Il statue sur une demande de constat de r\u00e9siliation de bail pour d\u00e9faut de paiement de loyers et sur l&#8217;expulsion des locataires. La juridiction examine la recevabilit\u00e9 de la demande et les conditions d&#8217;acquisition de la clause r\u00e9solutoire. Elle accueille les demandes principales du bailleur et rejette la demande de d\u00e9lais de paiement form\u00e9e par un locataire.<\/p>\n<p>La r\u00e9gularit\u00e9 proc\u00e9durale conditionne l&#8217;examen du fond<\/p>\n<p>La juridiction v\u00e9rifie scrupuleusement le respect des formalit\u00e9s pr\u00e9alables \u00e0 l&#8217;action. Le bailleur justifie avoir saisi la commission de coordination des actions de pr\u00e9vention des expulsions locatives deux mois avant l&#8217;assignation. &#8220;Par ailleurs, [les bailleurs] justifient avoir saisi la commission de coordination des actions de pr\u00e9vention des expulsions locatives (CCAPEX) le 2 d\u00e9cembre 2024, soit deux mois au moins avant la d\u00e9livrance de l\u2019assignation du 19 f\u00e9vrier 2025&#8221; (Motifs). Une copie de l&#8217;assignation a \u00e9galement \u00e9t\u00e9 notifi\u00e9e au pr\u00e9fet six semaines avant l&#8217;audience. Ce contr\u00f4le strict assure la protection des locataires contre les expulsions pr\u00e9cipit\u00e9es. Il garantit que les mesures d&#8217;accompagnement social ont \u00e9t\u00e9 envisag\u00e9es avant toute action judiciaire. La proc\u00e9dure est ainsi d\u00e9clar\u00e9e recevable, permettant un examen au fond.<\/p>\n<p>Le d\u00e9faut de comparution n&#8217;emp\u00eache pas un jugement au fond. En l&#8217;absence d&#8217;une partie, le juge statue par jugement r\u00e9put\u00e9 contradictoire. Il ne fait droit \u00e0 la demande que s&#8217;il l&#8217;estime r\u00e9guli\u00e8re, recevable et bien fond\u00e9e. Cette r\u00e8gle pr\u00e9serve les droits de la d\u00e9fense tout en \u00e9vitant la carence juridictionnelle. Elle impose au demandeur de rapporter la preuve de ses pr\u00e9tentions malgr\u00e9 l&#8217;absence de d\u00e9bat. Le juge exerce donc un contr\u00f4le complet et impartial des demandes pr\u00e9sent\u00e9es. Cette approche \u00e9quilibre l&#8217;efficacit\u00e9 de la justice et les garanties proc\u00e9durales fondamentales.<\/p>\n<p>L&#8217;acquisition de la clause r\u00e9solutoire entra\u00eene la r\u00e9siliation du bail<\/p>\n<p>Le juge constate la r\u00e9union des conditions l\u00e9gales pour l&#8217;application de la clause. Le bail contient une clause r\u00e9solutoire pr\u00e9vue par l&#8217;article 24 de la loi de 1989. Un commandement de payer visant cette clause a \u00e9t\u00e9 signifi\u00e9 en bonne et due forme. &#8220;Il ressort des pi\u00e8ces communiqu\u00e9es que les sommes dues dont le paiement \u00e9tait demand\u00e9 n&#8217;ont pas \u00e9t\u00e9 r\u00e9gl\u00e9es dans le d\u00e9lai de deux mois&#8221; (Motifs). L&#8217;acquisition de la clause est donc constat\u00e9e \u00e0 l&#8217;expiration du d\u00e9lai de deux mois suivant le commandement. La r\u00e9siliation du bail prend effet \u00e0 compter du lendemain, soit le 26 janvier 2025. Cette application stricte de la loi s\u00e9curise le recours du bailleur en cas d&#8217;impay\u00e9s.<\/p>\n<p>Le rejet de la demande de d\u00e9lais de paiement est justifi\u00e9 par l&#8217;absence de reprise des loyers courants. Le locataire sollicitant les d\u00e9lais n&#8217;a pas repris le paiement int\u00e9gral avant l&#8217;audience. &#8220;Cependant il n\u2019a pas repris le paiement int\u00e9gral du loyer courant avant l\u2019audience ce qui ne permet pas d\u2019\u00e9tablir sa bonne foi et sa capacit\u00e9 \u00e0 s\u2019acquitter de sa dette dans des d\u00e9lais l\u00e9gaux&#8221; (Motifs). La dette a m\u00eame augment\u00e9 depuis le commandement de payer et l&#8217;assignation. Le bailleur s&#8217;oppose par ailleurs \u00e0 l&#8217;octroi de d\u00e9lais. Le juge dispose donc d&#8217;un pouvoir d&#8217;appr\u00e9ciation pour refuser les d\u00e9lais lorsque les conditions l\u00e9gales ne sont pas remplies. Cette d\u00e9cision pr\u00e9serve les int\u00e9r\u00eats du bailleur face \u00e0 un locataire dont la situation ne s&#8217;am\u00e9liore pas.<\/p>\n<p>La condamnation au paiement distingue la cr\u00e9ance principale des frais irr\u00e9couvrables<\/p>\n<p>Le bailleur rapporte la preuve de l&#8217;arri\u00e9r\u00e9 de loyers et charges par les pi\u00e8ces du dossier. Il obtient la condamnation solidaire des locataires au paiement de la somme due. Cette condamnation inclut les loyers impay\u00e9s et l&#8217;indemnit\u00e9 d&#8217;occupation due apr\u00e8s la r\u00e9siliation. &#8220;Il y a lieu en tant que de besoin et au vu des \u00e9l\u00e9ments de faits propres \u00e0 l&#8217;affaire, de fixer l&#8217;indemnit\u00e9 d&#8217;occupation au montant du loyer principal&#8221; (Motifs). Le juge rappelle cependant l&#8217;interdiction de mettre \u00e0 la charge du locataire certains frais. &#8220;Il r\u00e9sulte de ces dispositions que le bailleur ne peut mettre \u00e0 la charge du locataire les frais relatifs au recouvrement amiable ou contentieux de sa cr\u00e9ance au titre de l\u2019arri\u00e9r\u00e9 locatif&#8221; (Motifs). Cette solution est conforme \u00e0 la jurisprudence existante. &#8220;Il r\u00e9sulte de ces dispositions que le bailleur ne peut mettre \u00e0 la charge du locataire les frais relatifs au recouvrement amiable ou contentieux de sa cr\u00e9ance au titre de l&#8217;arri\u00e9r\u00e9 locatif&#8221; (Tribunal judiciaire de Bobigny, le 17 d\u00e9cembre 2025, n\u00b025\/00869). Seuls les d\u00e9pens et une indemnit\u00e9 au titre de l&#8217;article 700 du code de proc\u00e9dure civile peuvent \u00eatre allou\u00e9s.<\/p>\n<p>L&#8217;expulsion est ordonn\u00e9e avec un d\u00e9lai de deux mois apr\u00e8s commandement de lib\u00e9rer les lieux. Le juge pr\u00e9voit le concours de la force publique et d&#8217;un serrurier si besoin. Le sort des meubles laiss\u00e9s dans les lieux est r\u00e9gi par les dispositions du code des proc\u00e9dures civiles d&#8217;ex\u00e9cution. Cette mesure est la cons\u00e9quence directe et n\u00e9cessaire de la r\u00e9siliation du bail constat\u00e9e. Elle permet au bailleur de recouvrer la libre disposition de son bien.
