Le locataire, invoquant des d\u00e9sordres importants li\u00e9s \u00e0 l&#8217;humidit\u00e9 et une non-conformit\u00e9 de l&#8217;installation de gaz, avait suspendu le paiement de ses loyers et demand\u00e9 r\u00e9paration. Les bailleurs sollicitaient quant \u00e0 eux la r\u00e9solution du bail pour d\u00e9faut de paiement. La juridiction d&#8217;appel confirme le rejet des demandes du locataire et prononce la r\u00e9solution du contrat, condamnant le preneur au paiement des sommes dues.<\/p>\n<p>La d\u00e9limitation des obligations respectives en mati\u00e8re de logement d\u00e9cent<\/p>\n<p>La caract\u00e9risation de l&#8217;ind\u00e9cence du logement et la faute du bailleur. La cour rappelle les obligations l\u00e9gales pesant sur le bailleur, issues de l&#8217;article 1719 du code civil et de l&#8217;article 6 de la loi du 6 juillet 1989. Elle souligne que le bailleur doit d\u00e9livrer un logement d\u00e9cent et en assurer la jouissance paisible. En l&#8217;esp\u00e8ce, elle constate que le logement pr\u00e9sentait \u00e0 l&#8217;entr\u00e9e des traces d&#8217;humidit\u00e9 et un \u00e9tat g\u00e9n\u00e9ral d\u00e9fra\u00eechi. Cependant, elle rel\u00e8ve que ces d\u00e9sordres &#8220;se sont fortement aggrav\u00e9es pendant l&#8217;occupation des lieux&#8221; par le locataire. La port\u00e9e de cette analyse est de subordonner la qualification d&#8217;ind\u00e9cence \u00e0 une carence prouv\u00e9e du bailleur dans l&#8217;ex\u00e9cution de ses obligations de d\u00e9livrance et d&#8217;entretien. La cour \u00e9carte ainsi la responsabilit\u00e9 des bailleurs en relevant leur r\u00e9activit\u00e9 \u00e0 proc\u00e9der aux travaux n\u00e9cessaires d\u00e8s leur information compl\u00e8te.<\/p>\n<p>La r\u00e9partition des responsabilit\u00e9s concernant les d\u00e9sordres et leur aggravation. L&#8217;arr\u00eat op\u00e8re une distinction nette entre les d\u00e9sordres pr\u00e9existants et leur amplification. Il estime que l&#8217;aggravation des probl\u00e8mes d&#8217;humidit\u00e9 et de moisissures r\u00e9sulte principalement du comportement du locataire. La cour s&#8217;appuie sur plusieurs \u00e9l\u00e9ments factuels, notamment un constat du gestionnaire indiquant que le logement &#8220;n&#8217;\u00e9tait pas correctement a\u00e9r\u00e9&#8221;, et le fait que &#8220;la grille de ventilation de la chambre avait \u00e9t\u00e9 obstru\u00e9e par un carton scotch\u00e9&#8221;. La valeur de ce raisonnement est d&#8217;affirmer que le locataire ne peut se pr\u00e9valoir d&#8217;un trouble de jouissance dont il est lui-m\u00eame la cause principale. Cela renforce l&#8217;obligation pour le preneur d&#8217;user raisonnablement des lieux lou\u00e9s et de ne pas entraver les dispositifs d&#8217;a\u00e9ration.<\/p>\n<p>Les effets de la suspension de paiement unilat\u00e9rale et la mise en \u0153uvre de la <a href=\"https:\/\/kohenavocats.fr\/avocat-resiliation-bail-paris\/\" target=\"_blank\" title=\"clause r\u00e9solutoire\">clause r\u00e9solutoire<\/a><\/p>\n<p>L&#8217;inopposabilit\u00e9 de l&#8217;exception d&#8217;inex\u00e9cution en l&#8217;absence de faute du bailleur. Le locataire invoquait l&#8217;article 1219 du code civil pour justifier la suspension du paiement des loyers. La cour rejette cet argument en consid\u00e9rant que les bailleurs n&#8217;ont pas manqu\u00e9 \u00e0 leurs obligations. Elle estime qu&#8217;ils ont agi avec diligence pour rem\u00e9dier \u00e0 la non-conformit\u00e9 de l&#8217;installation gaz d\u00e8s qu&#8217;ils en ont eu une connaissance certaine. &#8220;Les bailleurs, inform\u00e9s de cette situation le 15 f\u00e9vrier 2022 seulement, y ont rem\u00e9di\u00e9 dans les meilleurs d\u00e9lais compte tenu de la disponibilit\u00e9 de leur locataire.&#8221; Le sens de cette solution est de rappeler que l&#8217;exception d&#8217;inex\u00e9cution, pour \u00eatre valable, suppose une inex\u00e9cution suffisamment grave imputable \u00e0 l&#8217;autre partie. Une suspension unilat\u00e9rale des loyers est donc risqu\u00e9e en l&#8217;absence de faute \u00e9tablie du bailleur.<\/p>\n<p>L&#8217;acquisition de la clause r\u00e9solutoire et les suites de la r\u00e9solution du bail. La cour constate que les conditions d&#8217;acquisition de la clause r\u00e9solutoire sont r\u00e9unies en raison des impay\u00e9s persistants. Elle ordonne l&#8217;expulsion du locataire et le condamne au paiement des loyers et indemnit\u00e9s d&#8217;occupation dus, soit 7 585,67 euros. Elle d\u00e9boute \u00e9galement le preneur de sa demande de d\u00e9lais de gr\u00e2ce, faute de justificatifs sur sa situation financi\u00e8re. Cette solution illustre le principe selon lequel le d\u00e9faut de paiement du loyer, non justifi\u00e9 par une faute du bailleur, expose le locataire \u00e0 la r\u00e9solution du bail et au paiement int\u00e9gral des sommes \u00e9chues.
