Le syndicat demandait la condamnation des copropri\u00e9taires d\u00e9faillants au paiement de dommages et int\u00e9r\u00eats distincts des int\u00e9r\u00eats moratoires. La juridiction a accueilli cette demande en allouant une indemnit\u00e9 forfaitaire tout en pr\u00e9cisant les conditions de la r\u00e9paration du pr\u00e9judice autonome.<\/p>\n<p>La reconnaissance d\u2019un pr\u00e9judice autonome li\u00e9 aux impay\u00e9s<\/p>\n<p>L\u2019exigence d\u2019une preuve sp\u00e9cifique du pr\u00e9judice subi<\/p>\n<p>La d\u00e9cision rappelle le principe selon lequel le d\u00e9faut de paiement des charges peut causer un pr\u00e9judice distinct. &#8220;Si la carence d&#8217;un copropri\u00e9taire dans le paiement r\u00e9gulier de ses charges peut causer \u00e0 l&#8217;ensemble des autres copropri\u00e9taires un pr\u00e9judice autonome indemnisable ind\u00e9pendamment des int\u00e9r\u00eats moratoires, encore incombe-t-il au syndicat des copropri\u00e9taires d&#8217;\u00e9tablir la preuve de ce pr\u00e9judice autonome.&#8221; (Motifs de la d\u00e9cision) Cette exigence de preuve constitue un garde-fou contre les demandes abusives. Elle rejoint la solution d\u00e9gag\u00e9e par d\u2019autres juridictions exigeant une d\u00e9monstration concr\u00e8te. &#8220;Toutefois le syndicat des copropri\u00e9taires ne d\u00e9montre pas le pr\u00e9judice qui en d\u00e9coule et notamment le d\u00e9s\u00e9quilibre dans la tr\u00e9sorerie que l\u2019impay\u00e9 de charges de 140,24 euros aurait cr\u00e9\u00e9.&#8221; (Tribunal judiciaire de Paris, le 9 septembre 2025, n\u00b025\/02782) La port\u00e9e de ce principe est ainsi confirm\u00e9e et pr\u00e9cis\u00e9e.<\/p>\n<p>L\u2019appr\u00e9ciation souveraine des indices caract\u00e9risant le pr\u00e9judice<\/p>\n<p>En l\u2019esp\u00e8ce, les juges du fond estiment la preuve rapport\u00e9e par la dur\u00e9e et le montant des impay\u00e9s. &#8220;En l&#8217;esp\u00e8ce, alors que les d\u00e9fendeurs \u00e9taient redevables de plus de 12 000 euros d\u2019arri\u00e9r\u00e9s, correspondant n\u00e9cessairement \u00e0 plusieurs ann\u00e9es d\u2019impay\u00e9s de charges de copropri\u00e9t\u00e9, il est \u00e9vident que leur comportement qui a perdur\u00e9 dans le temps a caus\u00e9 un pr\u00e9judice financier \u00e0 la copropri\u00e9t\u00e9.&#8221; (Motifs de la d\u00e9cision) Cette \u00e9vidence tir\u00e9e des circonstances de la cause dispense d\u2019une d\u00e9monstration comptable d\u00e9taill\u00e9e. La valeur de cette d\u00e9cision r\u00e9side dans l\u2019admission d\u2019une pr\u00e9somption de pr\u00e9judice pour les arri\u00e9r\u00e9s importants et anciens. Elle op\u00e8re ainsi une distinction pragmatique avec les cas d\u2019impay\u00e9s minimes ou ponctuels.<\/p>\n<p>La modulation de l\u2019indemnisation forfaitaire accord\u00e9e<\/p>\n<p>La prise en compte des circonstances att\u00e9nuantes pour le d\u00e9biteur<\/p>\n<p>Le tribunal a fix\u00e9 le montant des dommages et int\u00e9r\u00eats \u00e0 mille euros en consid\u00e9ration de certains \u00e9l\u00e9ments. &#8220;Ce pr\u00e9judice sera r\u00e9par\u00e9 par l\u2019allocation d\u2019une somme de 1 000 euros, eu \u00e9gard n\u00e9anmoins \u00e0 leurs tanti\u00e8mes limit\u00e9s (118\/10 000) dans la copropri\u00e9t\u00e9 et en l\u2019absence de toute condamnation ant\u00e9rieure.&#8221; (Motifs de la d\u00e9cision) La faiblesse des tanti\u00e8mes et l\u2019absence d\u2019ant\u00e9c\u00e9dent sont ainsi \u00e9rig\u00e9es en circonstances att\u00e9nuantes. Cette individualisation de la r\u00e9paration temp\u00e8re la rigueur du principe de responsabilit\u00e9. Elle montre que la sanction p\u00e9cuniaire vise moins \u00e0 punir qu\u2019\u00e0 r\u00e9parer un trouble objectif \u00e0 la gestion collective.<\/p>\n<p>La condamnation compl\u00e8te aux frais de proc\u00e9dure engag\u00e9s<\/p>\n<p>La d\u00e9cision condamne en outre les d\u00e9biteurs aux d\u00e9pens et \u00e0 une somme au titre de l\u2019article 700 du code de proc\u00e9dure civile. &#8220;Les d\u00e9fendeurs, qui n\u2019ont r\u00e9gl\u00e9 leur dette qu\u2019apr\u00e8s avoir \u00e9t\u00e9 assign\u00e9s devant la pr\u00e9sente juridiction, et qui perdent leur proc\u00e8s, seront condamn\u00e9s aux entiers d\u00e9pens, ainsi qu\u2019\u00e0 verser la somme de 1 500 euros au syndicat des copropri\u00e9taires au titre des frais de proc\u00e9dure.&#8221; (Motifs de la d\u00e9cision) Cette condamnation distingue les frais irr\u00e9p\u00e9tibles du pr\u00e9judice autonome d\u00e9j\u00e0 r\u00e9par\u00e9.
