Suite \u00e0 un <a href=\"https:\/\/kohenavocats.com\/avocats-droit-social-paris\/avocats-accident-travail-paris\/\" target=\"_blank\" title=\"accident du travail\">accident du travail<\/a>, le taux initial est contest\u00e9 apr\u00e8s une nouvelle consolidation. Le tribunal ordonne une expertise m\u00e9dicale pour d\u00e9terminer le taux applicable \u00e0 la date de cette consolidation, conform\u00e9ment au bar\u00e8me indicatif.<\/p>\n<p>Le principe de la date de consolidation<br \/>\nLe droit fixe le moment pr\u00e9cis pour \u00e9valuer l\u2019incapacit\u00e9 permanente. L\u2019appr\u00e9ciation doit se faire \u00e0 la date o\u00f9 l\u2019\u00e9tat de la victime se stabilise. &#8220;L\u2019incapacit\u00e9 permanente est appr\u00e9ci\u00e9e \u00e0 la date de la consolidation de l\u2019\u00e9tat du salari\u00e9&#8221; (Motifs de la d\u00e9cision). Ce principe est constant dans la jurisprudence r\u00e9cente des juridictions du fond. &#8220;Le taux d\u2019incapacit\u00e9 permanente partielle doit \u00eatre fix\u00e9 en fonction de l\u2019\u00e9tat s\u00e9quellaire au jour de la consolidation de l\u2019\u00e9tat de la victime&#8221; (Tribunal judiciaire de Bar-le-Duc, le 13 f\u00e9vrier 2026, n\u00b025\/00125). La date de consolidation constitue ainsi le point de r\u00e9f\u00e9rence intangible pour toute \u00e9valuation. Elle permet une appr\u00e9ciation objective et d\u00e9finitive des s\u00e9quelles imputables \u00e0 l\u2019accident.<\/p>\n<p>La mise en \u0153uvre par l\u2019expertise judiciaire<br \/>\nLe juge use de son pouvoir d\u2019instruction face \u00e0 des constatations m\u00e9dicales divergentes. Il ordonne une mesure d\u2019expertise pour \u00e9clairer sa d\u00e9cision sur le taux applicable. &#8220;Il convient d\u2019ordonner une expertise m\u00e9dicale sur pi\u00e8ces&#8221; (Motifs de la d\u00e9cision). La mission de l\u2019expert est strictement cadr\u00e9e par la d\u00e9cision du tribunal. Il doit &#8220;d\u00e9terminer le taux d\u2019incapacit\u00e9 permanente partielle, en se pla\u00e7ant \u00e0 la date de consolidation du 21 mars 2018&#8221; (Dispositif). L\u2019expertise vise \u00e0 reconstituer l\u2019\u00e9tat s\u00e9quellaire \u00e0 cette date pr\u00e9cise. Elle \u00e9carte ainsi toute consid\u00e9ration d\u2019\u00e9l\u00e9ments post\u00e9rieurs \u00e0 la consolidation.<\/p>\n<p>L\u2019encadrement l\u00e9gal de l\u2019\u00e9valuation du taux<br \/>\nLe l\u00e9gislateur a d\u00e9fini les crit\u00e8res guidant la fixation du taux d\u2019incapacit\u00e9. Le juge doit se fonder sur une pluralit\u00e9 d\u2019\u00e9l\u00e9ments pr\u00e9vus par la loi. Le taux est d\u00e9termin\u00e9 &#8220;d\u2019apr\u00e8s la nature de l\u2019infirmit\u00e9, l\u2019\u00e9tat g\u00e9n\u00e9ral, l\u2019\u00e2ge, les facult\u00e9s physiques et mentales de la victime&#8221; (Motifs de la d\u00e9cision). Le bar\u00e8me indicatif d\u2019invalidit\u00e9 fournit un cadre de r\u00e9f\u00e9rence essentiel. Il pr\u00e9voit notamment &#8220;un taux minimum de 5% lorsque la flexion du genou ne peut s\u2019effectuer au-del\u00e0 de 110\u00b0&#8221; (Motifs de la d\u00e9cision). Ces \u00e9l\u00e9ments l\u00e9gaux garantissent une appr\u00e9ciation \u00e0 la fois technique et \u00e9quitable. Ils assurent une certaine uniformit\u00e9 dans l\u2019indemnisation des pr\u00e9judices professionnels.<\/p>\n<p>La port\u00e9e proc\u00e9durale de la d\u00e9cision<br \/>\nL\u2019ordonnance d\u2019expertise constitue une mesure d\u2019instruction avant dire droit. Elle suspend le jugement sur le fond en attendant le rapport d\u2019expert. Le tribunal renvoie &#8220;l\u2019examen de l\u2019affaire \u00e0 l\u2019audience du mercredi 13 mai 2026&#8221; (Dispositif). La d\u00e9cision impose \u00e9galement des obligations pr\u00e9cises aux parties. Elles doivent transmettre \u00e0 l\u2019expert tous les documents m\u00e9dicaux justificatifs. Cette mesure assure l\u2019\u00e9galit\u00e9 des armes et le contradictoire dans la proc\u00e9dure.
