Le bailleur d&#8217;un logement-foyer sollicitait la r\u00e9siliation du contrat pour impay\u00e9s et l&#8217;expulsion de l&#8217;occupant. Apr\u00e8s une proc\u00e9dure par d\u00e9faut, le juge a d\u00e9clar\u00e9 la demande recevable et l&#8217;a accueillie en constatant la r\u00e9siliation de plein droit. Il a ordonn\u00e9 l&#8217;expulsion et condamn\u00e9 l&#8217;occupant au paiement de diverses sommes.<\/p>\n<p>La recevabilit\u00e9 de l&#8217;action en expulsion dans les logements-foyers<\/p>\n<p>Le r\u00e9gime de notification pr\u00e9alable \u00e0 l&#8217;autorit\u00e9 administrative. Le code de la construction et de l&#8217;habitation impose g\u00e9n\u00e9ralement une formalit\u00e9 protectrice avant toute action en expulsion. L&#8217;assignation doit \u00eatre notifi\u00e9e au repr\u00e9sentant de l&#8217;\u00c9tat &#8220;au moins un mois avant l&#8217;audience, afin qu&#8217;il informe les services comp\u00e9tents&#8221; (article L. 632-1 du code de la construction et de l&#8217;habitation). Cette r\u00e8gle vise \u00e0 permettre l&#8217;intervention des services sociaux pour pr\u00e9venir l&#8217;expulsion. Une jurisprudence r\u00e9cente rappelle que cette notification est requise &#8220;\u00e0 peine d&#8217;irrecevabilit\u00e9 de la demande&#8221; (Tribunal judiciaire, le 29 juillet 2025, n\u00b024\/00153). Le l\u00e9gislateur a donc instaur\u00e9 un filtrage proc\u00e9dural pour prot\u00e9ger les personnes vuln\u00e9rables.<\/p>\n<p>L&#8217;exclusion sp\u00e9cifique des logements-foyers de ce formalisme. Le juge a cependant relev\u00e9 que le logement litigieux \u00e9tait un logement-foyer. Il a appliqu\u00e9 l&#8217;article L. 632-3 du m\u00eame code, qui dispose que &#8220;les dispositions du pr\u00e9sent chapitre ne s&#8217;appliquent pas aux logements-foyers&#8221;. Ainsi, le bailleur \u00e9tait dispens\u00e9 de la notification \u00e0 la pr\u00e9fecture. Cette exclusion se justifie par le statut particulier de ces structures, souvent g\u00e9r\u00e9es par des organismes sociaux, et par un encadrement contractuel sp\u00e9cifique. La recevabilit\u00e9 de l&#8217;action est donc appr\u00e9ci\u00e9e diff\u00e9remment selon la nature du logement occup\u00e9.<\/p>\n<p>Les conditions de la r\u00e9siliation de plein droit pour impay\u00e9s<\/p>\n<p>Le fondement l\u00e9gal et contractuel de la r\u00e9siliation. Le juge a combin\u00e9 les dispositions du code civil et du code de la construction et de l&#8217;habitation. L&#8217;article 1224 du code civil pr\u00e9voit que la r\u00e9solution peut r\u00e9sulter de l&#8217;application d&#8217;une <a href=\"https:\/\/kohenavocats.fr\/avocat-resiliation-bail-paris\/\" target=\"_blank\" title=\"clause r\u00e9solutoire\">clause r\u00e9solutoire<\/a>. Le juge a ensuite appliqu\u00e9 l&#8217;article R.633-3 du code de la construction et de l&#8217;habitation, qui autorise la r\u00e9siliation &#8220;pour impay\u00e9, lorsque trois termes mensuels cons\u00e9cutifs [&#8230;] sont impay\u00e9s ou bien, en cas de paiement partiel, lorsqu&#8217;une somme au moins \u00e9gale \u00e0 deux fois le montant mensuel [&#8230;] reste due&#8221;. Une jurisprudence identique pr\u00e9cise que le propri\u00e9taire peut r\u00e9silier le contrat &#8220;notamment en cas d&#8217;impay\u00e9, lorsque trois termes mensuels cons\u00e9cutifs [&#8230;] sont impay\u00e9s&#8221; (Tribunal judiciaire de Paris, le 28 mars 2024, n\u00b024\/01288). Le contrat contenait une clause conforme, pr\u00e9voyant un d\u00e9lai d&#8217;un mois apr\u00e8s mise en demeure.<\/p>\n<p>La mise en \u0153uvre proc\u00e9durale de la r\u00e9siliation de plein droit. Le bailleur a justifi\u00e9 avoir signifi\u00e9 une mise en demeure pr\u00e9cisant que le d\u00e9faut de paiement entra\u00eenerait la r\u00e9siliation de plein droit. Le juge a constat\u00e9 que les sommes restaient dues apr\u00e8s l&#8217;expiration du d\u00e9lai. Il en a d\u00e9duit que la condition contractuelle et l\u00e9gale \u00e9tait remplie. La r\u00e9siliation \u00e9tait donc acquise de plein droit \u00e0 la date fix\u00e9e par la mise en demeure, sans qu&#8217;une d\u00e9cision judiciaire d\u00e9clarative soit n\u00e9cessaire. Le juge s&#8217;est born\u00e9 \u00e0 en constater la r\u00e9alit\u00e9, ce qui justifiait les suites de l&#8217;expulsion et la condamnation \u00e0 une indemnit\u00e9 d&#8217;occupation.<\/p>\n<p>Les mesures ordonn\u00e9es en r\u00e9f\u00e9r\u00e9 et leurs modalit\u00e9s d&#8217;ex\u00e9cution<\/p>\n<p>Le prononc\u00e9 de mesures provisoires en pr\u00e9sence d&#8217;une obligation non s\u00e9rieusement contestable. Sur le fondement de l&#8217;article 835 du code de proc\u00e9dure civile, le juge a accord\u00e9 une provision pour la dette locative, estimant que l&#8217;obligation de payer n&#8217;\u00e9tait &#8220;pas s\u00e9rieusement contestable&#8221;. Il a \u00e9galement fix\u00e9 une indemnit\u00e9 d&#8217;occupation provisionnelle mensuelle jusqu&#8217;\u00e0 la lib\u00e9ration des lieux. Ces mesures sont caract\u00e9ristiques du r\u00e9f\u00e9r\u00e9, permettant d&#8217;obtenir une avance sans attendre un jugement au fond. Le juge a veill\u00e9 \u00e0 calculer pr\u00e9cis\u00e9ment les sommes dues, en rectifiant m\u00eame le d\u00e9compte initial du bailleur.<\/p>\n<p>Le r\u00e9gime protecteur de l&#8217;expulsion malgr\u00e9 la r\u00e9siliation de plein droit. Bien que la r\u00e9siliation soit constat\u00e9e, l&#8217;expulsion n&#8217;est pas imm\u00e9diate. Le juge a rappel\u00e9 les dispositions protectrices de l&#8217;article L.412-1 du code des proc\u00e9dures civiles d&#8217;ex\u00e9cution. Il a accord\u00e9 un d\u00e9lai de sept jours pour lib\u00e9rer volontairement les lieux. \u00c0 d\u00e9faut, un commandement devra \u00eatre signifi\u00e9, et l&#8217;expulsion forc\u00e9e ne pourra intervenir qu&#8217;apr\u00e8s un d\u00e9lai de deux mois suivant ce commandement.
