Une soci\u00e9t\u00e9 civile immobili\u00e8re demande la r\u00e9siliation d\u2019un bail pour impay\u00e9s et l\u2019expulsion du locataire. Le juge d\u00e9clare la demande recevable mais la rejette au fond. Il constate l\u2019existence de contestations s\u00e9rieuses et renvoie les parties devant le juge du fond.<\/p>\n<p>La recevabilit\u00e9 formelle face \u00e0 l\u2019exigence probatoire<\/p>\n<p>La r\u00e9gularit\u00e9 proc\u00e9durale est strictement v\u00e9rifi\u00e9e. Le juge rel\u00e8ve le respect des d\u00e9lais de notification pr\u00e9vus par la loi du 6 juillet 1989. La soci\u00e9t\u00e9 a produit la notification \u00e0 la commission de pr\u00e9vention des expulsions deux mois avant l\u2019assignation. Elle a aussi d\u00e9nonc\u00e9 l\u2019assignation \u00e0 la pr\u00e9fecture six semaines avant l\u2019audience. Son action est donc d\u00e9clar\u00e9e recevable sur le plan formel. Cette recevabilit\u00e9 ne pr\u00e9juge cependant pas du bien-fond\u00e9 des pr\u00e9tentions. Elle ouvre simplement la voie \u00e0 un examen au fond des demandes pr\u00e9sent\u00e9es. La proc\u00e9dure d\u2019expulsion reste encadr\u00e9e par des formalit\u00e9s protectrices imp\u00e9ratives.<\/p>\n<p>L\u2019examen au fond r\u00e9v\u00e8le imm\u00e9diatement une carence probatoire d\u00e9cisive. Le juge applique le principe selon lequel &#8220;il incombe \u00e0 chaque partie de prouver conform\u00e9ment \u00e0 la loi les faits n\u00e9cessaires au succ\u00e8s de sa pr\u00e9tention&#8221; (article 9 du code de proc\u00e9dure civile). Les d\u00e9comptes fournis par la soci\u00e9t\u00e9 sont incomplets et ne justifient pas les soldes ant\u00e9rieurs. Le juge note que &#8220;les soldes d\u00e9biteurs ant\u00e9rieurs des d\u00e9comptes ne sont pas justifi\u00e9s, et les mois d\u2019avril et mai 2025 ne sont pas inclus&#8221;. Cette insuffisance documentaire emp\u00eache d\u2019\u00e9tablir la r\u00e9alit\u00e9 de la cr\u00e9ance all\u00e9gu\u00e9e. La demande se heurte ainsi \u00e0 une contestation s\u00e9rieuse sur un \u00e9l\u00e9ment essentiel.<\/p>\n<p>Le rejet des demandes au r\u00e9f\u00e9r\u00e9 et le renvoi au fond<\/p>\n<p>La demande de constat de r\u00e9siliation \u00e9choue devant le juge de l\u2019incontestable. Le juge rappelle que sa mission en r\u00e9f\u00e9r\u00e9 est limit\u00e9e par l\u2019article 835 du code de proc\u00e9dure civile. Il ne peut ordonner une mesure que si elle ne se heurte \u00e0 aucune contestation s\u00e9rieuse. En l\u2019esp\u00e8ce, la preuve du d\u00e9faut de paiement faisant suite au commandement n\u2019est pas \u00e9tablie. Le juge motive ainsi son refus : &#8220;il n\u2019est donc pas possible d\u2019\u00e9tablir, comme l\u2019affirme la <a href=\"https:\/\/kohenavocats.fr\/elementor-60\/avocats-droit-immobilier-paris\/avocat-sci-paris\/\" target=\"_blank\" title=\"SCI\">SCI<\/a> Marseille Junot 20, que le <a href=\"https:\/\/kohenavocats.fr\/avocat-recouvrement-loyers-paris\/\" target=\"_blank\" title=\"commandement de payer\">commandement de payer<\/a> est rest\u00e9 infructueux&#8221;. La demande de r\u00e9siliation et d\u2019expulsion n\u00e9cessite donc un d\u00e9bat au fond. Cette solution rappelle que la <a href=\"https:\/\/kohenavocats.fr\/avocat-resiliation-bail-paris\/\" target=\"_blank\" title=\"clause r\u00e9solutoire\">clause r\u00e9solutoire<\/a> s\u2019interpr\u00e8te strictement. Une jurisprudence r\u00e9cente souligne que sa mise en \u0153uvre requiert une preuve certaine du d\u00e9faut de paiement. &#8220;Le bailleur, au titre d\u2019un <a href=\"https:\/\/kohenavocats.fr\/avocats-en-droit-immobilier-et-droit-des-affaires-a-paris-kohen-avocats\/avocats-droit-immobilier-paris\/avocats-baux-commerciaux-paris\/\" target=\"_blank\" title=\"bail commercial\">bail commercial<\/a>, demandant la constatation de l\u2019acquisition de la clause r\u00e9solutoire comprise dans le bail doit rapporter la preuve de sa cr\u00e9ance&#8221; (Cour d\u2019appel de Lyon, le 5 f\u00e9vrier 2025, n\u00b024\/00205). Le principe est transposable au bail d\u2019habitation devant le juge des r\u00e9f\u00e9r\u00e9s.<\/p>\n<p>La demande de provision subit le m\u00eame sort pour des motifs identiques. Le juge pourrait accorder une provision si l\u2019obligation n\u2019est pas s\u00e9rieusement contestable. Or, l\u2019existence m\u00eame de la dette locative est mise en doute par les lacunes probatoires. Le juge constate \u00e0 nouveau que &#8220;les soldes d\u00e9biteurs ant\u00e9rieurs des d\u00e9comptes ne sont pas justifi\u00e9s&#8221;. Il en d\u00e9duit qu\u2019il &#8220;n\u2019est donc pas possible d\u2019\u00e9tablir, comme l\u2019affirme la SCI Marseille Junot 20, l\u2019existence et le montant d\u2019une dette locative&#8221;. La demande de condamnation au paiement est donc renvoy\u00e9e \u00e0 l\u2019instance au fond. Ce renvoi syst\u00e9matique prot\u00e8ge le d\u00e9biteur contre une ex\u00e9cution forc\u00e9e pr\u00e9cipit\u00e9e. Il garantit un d\u00e9bat contradictoire complet sur la r\u00e9alit\u00e9 des sommes r\u00e9clam\u00e9es.
