Le litige opposait un locataire et son bailleur concernant l\u2019\u00e9tat d\u2019un logement et la validit\u00e9 d\u2019un cong\u00e9 pour reprise. Le locataire invoquait l\u2019ind\u00e9cence du bien et r\u00e9clamait des dommages et int\u00e9r\u00eats pour trouble de jouissance. Le bailleur sollicitait l\u2019expulsion pour reprise et le paiement de <a href=\"https:\/\/kohenavocats.fr\/avocat-recouvrement-loyers-paris\/\" target=\"_blank\" title=\"loyers impay\u00e9s\">loyers impay\u00e9s<\/a>. Le juge a reconnu l\u2019existence d\u2019un trouble de jouissance et a ordonn\u00e9 des travaux. Il a \u00e9galement prononc\u00e9 la validit\u00e9 du cong\u00e9 et ordonn\u00e9 l\u2019expulsion avec un d\u00e9lai pour quitter les lieux.<\/p>\n<p>La caract\u00e9risation objective de l\u2019ind\u00e9cence du logement<\/p>\n<p>La d\u00e9cision op\u00e8re une distinction nette entre l\u2019ind\u00e9cence et l\u2019insalubrit\u00e9. Le juge retient la violation de l\u2019obligation de d\u00e9livrer un logement d\u00e9cent. Il fonde sa d\u00e9cision sur les constats mat\u00e9riels de deux visites successives. Un premier rapport rel\u00e8ve des d\u00e9sordres comme des moisissures ou des probl\u00e8mes d\u2019a\u00e9ration. Une mise en demeure administrative ult\u00e9rieure ordonne des travaux correctifs pr\u00e9cis. Le juge en d\u00e9duit la preuve d\u2019un manquement \u00e0 l\u2019obligation l\u00e9gale. &#8220;Il en r\u00e9sulte que [le locataire] rapporte la preuve de l\u2019existence d\u2019un manquement des bailleurs \u00e0 son obligation de fourniture d\u2019un logement d\u00e9cent&#8221; (Motifs). La d\u00e9cision \u00e9carte la cause \u00e9trang\u00e8re en rejetant la faute du locataire. Les d\u00e9sordres sont inh\u00e9rents \u00e0 la structure du logement selon le magistrat. Cette approche objective se distingue d\u2019une jurisprudence ant\u00e9rieure. Un tribunal exigeait la d\u00e9monstration d\u2019une atteinte \u00e0 la sant\u00e9 ou la s\u00e9curit\u00e9. &#8220;M. [Z] [I] ne fait pas la d\u00e9monstration de ce que le logement ne satisferait pas aux prescriptions&#8221; (Tribunal judiciaire de Paris, le 30 mai 2024, n\u00b024\/01130). Le pr\u00e9sent jugement adopte un standard moins exigeant pour le locataire. La simple constatation de d\u00e9sordres contraires au d\u00e9cret de 2002 suffit. La port\u00e9e est significative pour la charge de la preuve en mati\u00e8re de bail. Le locataire doit simplement \u00e9tablir des faits non conformes aux textes. Le bailleur doit ensuite prouver que ces d\u00e9sordres lui sont imputables.<\/p>\n<p>La r\u00e9paration limit\u00e9e du pr\u00e9judice et la validit\u00e9 du cong\u00e9<\/p>\n<p>Le juge op\u00e8re une quantification rigoureuse du pr\u00e9judice n\u00e9 du trouble de jouissance. Il retient une p\u00e9riode limit\u00e9e et un taux de r\u00e9duction de loyer fixe. Le point de d\u00e9part du trouble est align\u00e9 sur la visite administrative la plus r\u00e9cente. Le taux de cinquante pour cent est d\u00e9duit de la lecture du rapport d\u2019hygi\u00e8ne. &#8220;L\u2019indemnisation du trouble de jouissance est donc fix\u00e9e \u00e0 la somme de 50%x660 eurosx11 mois soit 3630 euros&#8221; (Motifs). En revanche, le pr\u00e9judice moral et le pr\u00e9judice de sant\u00e9 sont rejet\u00e9s. Les certificats m\u00e9dicaux produits sont jug\u00e9s insuffisants pour \u00e9tablir un lien causal. Le juge exige une d\u00e9monstration pr\u00e9cise entre l\u2019\u00e9tat du logement et la pathologie. Cette exigence stricte contraste avec l\u2019appr\u00e9ciation souple de l\u2019ind\u00e9cence. Par ailleurs, la d\u00e9cision valide le cong\u00e9 pour reprise d\u00e9livr\u00e9 par le bailleur. Le juge estime que la mise en demeure de travaux n\u2019y fait pas obstacle. Aucun arr\u00eat\u00e9 d\u2019insalubrit\u00e9 n\u2019ayant \u00e9t\u00e9 prononc\u00e9, le motif de reprise est s\u00e9rieux. Le cong\u00e9 respecte les formalit\u00e9s de d\u00e9lai et de motivation l\u00e9gales. Le d\u00e9faut de notification \u00e0 l\u2019\u00e9pouse n\u2019est pas retenu comme une nullit\u00e9. Le locataire n\u2019avait pas inform\u00e9 le bailleur de sa situation matrimoniale ant\u00e9rieurement. Le juge accorde finalement un d\u00e9lai pour quitter les lieux compte tenu de l\u2019occupation paisible. Cette d\u00e9cision \u00e9quilibre les droits des deux parties de mani\u00e8re pragmatique.
