La juridiction doit d\u00e9terminer sa comp\u00e9tence mat\u00e9rielle et les r\u00e8gles de repr\u00e9sentation obligatoire. Elle se d\u00e9clare incomp\u00e9tente au profit du tribunal judiciaire avec repr\u00e9sentation obligatoire.<\/p>\n<p>La fixation de la comp\u00e9tence par les demandes initiales<\/p>\n<p>Le montant des pr\u00e9tentions d\u00e9termine la juridiction comp\u00e9tente. Le juge qui se d\u00e9clare incomp\u00e9tent doit d\u00e9signer la juridiction qu&#8217;il estime comp\u00e9tente. Cette d\u00e9signation s&#8217;impose aux parties et au juge de renvoi par la suite. Le dossier est transmis au greffe de la nouvelle juridiction d\u00e9sign\u00e9e. Les parties sont alors invit\u00e9es \u00e0 poursuivre l&#8217;instance selon les r\u00e8gles applicables.<\/p>\n<p>La formation avec repr\u00e9sentation obligatoire devient alors la r\u00e8gle. Le tribunal judiciaire statue avec repr\u00e9sentation par avocat dans ce cas. Les parties doivent constituer avocat dans le mois suivant l&#8217;avis du greffe. \u00c0 d\u00e9faut, l&#8217;affaire sera d&#8217;office radi\u00e9e du r\u00f4le de la juridiction. Cette solution garantit le respect des r\u00e8gles de proc\u00e9dure et de l&#8217;ordre public.
