La juridiction a examin\u00e9 la validit\u00e9 d\u2019un licenciement pour insuffisance professionnelle et une demande de dommages-int\u00e9r\u00eats pour <a href=\"https:\/\/kohenavocats.com\/avocats-en-droit-penal-a-paris-conseil-et-defense-strategique\/avocat-harcelement-moral-paris\/\" target=\"_blank\" title=\"harc\u00e8lement moral\">harc\u00e8lement moral<\/a>. Elle a confirm\u00e9 la qualification de harc\u00e8lement moral et l\u2019absence de cause r\u00e9elle et s\u00e9rieuse du licenciement. La cour a ainsi condamn\u00e9 l\u2019employeur \u00e0 diverses indemnit\u00e9s au b\u00e9n\u00e9fice de la salari\u00e9e.<\/p>\n<p>La caract\u00e9risation du harc\u00e8lement moral<\/p>\n<p>La d\u00e9finition l\u00e9gale et la charge de la preuve<\/p>\n<p>Le harc\u00e8lement moral est d\u00e9fini par des agissements r\u00e9p\u00e9t\u00e9s ayant pour effet une d\u00e9gradation des conditions de travail. &#8220;Le harc\u00e8lement moral par r\u00e9f\u00e9rence \u00e0 l&#8217;article L 1152-1 du code du travail est constitu\u00e9 par des agissements r\u00e9p\u00e9t\u00e9s qui ont pour objet ou pour effet une d\u00e9gradation des conditions de travail&#8221; (Motifs de la d\u00e9cision). La charge de la preuve p\u00e8se d\u2019abord sur le salari\u00e9, qui doit pr\u00e9senter des \u00e9l\u00e9ments de fait laissant supposer l\u2019existence du harc\u00e8lement. L\u2019employeur doit ensuite d\u00e9montrer que les agissements \u00e9taient objectivement justifi\u00e9s. Cette r\u00e9partition all\u00e8ge sensiblement la preuve pour le salari\u00e9 victime.<\/p>\n<p>L\u2019appr\u00e9ciation in concreto des faits all\u00e9gu\u00e9s<\/p>\n<p>La cour a retenu la mat\u00e9rialit\u00e9 de plusieurs faits invoqu\u00e9s par la salari\u00e9e. Elle rel\u00e8ve un comportement brutal de la part d\u2019un dirigeant, une mise \u00e0 l\u2019\u00e9cart et des pressions pour reprendre le travail sur site. &#8220;Il r\u00e9sulte n\u00e9anmoins du sms de M. [B] du 16 mars 2020 et du t\u00e9moignage pr\u00e9cis et circonstanci\u00e9 de Mme [F] que M. [B] a eu un comportement brutal&#8221; (Motifs de la d\u00e9cision). Ces \u00e9l\u00e9ments, pris globalement, ont permis de pr\u00e9sumer l\u2019existence d\u2019un harc\u00e8lement moral. L\u2019employeur n\u2019a pas rapport\u00e9 la preuve de justifications objectives \u00e9trang\u00e8res \u00e0 tout harc\u00e8lement. La d\u00e9cision illustre l\u2019importance d\u2019une appr\u00e9ciation concr\u00e8te et globale des comportements.<\/p>\n<p>L\u2019absence de cause r\u00e9elle et s\u00e9rieuse du licenciement<\/p>\n<p>La preuve insuffisante de l\u2019insuffisance professionnelle<\/p>\n<p>L\u2019insuffisance professionnelle doit \u00eatre objective, non fautive et durable. Elle ne peut proc\u00e9der d\u2019une appr\u00e9ciation subjective de l\u2019employeur. &#8220;L&#8217;insuffisance professionnelle ne peut proc\u00e9der d&#8217;une seule appr\u00e9ciation subjective de l&#8217;employeur&#8221; (Motifs de la d\u00e9cision). En l\u2019esp\u00e8ce, l\u2019employeur reprochait \u00e0 la salari\u00e9e des erreurs r\u00e9p\u00e9t\u00e9es dans le calcul des provisions de cong\u00e9s pay\u00e9s. Les tableaux produits pour \u00e9tayer ces griefs \u00e9taient jug\u00e9s insuffisants. &#8220;Les tableaux produits par la soci\u00e9t\u00e9 Sacatec, qu&#8217;elle a elle-m\u00eame \u00e9labor\u00e9s sans justifier des donn\u00e9es \u00e0 partir desquelles ils ont \u00e9t\u00e9 renseign\u00e9s, ne suffisent pas \u00e0 v\u00e9rifier la mat\u00e9rialit\u00e9 du manquement&#8221; (Motifs de la d\u00e9cision). La preuve n\u2019\u00e9tait donc pas rapport\u00e9e.<\/p>\n<p>L\u2019incidence des moyens mis \u00e0 disposition par l\u2019employeur<\/p>\n<p>La cour a relev\u00e9 que les erreurs all\u00e9gu\u00e9es \u00e9taient li\u00e9es \u00e0 un outil de travail ant\u00e9rieur non performant. L\u2019employeur avait d\u2019ailleurs acquis un nouveau logiciel pour s\u00e9curiser ces t\u00e2ches. &#8220;Il en r\u00e9sulte qu&#8217;il ne peut \u00eatre reproch\u00e9 \u00e0 la salari\u00e9e des erreurs cons\u00e9cutives \u00e0 un outil de travail ant\u00e9rieur non-performant&#8221; (Motifs de la d\u00e9cision). Concernant un autre grief, l\u2019absence d\u2019instructions, d\u2019alerte ou de formation de la salari\u00e9e a \u00e9t\u00e9 not\u00e9e. L\u2019employeur ne peut licencier pour des erreurs ponctuelles sans avoir mis en place un accompagnement correctif. La d\u00e9cision rappelle ainsi l\u2019obligation de soutien de l\u2019employeur avant toute rupture pour insuffisance.<\/p>\n<p>La port\u00e9e de l\u2019arr\u00eat est significative en mati\u00e8re de preuve. Pour le harc\u00e8lement moral, la cour applique strictement l\u2019am\u00e9nagement probatoire au b\u00e9n\u00e9fice du salari\u00e9. Pour l\u2019insuffisance professionnelle, elle exige des \u00e9l\u00e9ments objectifs et v\u00e9rifiables, excluant toute subjectivit\u00e9. L\u2019arr\u00eat souligne \u00e9galement que l\u2019employeur doit fournir les outils ad\u00e9quats et ne peut reprocher des erreurs d\u00e9coulant d\u2019un \u00e9quipement d\u00e9faillant.
