L\u2019administration justifie l\u2019impossibilit\u00e9 d\u2019ex\u00e9cuter l\u2019\u00e9loignement dans le d\u00e9lai l\u00e9gal. Le juge ordonne la prolongation tout en enjoignant un examen m\u00e9dical de compatibilit\u00e9 avec la r\u00e9tention. La d\u00e9cision valide ainsi la prolongation sous condition d\u2019une expertise sanitaire tierce.<\/p>\n<p>Le contr\u00f4le des conditions de prolongation<\/p>\n<p>Le juge v\u00e9rifie d\u2019abord le strict respect des diligences administratives. L\u2019impossibilit\u00e9 de d\u00e9part dans le d\u00e9lai de quatre jours fonde la prolongation. L\u2019administration d\u00e9montre des d\u00e9marches actives pour obtenir un titre de voyage. &#8220;les autorit\u00e9s consulaires tunisiennes ont \u00e9t\u00e9 saisies d\u2019une demande d\u2019audition aux fins d\u2019identification par courriel le 19 septembre 2025 \u00e0 10h13&#8221; (Motifs). Cette preuve concr\u00e8te satisfait l\u2019exigence de diligence pr\u00e9vue par le code. Le juge \u00e9carte ensuite l\u2019alternative de l\u2019assignation \u00e0 r\u00e9sidence. Le d\u00e9faut de remise d\u2019un passeport valide rend cette mesure impossible. &#8220;elle n\u2019a pas pr\u00e9alablement remis \u00e0 un service de police ou \u00e0 une unit\u00e9 de gendarmerie un passeport en cours de validit\u00e9&#8221; (Motifs). La jurisprudence confirme cette approche exigeante des conditions l\u00e9gales.<\/p>\n<p>L\u2019encadrement sanitaire de la mesure<\/p>\n<p>La d\u00e9cision consacre un principe de protection de l\u2019int\u00e9grit\u00e9 physique. La saisine d\u2019un m\u00e9decin tiers devient obligatoire face \u00e0 certaines pathologies. Le juge ordonne cet examen malgr\u00e9 l\u2019existence d\u2019un service de soins sur place. &#8220;force est de constater que les pathologies rapport\u00e9es n\u00e9cessitent un examen m\u00e9dical de compatibilit\u00e9&#8221; (Motifs). Cette solution pr\u00e9vaut m\u00eame sans preuve d\u2019incompatibilit\u00e9 imm\u00e9diate. Elle renforce les garanties proc\u00e9durales de la personne retenue. Une jurisprudence ant\u00e9rieure valide d\u00e9j\u00e0 cette obligation. &#8220;il a \u00e9t\u00e9 satisfait par l\u2019administration a la demande d\u2019examen m\u00e9dical&#8221; (Tribunal judiciaire de Boulogne-sur-Mer, le 1 f\u00e9vrier 2025, n\u00b025\/00474). L\u2019expertise m\u00e9dicale ind\u00e9pendante devient ainsi un pr\u00e9alable essentiel.<\/p>\n<p>Cette ordonnance illustre le contr\u00f4le dual exerc\u00e9 par le juge des libert\u00e9s. Il valide la prolongation au regard des diligences administratives mat\u00e9rielles. Il conditionne simultan\u00e9ment cette mesure au respect absolu de l\u2019int\u00e9grit\u00e9 physique. L\u2019exigence d\u2019un examen m\u00e9dical tiers cr\u00e9e une garantie proc\u00e9durale substantielle.
