Le tribunal judiciaire du Mesnil-Amelot, le 20 septembre 2025, statue sur un recours contre un arr\u00eat\u00e9 de placement en r\u00e9tention administrative. L’int\u00e9ress\u00e9 conteste la r\u00e9gularit\u00e9 du contr\u00f4le d’identit\u00e9 pr\u00e9alable. Le juge des libert\u00e9s et de la d\u00e9tention, saisi en urgence, rejette la requ\u00eate pr\u00e9fectorale apr\u00e8s jonction des proc\u00e9dures. Il d\u00e9clare la proc\u00e9dure irr\u00e9guli\u00e8re en raison d’un contr\u00f4le d’identit\u00e9 op\u00e9r\u00e9 hors du cadre horaire des r\u00e9quisitions du parquet.<\/p>\n

Le contr\u00f4le d’identit\u00e9, condition pr\u00e9alable essentielle<\/p>\n

Le juge rappelle son r\u00f4le de gardien des libert\u00e9s individuelles dans ce contentieux. Il doit v\u00e9rifier scrupuleusement le respect de la cha\u00eene des formalit\u00e9s l\u00e9gales. La d\u00e9cision se fonde sur l’irr\u00e9gularit\u00e9 du contr\u00f4le d’identit\u00e9 qui a initi\u00e9 la proc\u00e9dure. Le contr\u00f4le a \u00e9t\u00e9 effectu\u00e9 \u00e0 treize heures alors que les r\u00e9quisitions du procureur autorisaient des contr\u00f4les entre z\u00e9ro heure et midi. Cette violation rend la suite de la proc\u00e9dure entach\u00e9e d’ill\u00e9galit\u00e9. Le juge estime ainsi inutile d’examiner les autres moyens soulev\u00e9s contre l’arr\u00eat\u00e9 de placement.<\/p>\n

La port\u00e9e de cette analyse est imm\u00e9diate et absolue. Une irr\u00e9gularit\u00e9 entachant un acte fondateur vicie l’ensemble de la proc\u00e9dure administrative ult\u00e9rieure. Le juge des libert\u00e9s exerce ici un contr\u00f4le rigoureux du respect des conditions l\u00e9gales. Cette rigueur prot\u00e8ge effectivement la libert\u00e9 individuelle contre les mesures arbitraires. Elle rappelle que l’autorit\u00e9 administrative est strictement encadr\u00e9e par la loi. Le contr\u00f4le judiciaire constitue ainsi un rempart essentiel contre les d\u00e9rives proc\u00e9durales.<\/p>\n

La sanction de l’irr\u00e9gularit\u00e9, une garantie proc\u00e9durale<\/p>\n

La solution adopt\u00e9e est la d\u00e9claration d’irr\u00e9gularit\u00e9 de la proc\u00e9dure. Elle conduit au rejet de la requ\u00eate du pr\u00e9fet demandant le maintien en r\u00e9tention. Cette sanction est automatique et ne n\u00e9cessite pas la recherche d’un pr\u00e9judice. Le juge consid\u00e8re que l’acte initial \u00e9tant ill\u00e9gal, la privation de libert\u00e9 ne peut se fonder sur lui. La d\u00e9cision met donc fin \u00e0 la r\u00e9tention administrative de l’int\u00e9ress\u00e9. Elle ordonne sa remise en libert\u00e9 dans les plus brefs d\u00e9lais pr\u00e9vus par la proc\u00e9dure.<\/p>\n

La valeur de cette jurisprudence renforce une ligne jurisprudentielle constante. Elle rejoint une d\u00e9cision du tribunal de Boulogne-sur-Mer sanctionnant un d\u00e9faut de cadre l\u00e9gal. “Il y a lieu de consid\u00e9rer que l’int\u00e9ress\u00e9 a \u00e9t\u00e9 priv\u00e9 de libert\u00e9s durant 45 minutes sans cadre judiciaire ni administratif” (Tribunal judiciaire de Boulogne-sur-Mer, le 23 avril 2025, n\u00b025\/01725). La Cour d’appel de Douai a \u00e9galement annul\u00e9 un placement pour irr\u00e9gularit\u00e9 proc\u00e9durale. “Le premier juge a fait droit \u00e0 la requ\u00eate en contestation de l’arr\u00eat\u00e9 de placement” (Cour d’appel de Douai, le 22 mars 2025, n\u00b025\/00533). Cette d\u00e9cision confirme ainsi une interpr\u00e9tation stricte des textes protecteurs des libert\u00e9s.
