La cour d’appel, statuant par ordonance du 22 septembre 2025, examine une contestation de taux d’incapacit\u00e9 permanente. Le tribunal judiciaire avait radi\u00e9 l’affaire avant de la r\u00e9tablir \u00e0 la demande du requ\u00e9rant. La juridiction ordonne une mesure d’instruction m\u00e9dicale avant de statuer au fond. Elle d\u00e9signe un m\u00e9decin consultant et pr\u00e9cise les modalit\u00e9s de sa mission ainsi que la prise en charge des frais.<\/p>\n

Le pouvoir d’ordonner des mesures d’instruction<\/p>\n

Le cadre l\u00e9gal de la consultation m\u00e9dicale. Le juge fonde sa d\u00e9cision sur l’article R. 142-16 du code de la s\u00e9curit\u00e9 sociale. Ce texte lui conf\u00e8re un pouvoir discr\u00e9tionnaire pour ordonner toute mesure d’instruction utile. “la juridiction peut ordonner toute mesure d’instruction, qui peut prendre la forme d’une consultation clinique ou sur pi\u00e8ces” (article R. 142-16). La nature m\u00e9dicale du litige justifie pleinement le recours \u00e0 cette proc\u00e9dure. Cette ordonnance illustre l’adaptation de l’instruction aux besoins techniques du contentieux social.<\/p>\n

La mission pr\u00e9cise confi\u00e9e au m\u00e9decin expert. Le juge d\u00e9finit avec rigueur le cadre de l’expertise pour \u00e9clairer sa d\u00e9cision future. La mission inclut l’examen de la personne, l’analyse des s\u00e9quelles et l’avis sur le taux d’IPP contest\u00e9. La transmission obligatoire des \u00e9l\u00e9ments m\u00e9dicaux. L’efficacit\u00e9 de la consultation repose sur la communication compl\u00e8te du dossier m\u00e9dical. Le juge rappelle les obligations de transmission pesant sur l’organisme de s\u00e9curit\u00e9 sociale. “il appartient au service m\u00e9dical de la [9] de transmettre au m\u00e9decin consultant […] l’int\u00e9gralit\u00e9 du rapport m\u00e9dical” (Motifs de l’ordonnance). Ce dispositif garantit au consultant un acc\u00e8s \u00e0 toutes les pi\u00e8ces n\u00e9cessaires. Il assure ainsi l’\u00e9galit\u00e9 des armes et la qualit\u00e9 de l’avis rendu.<\/p>\n

La prise en charge des frais par l’organisme d\u00e9biteur. La d\u00e9cision r\u00e8gle la question financi\u00e8re en application d’une disposition l\u00e9gale pr\u00e9cise. Elle rappelle que les frais de consultation sont support\u00e9s par la caisse de s\u00e9curit\u00e9 sociale concern\u00e9e. Ce point est conforme \u00e0 l’article L. 142-11 du code de la s\u00e9curit\u00e9 sociale.
