Cette d\u00e9cision intervient dans un litige opposant le syndicat des copropri\u00e9taires \u00e0 des copropri\u00e9taires concernant de nombreux travaux. Le juge a \u00e9t\u00e9 saisi de fins de non-recevoir soulev\u00e9es par les d\u00e9fendeurs, fond\u00e9es sur le d\u00e9faut d&#8217;int\u00e9r\u00eat et la prescription. L&#8217;ordonnance renvoie l&#8217;examen de ces exceptions au fond et organise la suite de la proc\u00e9dure.<\/p>\n<p>La comp\u00e9tence du juge de la mise en \u00e9tat pour statuer sur les exceptions<\/p>\n<p>Le juge de la mise en \u00e9tat poss\u00e8de une comp\u00e9tence exclusive pour trancher les exceptions de proc\u00e9dure. Cette comp\u00e9tence s&#8217;exerce depuis sa d\u00e9signation jusqu&#8217;\u00e0 son dessaisissement final. L&#8217;article 789 du code de proc\u00e9dure civile encadre pr\u00e9cis\u00e9ment cette attribution. Il pr\u00e9voit toutefois une possibilit\u00e9 de renvoi au fond pour examen. Le juge peut d\u00e9cider de ce renvoi en raison de la complexit\u00e9 des moyens soulev\u00e9s. Il peut aussi le faire en consid\u00e9ration de l&#8217;\u00e9tat d&#8217;avancement de l&#8217;instruction. Cette d\u00e9cision constitue alors une mesure d&#8217;administration judiciaire.<\/p>\n<p>La port\u00e9e de cette r\u00e8gle est de distinguer clairement les phases de la proc\u00e9dure. Elle permet une instruction efficace en filtrant les questions purement proc\u00e9durales simples. En l&#8217;esp\u00e8ce, la complexit\u00e9 des arguments relatifs \u00e0 la prescription a justifi\u00e9 le renvoi. Cette solution \u00e9vite de multiplier les d\u00e9cisions incidentes et pr\u00e9serve l&#8217;\u00e9conomie proc\u00e9durale. Elle garantit un examen complet des moyens avec l&#8217;ensemble des \u00e9l\u00e9ments du dossier.<\/p>\n<p>Le renvoi des questions de prescription pour examen au fond<\/p>\n<p>Les d\u00e9fendeurs invoquent l&#8217;irrecevabilit\u00e9 de l&#8217;action du syndicat pour prescription. Ils soutiennent que les travaux litigieux remontent \u00e0 plus de vingt-sept ans. Ils estiment que l&#8217;action personnelle du syndicat est soumise \u00e0 la prescription quinquennale. Le syndicat oppose que les troubles sont continus et que les travaux ont \u00e9t\u00e9 dissimul\u00e9s. Il invoque \u00e9galement la prescription trentenaire pour les actions r\u00e9elles immobili\u00e8res. La jurisprudence rappelle que la qualification de l&#8217;action est d\u00e9terminante pour le d\u00e9lai.<\/p>\n<p>&#8220;Conform\u00e9ment aux dispositions de l&#8217;article 2227 du code civil, les actions r\u00e9elles immobili\u00e8res se prescrivent par trente ans \u00e0 compter du jour o\u00f9 le titulaire d&#8217;un droit a connu ou aurait d\u00fb conna\u00eetre les faits lui permettant de l&#8217;exercer. Il est ainsi admis qu&#8217;une action tendant \u00e0 mettre fin \u00e0 un acte d&#8217;appropriation d&#8217;une partie commune est une action r\u00e9elle se prescrivant par 30 ans. En revanche, conform\u00e9ment aux dispositions de l&#8217;article 42 de la loi du 10 juillet 1965 auxquelles renvoie l&#8217;article 2224 du code civil, la prescription applicable aux actions personnelles relatives \u00e0 la <a href=\"https:\/\/kohenavocats.fr\/droit-de-la-copropriete\/\" target=\"_blank\" title=\"copropri\u00e9t\u00e9\">copropri\u00e9t\u00e9<\/a> entre copropri\u00e9taires ou entre un copropri\u00e9taire et le syndicat est de cinq ans&#8221; (Tribunal judiciaire de Paris, le 30 janvier 2024, n\u00b023\/53857). La difficult\u00e9 r\u00e9side ici dans la qualification des multiples demandes formul\u00e9es.<\/p>\n<p>La valeur de ce renvoi est de permettre un examen approfondi au fond. Le juge du fond devra v\u00e9rifier la date de connaissance des faits par le syndicat. Il devra aussi qualifier chaque atteinte all\u00e9gu\u00e9e aux parties communes. La question de l&#8217;interruption de la prescription par les assignations sera \u00e9galement d\u00e9battue. Cette d\u00e9cision pr\u00e9serve les droits de la d\u00e9fense et assure une instruction contradictoire compl\u00e8te. Elle reporte une d\u00e9cision substantielle qui n\u00e9cessite une appr\u00e9ciation souveraine des preuves.<\/p>\n<p>La gestion des demandes accessoires et la suite de la proc\u00e9dure<\/p>\n<p>Le juge de la mise en \u00e9tat a statu\u00e9 sur les demandes accessoires incidentes. Il a r\u00e9serv\u00e9 les d\u00e9pens de l&#8217;incident pour les faire suivre le sort du principal. Il a d\u00e9bout\u00e9 les parties de leurs demandes au titre de l&#8217;article 700 du code de proc\u00e9dure civile. Le juge a \u00e9galement rappel\u00e9 le caract\u00e8re ex\u00e9cutoire \u00e0 titre provisoire de sa d\u00e9cision. Enfin, il a fix\u00e9 une nouvelle audience de mise en \u00e9tat pour conclusions r\u00e9capitulatives. Cette audience est pr\u00e9vue pour permettre aux d\u00e9fendeurs de conclure d\u00e9finitivement.<\/p>\n<p>La port\u00e9e de ces mesures est d&#8217;assurer une bonne administration de la justice. La r\u00e9servation des d\u00e9pens \u00e9vite un prononc\u00e9 anticip\u00e9 et suit le principe de connexit\u00e9. Le rejet des demandes sur l&#8217;article 700 est fond\u00e9 sur l&#8217;\u00e9quit\u00e9 en l&#8217;\u00e9tat de l&#8217;instruction. Le rappel de l&#8217;ex\u00e9cution provisoire est une application de droit de l&#8217;article 514 du code de proc\u00e9dure civile. La fixation d&#8217;une date pour conclusions r\u00e9capitulatives organise sereinement la fin de l&#8217;instruction.
