Le tribunal judiciaire, statuant en mati\u00e8re de contentieux de la protection, rend son jugement le 18 septembre 2025. Un bailleur social avait engag\u00e9 une proc\u00e9dure en r\u00e9siliation de bail pour impay\u00e9s. En audience, ce dernier s’est d\u00e9sist\u00e9 de ses demandes principales, la dette \u00e9tant sold\u00e9e, ne conservant qu’une demande accessoire sur les d\u00e9pens. Les locataires ont accept\u00e9 de supporter ces frais. Le juge constate le d\u00e9sistement et condamne les locataires aux d\u00e9pens. La d\u00e9cision pr\u00e9cise les conditions de perfection du d\u00e9sistement et ses cons\u00e9quences financi\u00e8res.<\/p>\n

Le perfection du d\u00e9sistement d’instance<\/p>\n

La recevabilit\u00e9 du d\u00e9sistement unilat\u00e9ral. Le code de proc\u00e9dure civile r\u00e9git strictement la renonciation \u00e0 l’instance. L’article 394 en reconna\u00eet le principe au demandeur. Toutefois, son article 395 subordonne son perfection \u00e0 l’accord du d\u00e9fendeur. Le juge rappelle cette r\u00e8gle fondamentale pour encadrer la volont\u00e9 unilat\u00e9rale. Il applique ensuite l’exception pr\u00e9vue par ce m\u00eame texte.<\/p>\n

“Toutefois, l’acceptation n’est pas n\u00e9cessaire si le d\u00e9fendeur n’a pr\u00e9sent\u00e9 aucune d\u00e9fense au fond ou fin de non-recevoir au moment o\u00f9 le demandeur se d\u00e9siste.” (article 395 du code de proc\u00e9dure civile). En l’esp\u00e8ce, les locataires n’avaient pas encore pr\u00e9sent\u00e9 de d\u00e9fense au fond. Le d\u00e9sistement est donc devenu parfait sans leur acceptation expresse. Cette solution s\u00e9curise la fin de l’instance lorsque le d\u00e9bat n’est pas engag\u00e9. Elle \u00e9vite aussi des discussions proc\u00e9durales inutiles apr\u00e8s le renoncement.<\/p>\n

Les cons\u00e9quences financi\u00e8res du d\u00e9sistement<\/p>\n

La condamnation aux d\u00e9pens de l’instance \u00e9teinte. Le d\u00e9sistement met fin au proc\u00e8s mais pas n\u00e9cessairement aux obligations p\u00e9cuniaires. L’article 399 du code de proc\u00e9dure civile \u00e9tablit une pr\u00e9somption de charge. “Le d\u00e9sistement emporte, sauf convention contraire, soumission de payer les frais de l’instance \u00e9teinte.” (article 399 du code de proc\u00e9dure civile). Le principe est donc la condamnation du demandeur d\u00e9sist\u00e9. Cette r\u00e8gle vise \u00e0 compenser les frais engag\u00e9s par la partie adverse.<\/p>\n

La convention contraire des parties modifie ce principe. En l’esp\u00e8ce, les d\u00e9fendeurs ont explicitement accept\u00e9 de supporter les d\u00e9pens. Le tribunal valide cet accord intervenu \u00e0 l’audience publique. Il condamne donc les locataires aux frais, incluant les actes d’huissier. Cette solution consacre l’autonomie des parties pour am\u00e9nager les cons\u00e9quences du d\u00e9sistement. Elle d\u00e9roge \u00e0 la r\u00e8gle l\u00e9gale par la volont\u00e9 commune exprim\u00e9e devant le juge.<\/p>\n

La port\u00e9e de cette d\u00e9cision est double. Elle rappelle d’abord la condition proc\u00e9durale du d\u00e9sistement unilat\u00e9ral. La jurisprudence confirme cette interpr\u00e9tation restrictive de l’article 395. “Le d\u00e9sistement n’est parfait que par l’acceptation du d\u00e9fendeur. Toutefois, l’acceptation n’est pas n\u00e9cessaire si le d\u00e9fendeur n’a pr\u00e9sent\u00e9 aucune d\u00e9fense au fond ou fin de non-recevoir” (Tribunal judiciaire de Saint-Brieuc, le 26 janvier 2026, n\u00b025\/00533). Ensuite, elle illustre la libert\u00e9 des parties concernant les d\u00e9pens. Le tribunal valide leur accord d\u00e9rogeant \u00e0 l’article 399. Cette approche est conforme \u00e0 une d\u00e9cision ant\u00e9rieure. “Aux termes de l’article 399 du code de proc\u00e9dure civile, le d\u00e9sistement emporte, sauf convention contraire, soumission de payer les frais” (Tribunal judiciaire de Bergerac, le 12 septembre 2025, n\u00b023\/00530).
