 3200 euros, au titre de la reconnaissance de dette \u00e9tablie le 04\/07\/2023&#8221; (Motifs). L\u2019absence de d\u00e9fense de l\u2019emprunteuse a facilit\u00e9 cette d\u00e9monstration. Le juge a ainsi pu fonder sa conviction sur des \u00e9l\u00e9ments \u00e9crits concordants et incontest\u00e9s.<\/p>\n<p>La port\u00e9e de la d\u00e9cision sur la preuve des actes conclus sous curatelle<\/p>\n<p>Cette d\u00e9cision illustre l\u2019autonomie conserv\u00e9e sous le r\u00e9gime de la curatelle simple. Elle rappelle que les actes accomplis par la personne prot\u00e9g\u00e9e ne sont pas nuls de plein droit. La charge de la preuve de l\u2019obligation repose sur le demandeur, quel que soit son statut. Le jugement valide une pratique courante de pr\u00eat entre particuliers malgr\u00e9 une mesure de protection. Il \u00e9vite ainsi une p\u00e9nalisation injuste des personnes prot\u00e9g\u00e9es dans leurs relations contractuelles.<\/p>\n<p>La valeur de la d\u00e9cision au regard de la condition de notori\u00e9t\u00e9<\/p>\n<p>La solution se distingue des exigences pos\u00e9es pour d\u2019autres r\u00e9gimes de protection. Une jurisprudence r\u00e9cente exige, pour la rescision pour l\u00e9sion, la preuve de la notori\u00e9t\u00e9 du trouble. &#8220;S&#8217;agissant de la condition de notori\u00e9t\u00e9 exig\u00e9e par l&#8217;article 464 pr\u00e9cit\u00e9, force est de reconna\u00eetre au vu des pi\u00e8ces vers\u00e9es au dossier que cette condition n&#8217;est pas remplie en l&#8217;esp\u00e8ce&#8221; (Cour d&#8217;appel de Limoges, le 9 janvier 2025, n\u00b024\/00191). En l\u2019esp\u00e8ce, le juge n\u2019a pas eu \u00e0 rechercher une telle notori\u00e9t\u00e9 pour valider le contrat.
